El C. Juez de primera instancia permitió que el inculpado exprese en actas las
razones por las cuales no se presentó a declarar a pesar de haber recibido un
auto de presentación expedido por el C. Juez que tiene conocimiento de la
causa.
The trial Judge allowed the defendant to state on the record the motives for
failing to appear to testify despite the fact that he had received a subpoena
issued by the Court hearing the case.
El inculpado expresó lo siguiente: “Yo nunca recibí la orden judicial. A lo mejor
mi vieja la recibió y la tiró. O a lo mejor la recibió mi chavo y no me la entregó. La
verdad es que no recibí nada y creo que no debería ser sancionado por no
presentarme. Le prometo Señor Juez que esto no va a suceder jamás. De ahora
en más, yo seré la persona que recibirá la correspondencia en mi casa para
evitar que algún escuincle me la tire a la basura. Permítame pedirle disculpas y
le doy mi palabra que esto no sucederá.”
The defendant stated the following: “I never received the court order. Perhaps my
old lady received it and threw it away. Or perhaps my kid received it and did not
give it to me. The truth of the matter is that I did not receive anything and I
believe that I should not be punished for not appearing. I promise Judge that this
will not ever happen again. From now on, I will be the one who will receive the
mail at home to prevent that any brat throws it to the trash. I apologize and I give
you my word that this will not happen.”
El C. Juez decidió citar al inculpado y requerir la presentación de tres
documentos adicionales para el 3 de mayo de 2010.
The Judge decided to subpoena the defendant and to subpoena three additional
documents for May 3rd, 2010.
