para solicitar, tramitar, obtener y recabar de las
oficinas y autoridades nacionales del Perú
(INDECOPI, SENASA, DIGESA, DIGEMIN NIC-PE), la
obtención de patentes de invención, certificados de
protección, registros de diseños industriales y
modelos de utilidad, registros de marcas de
productos o servicios, nombres comerciales, lemas
comerciales, marcas colectivas y de certificación,
nombres de dominio, programas de computación,
base de datos, software, la protección de secretos
industriales con facultad de depósito ante Notario y,
en general, cualquier elemento de Propiedad
Industrial y Derechos de Autor, facultándoles de
manera expresa para dar ante dichas autoridades
todos los pasos necesarios incluyendo, sin
limitación, el preparar, suscribir, presentar y
tramitar
solicitudes,
hacer
declaraciones,
declaraciones juradas, pagar tasas, contribuciones e
impuestos, incluyendo honorarios de peritos,
ordenar las publicaciones de ley, recabar los títulos
o certificados, solicitar renovación, cancelación de
registros, desistimientos y renuncia de derechos de
registros obtenidos; formular observaciones a
solicitudes de registro presentadas por terceros,
contestar observaciones y/u oposiciones, interponer
recursos de cancelación y de nulidad de Derechos
de la Propiedad Industrial y de Derechos de Autor de
propiedad de terceros, desistirse de los mismos,
celebrar convenios transaccionales, y acceder a la
mediación, a propuestas de conciliación o celebrar
cualquier tipo de convenio que resuelva el conflicto,
incluyendo acuerdos de coexistencia, defender
acciones de cancelación y nulidad de registro;
solicitar la inscripción de contratos de transferencia
de tecnología extranjera, licencias, transferencias,
cambios de nombre, cambios de domicilio, fusiones
y en general, de todo acto modificatorio de registro,
aceptar transferencias que terceros hagan a favor
del poderdante suscribiendo, para el efecto, los
contratos correspondientes, incluyendo cláusulas de
sometimiento a arbitraje, solicitar modificaciones a
la descripción de productos o servicios de registros
As attorneys with special and sufficient powers to
apply for, proceed, and obtain from the Competent
National Offices and Authorities of Peru (INDECOPI
and/or PE-NIC), the issuance of invention patents,
certificates of protection, registrations of industrial
designs and utility models, registrations of
trademarks and service marks, trade names,
commercial
slogans,
collective
marks
and
certification marks, domain names, computing
programs, database, software, protection of
industrial secrets or know-how with right of deposit
before Notary, and in general, any other element of
Industrial Property and Copyright recognized by the
legislation of the Republic of Peru, being empowered
to take all necessary steps before the said
authorities for the objects stated above, including
without any limitation to prepare, sign, file and
prosecute applications, make declarations, legal
declarations, pay taxes and all official fees including
examiner’s fees, order publications and notices as
required by law, succeed in getting titles or
certificates, to apply for renewals and cancellation of
registrations obtained by the person who grants the
power of attorney, to make observations to
applications filed by third parties, to answer
observations and/or oppositions, to file cancellations
and nullities of Industrial Property rights and
copyrights owned by third parties, to withdraw such
actions, celebrate transactions, and to agree to
mediation, to conciliation proposals or to celebrate
any other type of agreement which end the conflict,
including coexistence agreements, to defend any
register cancellation or nullity actions, to apply for
the recordal of agreements of foreign technology
assignment, licenses, assignments, changes of
name, changes of address, mergers, and, in general,
any modifying act of registration, to accept
assignments that third parties perform on behalf of
the person who grants the power of attorney signing

renovación; interponer acciones por violación de las
normas de Represión de la Competencia Desleal, de
infracción de derechos de Propiedad Industrial y de
Derechos de Autor, denuncias por violación de
Normas de Publicidad Comercial y Protección al
Consumidor, de Libre Competencia y por violación
de normas sobre Dumping y Subsidios ante
cualquier organismo competente, con todas las
facultades

incluyendo
la
de solicitar
inspecciones, nombrar y aceptar el nombramiento
de peritos, conducir diligencias preparatorias y
actuar pruebas,
contestar acciones de infracción de Derechos de
Propiedad Industrial, denuncias por competencia
desleal y de violación de Normas de Publicidad, de
Protección al Consumidor y de Derecho de Autor
formuladas por terceros contra el poderdante,
representándolo durante todo el procedimiento
administrativo
correspondiente,
solicitar
la
reconsideración de resoluciones administrativas y la
adopción de medidas cautelares así como el pago de
los costos del procedimiento. Quedan igualmente
facultados para interponer todo tipo de recursos
impugnativos, incluyendo reconsideraciones, quejas,
apelaciones y nulidades, solicitar declaraciones
testimoniales, formular desistimientos, interponer
reclamos. Asimismo, quedan facultados para
interponer
acciones
judiciales
contenciosoadministrativas de impugnación, nulidad o revisión
de acto o resoluciones administrativas, así como
para interponer acciones judiciales de cambio de
razón y/o denominación social y para representarnos
como demandantes, demandados o terceros
intervinientes en acciones civiles y constitucionales
de toda índole, incluyendo la defensa en acciones de
impugnación o nulidad o revisión de acto o
resoluciones administrativas, interpuestas por
terceros, llegar a acuerdos, someter a arbitraje,
solicitar declaraciones y testimonios, y apelar con
las facultades generales y especiales a que se
refieren los artículos 74° y 75° del Código Procesal
Civil y, en especial las facultades de realizar todos
los actos de disposición de derechos sustantivos y
para demandar, reconvenir, contestar demandas y
reconvenciones, deducir excepciones y contestarlas,
desistirse del proceso y de la pretensión, allanarse a
la pretensión, conciliar, transigir, someter a
arbitraje, delegar o sustituir el poder, prestar
declaraciones y confesiones, interponer o formular
denuncias ante el Fuero Penal o Criminal por delito a

interponer recursos impugnativos y de celebrar

all sufficient powers required for the corresponding
actions, including the request of inspections, to

conduct preparatory proceedings and offer evidence,
to answer infringement actions based on violations
of Industrial Property rights, Copyrights, and unfair
competition actions, as well as actions for violation
of Advertising and Consumer Protection Legislations
filed by third parties against our company, with full
power to represent it in the whole corresponding
administrative procedure, to apply for the
reconsideration of administrative resolutions and the
adoption of preventive measures as well as the
payment for the administrative proceedings. They
are also empowered to file any type of impugning
resources, including reconsiderations, complaints,
appeals, and nullities, to request testimonial
declarations, to lodge withdrawals of complaints, to
present claims. They are also empowered to lodge
impugning court action seeking reversal, nullity or
revision of acts or administrative resolutions, as well
as court actions seeking change of trading name
and/or corporate name and to represent us as
plaintiff, defendants, or third parties who intervene
in civil and constitutional actions initiated against
our company, with all such powers as may be
required, including the defense in impugning actions,
nullity or revision of administrative resolutions,
presented by third parties, to make arrangements,
submit to arbitration, request declarations and
testimonies, and to appeal, with general and special
powers as stated in Articles 74 and 75 of the Civil
Procedure Code, and particularly with the powers to
make all the acts of regulation of fundamental rights
and to file the complaint, to counterclaim, to answer
complaints and counterclaims, to file exceptions and
to answer the same, to withdraw the claims and the
process, to accept the claims, to conciliate, to reach
a settlement, to submit to arbitrations, to delegate
or substitute this power, to render testimony and
declarations, to file actions before the Criminal
Courts for violation of Industrial and Intellectual

This document expressly ratifies the validity of all
acts, applications, acts of petitions that the above
mentioned persons have conducted in our name in
respect to any Industrial Property Right and
Copyright and in relation to the powers abovementioned, before the issuance and signature of this
document. The attorneys will, finally, have powers
to substitute, delegate or revoke this power of
attorney.
