PROVISIONAL RESOLUTION OF 24 JUNE 2015 FOR ANDALUCÍA TALENT HUB FELLOWSHIPS IN ACCORDANCE WITH THE REGULATIONS OF ORDER OF JULY 24, 2014 OF THE REGIONAL MINISTRY OF ECONOMY, INNOVATION, SCIENCE SCIENCE AND EMPLOYMENT ESTABLISHING THE RULES AND FOUNDATIONS OF THE ANDALUCÍA TALENT HUB FELLOWSHIP PROGRAM FOR TRANSNATIONAL MOBILITY OF RESEARCHERS. Considering applications received for the Andalucía Talent Hub Fellowship Call governed by the Regulations of Order of July 24, 2014 of the Regional Ministry of Economy, Innovation, Science and Employment establishing the rules and foundations of the Andalucía Talent Hub Fellowship Program for transnational mobility of researchers, published in the Official Gazette number 148 of July 31, 2014, the following applies, FACTUAL BACKGROUND 1. 2. 3. 4. By Order of July 24, 2014 the rules and foundations of the Andalucía Talent Hub Fellowship Program are established and the Call for Applications of the Andalucía Talent Hub Fellowship Program is issued. The Call is open from January 15 to March 14, 2015 and 20 fellowships will be awarded. The applications have been received as stated in the Order of July 24, 2014 and administrative procedures have been followed in accordance with the provisions of Article 16 of the above mentioned order. The applications have been evaluated by the Selection Committee constituted as provided in section 13 of the Call Summary of the Order of July 24, 2014. The Selection Committee of the Talentia Postdoc Program met in Cordoba June 3, 4 and 5 and has drafted its provisional outcome including nomination of the provisional beneficiaries and candidates on the reserve list for each mobility scheme and of the applicants that did not pass the evaluation process. As a result of the above facts the following applies, LEGAL FOUNDATION 1. 2. 3. 4. According to the provisions of paragraph 4 of article 16 of the Order of July 24, 2014 the Provisional Outcome lists the candidates who have obtained satisfactory marks in order to become provisional beneficiaries, and must include the amount to be granted. It also lists waitlisted candidates, in order, with the amounts of the grants in case those would become provisional beneficiary. In accordance with paragraph 8 of the Final Regulation of the Order of July 24, 2014, the number of candidates on the reserve list is limited to 10 under each mobility scheme. In line with paragraph 13 of the Call Summary of the Order of July 24, 2014 the Selection Committee is the competent body to carry out the evaluation of the applications and draft the provisional outcome. Furthermore, according to paragraph 13 of the Call Summary of the Order of July 24, 2014 the Managing Directorate of the Andalusian Knowledge Agency is the entitled body to determine the outcome as described in article 115 of the revised text of the General Finance Law of the Junta de Andalucía. The awarding of a fellowship to the 20 candidates listed in Annex I of the Provisional Outcome as provisional beneficiaries. Annex II lists the candidates on the reserve list, which will become beneficiaries in case vacancies happen before the Final Outcome is drafted. Annex III lists candidates that did not pass the evaluation process as foreseen in the Order of July 24, 2014. As established in Article 17 of the Order of July 24, 2014, applicants will have a period of 10 days to: a) Claim following the terms provided in Article 84 of Law 30/1992 of November 26. b) Redraft the application provided that the amount of the Fellowship in the provisional outcome is less than the amount in the Application, in order to adjust the obligations and conditions. c) Accept the nomination. The provisional outcome is deemed accepted when: 1.º Provided that the amount of the Fellowship in the provisional outcome is less than the amount in the Application and no redraft / withdrawal has been presented. 2.º When no withdrawal was communicated for the provisional outcome and its amounts as in the application. The provisional beneficiaries and the candidates on the reserve list must provide together with Annex II the documents stated in the Application and paragraph 15 of the Call Summary of the Order of July 24, 2014. The documents must be originals or certified copies. Form Annex II and all documents may be presented as stipulated in paragraph 10.c) 15 of the Call Summary of the Order of July 24, 2014. Assuming the application is submitted online, the documents may be digitalized copies, using advanced electronic signature. Digitalized copies imply the authorization to the managing body to access and process personal information. In the event candidates fail to provide with the requested documents within the 10 working days period: a) When documents refer to eligibility criteria, they will lose the condition of beneficiary. b) When documents refer to merits, evaluation will be corrected, discounting marks given according to nonaccredited merits. Beneficiaries and candidates on the reserve list must provide documental proof of their position regarding eligibility criteria established in section 4.a).2.º of the Call Summary of the Order of July 24, 2014, and according to the declaration made during application, as follows: a) Doctorate holder: Hold a PhD degree obtained within 10 years before the deadline of Applications of the Call. Situations such as temporary disability, maternity leave, adoption or foster care may interrupt and must be credited and demonstrated by providing supporting documentation. These periods entail the corresponding extension in the previous accounting period of time from the date of obtaining the doctorate. b) Mobility: At the deadline of Applications of the Call, the candidate must be: 1º Non-resident of the country where the Research Project will take place, unless being resident in Spain in the frame of a return phase of an outgoing mobility scheme. 2º Researchers must not have resided or carried out their main activity (work, studies, etc.) in the country of their host institution for more than 12 months in the 3 years immediately prior to the reference date. 3º For the outgoing mobility scheme, be resident of EU Member State or Associated Country c) Holding an invitation to a reputed research institution which would act as host to carry out a research project. (Annex III) d) Holding an agreement with an entity associated to a Campus of International Excellence of Andalucía that is registered as Agent of the Andalusian Knowledge System, which will act as contracting entity during the whole 24 months period. (Report of Working Life or similar legally valid). 4º Admission/invitation: document from a host institution where completion of the research project will take place in accordance with the provisions of paragraph 4.a).2º.1.e) and annex III 5º Commitment Letter: commitment by a contracting entity to conduct recruitment in accordance with the provisions of paragraph 4.a).2º.1.f) and annex IV. b) Accreditation of merits declared for evaluation should be made with any documents supporting those merits. c) Accreditation on the circumstance of having dependents by providing a certified copy of any legally binding document or official document certifying dependency status of a member of the family unit to the first degree of consanguinity or affinity. d) In the event any interruption of the scientific career is declared, any documentation supporting that interruption. According to article 18 of the Order of July 24, 2014, the Andalusian Agency of Knowledge will analyze claims, verify documents and formulate proposal of final resolution, whose amount could not exceed maximum budget allocated for the call. The Research Activity will have a duration of 24 months and should start not later than October 1, 2015. Before the start of the Research Activity, the collaborating entity that has signed Annex IV of the Order of July 24, 2014 will have to sign the model Agreement Annex V with the Andalusian Agency of Knowledge. Andalucía Talent Hub is financed with the community programme OP05010203, project 2014000205, service 13, ‘other EU funds’, in the budget chapter 0.1.11.00.13.00. .740.23.54A, sourced with funds from: a) Junta de Andalucía (60%): 5.623.921 euro. b) b) The European Union (40%) through the Grant Agreement number 291780 of EU 7th Framework Programme via the Marie Curie Action, “Co-funding of Regional, National and International Programmes”: 3.749.281 euro. The planned expenditure is 3.155.721,71 euros, distributed annually as follows: 2015 2016 2017 394.465,21 € 1.577.860,86 € 1.183.395,64 € 15. The funds will be transferred to the contracting entities that will hire the researchers as foreseen in the Order of July 24, 2014 once they have signed the agreement according to Annex V of the Order. 16. The payment method will be anticipated by a maximum of 75% of the funds, through quarterly advances of 12,5% of the total Fellowship as established in paragraph 24.b) of the Call Summary of the Order of July 24, 2014. 17. In accordance of paragraph 8.g) of the Call Summary of the Order of July 24, 2014, the collaborating entities must fulfill the following criteria: a) Be a knowledge generation agent of the Andalusian Knowledge System, essentially universities and public research institutions in Andalucía. (Law 16/2007, December 3, Science and Knowledge Act and Decree 254/2009, of May 26). b) Be an entity aggregated to a Campus of International Excellence with premises in Andalucía. c) Meet the requirements set by paragraph 2.2.d) of the Community Framework for State Aid for Research, Development and Innovation (2006/C 323/01) to be considered as a Research Institute: a body such as university or research institute, irrespective of its legal status (organized under public or private law) or way of financing, whose primary goal is to conduct fundamental research, industrial research or experimental development and to disseminate their results by way of teaching, publication or technology transfer; all profits are reinvested in these activities, the dissemination of their results or teaching; undertakings that can exert influence upon such an entity, in the quality of, for example, shareholders or members, shall enjoy no preferential access to the research capacities of such an entity or to the research results generated by it. 3 - 14 c / Max Planck 3, Edificio Iris 1, 41092 Isla de la Cartuja, Sevilla Telf.: 955 04 58 00- Fax: 955 05 82 01 Email: [email protected] Este proyecto ha recibido fondos del Séptimo Programa Marco de la Comunidad Europea para investigación, desarrollo tecnológico y demostración bajo el acuerdo de concesión nº 291780 18. According to section 8.g) of the Call Summary of the Order of July 24, 2014, the obligations of the contracting entities are: a) Establish a working relationship with the beneficiaries in accordance with the provisions of these regulations. b) Pass the funds received to the beneficiaries according to the regulations. c) Report on the economic incentive. d) Forward to the Andalusian Knowledge Agency the reporting required to the beneficiaries. e) Commit to the principles of the European Charter for Researchers and The Code of Conduct for the Recruitment of Researchers. f) In line with the rationale and principles of the People Program within the FP7, the Research Project will be approved by an ethical review board. The ethical review board will verify that the Project complies with their destination’s national and regional regulations regarding ethics, as well as with the limitations imposed by the ethical rules applying to the EU's Seventh Framework Programme for Research. Prior to the signing of the contract it will be reviewed by the Ethics Committee. The ethical aspects of the research project will be subjected to specific monitoring along the project (Decision 2006/1982/EC of the European Parliament and the Council of December 18, 2006).Colaborar en la restitución de las subvenciones otorgadas en los supuestos en que concurra causa de reintegro en los términos que indica el Título II de la Ley 38/2003, de 17 de noviembre, sin perjuicio de lo dispuesto en la Ley 30/1992, de 26 de noviembre. g) Collaborate in the procedure of refund when required. h) Adhere to all monitoring and control of the Research Project by Junta de Andalucía and the European Union as well as allow verification and control processes by Andalusian Agency of Knowledge, European Union as well as by any other competent institution, providing requested information. i) Return funding in the event requirements and obligations are not fulfilled, and, in any case, according to article 37 of Ley 38/2003, of 17 November, General de Subvenciones. 19. Additionally, beneficiaries should comply with relevant obligations stated in article 24 of the Order of July 24, 2014. 20. According to section 26 of the Call Summary of the Order of July 24, 2014, reporting to Andalusian Knowledge Agency: a) Will be made by the contracting entities. b) Deadlines for reporting of transfers to contacting entities will be those established in section 24.b) of the Call Summary of the Order of July 24, 2014, one month after each period of three months. c) Equally, according to section 26.b) of the Call Summary of the Order of July 24, 2014, the final deadline for reporting after the end of the research project will be three months after the end of the research activities. d) The content of the reports will be the established at section 26.f).1.º of the Call Summary of the Order of July 24, 2014. e) Documents should be originals or certified copies. 21.
