Explanatory statement. The
constitution currently prohibits
the operation of lotteries except
for specifically authorized
lotteries. A raffle is a lottery and
is illegal under current law.
A vote for this proposition
would permit the legislature
to authorize charitable raffles
operated or conducted by
religious, charitable, fraternal,
educational and veterans
nonprofit organizations subject
to the limitations listed.
Nonprofit organizations would
be prohibited from contracting
with a professional lottery vendor
to manage, operate or conduct a
charitable raffle.
A vote against this proposition
would continue the current
prohibition against all raffles.
Shall the following be adopted?

§ 3d. Regulation of “raffles”
authorized. Notwithstanding the
provisions of section 3 of article
15 of the constitution of the state
of Kansas, the legislature may
authorize the licensing, conduct
and regulation of charitable
raffles by nonprofit religious,
charitable, fraternal, educational
and veterans organizations. A
raffle means a game of chance
in which each participant buys a
ticket or tickets from a nonprofit
organization with each ticket
providing an equal chance
to win a prize and the winner
being determined by a random
drawing. Such organizations shall
not use an electronic gaming
machine or vending machine to
sell tickets or conduct raffles.
No such nonprofit organization
shall contract with a professional
raffle or other lottery vendor to
manage, operate or conduct any
raffle. Raffles shall be licensed
and regulated by the Kansas
department of revenue, office of
charitable gaming or successor
agency.

Exposición de motivos.
Actualmente, la Constitución
prohíbe la operación de loterías
con excepción de las loterías
específicamente autorizadas.
Una rifa es una lotería y es ilegal
bajo la ley actual.
Un voto a favor de esta propuesta
permitiría a la legislatura a autorizar
rifas para la caridad operadas o
llevadas a cabo por organizaciones
religiosas, caritativas, fraternales,
educativas y no lucrativas de
veteranos sujeto a las limitaciones
listadas. Las organizaciones sin
fines de lucro quedarían prohibidas
de contratar a un proveedor de
lotería profesional para administrar,
operar o realizar una rifa benéfica.
Un voto en contra de esta
propuesta seguiría la prohibición
actual contra todas las rifas.
¿Se debe adoptar lo siguiente?

disposiciones la sección 3 del
artículo 15 de la Constitución del
estado de Kansas, la legislatura
podrá autorizar la concesión
de licencias, conducción
y la regulación de las rifas
benéficas por organizaciones
sin fines de lucro religiosas,
caritativas, fraternas, educativas
y de veteranos. Un sorteo
significa que un juego de azar
en el que cada participante
compra un boleto o boletos
de una organización sin fines
de lucro con el que cada
boleto proporciona la misma
oportunidad de ganar un premio
y el ganador se determinará
por un sorteo al azar. Dichas
organizaciones no utilizarán una
máquina de juegos electrónicos
o máquinas expendedoras
para vender boletos o realizar
rifas. Tal organización sin fines
de lucro no deberá contratar
a un profesional de rifas u
otro proveedor de lotería para
administrar, operar o realizar
cualquier rifa. Las rifas deberán
tener una licencia y ser regulada
por el Departamento de Ingresos
de Kansas, oficina del juego
caritativo o agencia sucesora
(Kansas department of revenue,
office of charitable gaming or
successor agency).
