Declaración conjunta del Gobierno de Gibraltar y de la oposición
Comisión especial de Revisión de la Constitución
Gibraltar, 4 de abril de 2016
El Gobierno y la oposición han acordado los próximos pasos relativos a la Comisión
parlamentaria especial de Revisión de la Constitución.
Así, el líder de la oposición ha accedido a nombrar a dos miembros de dicha Comisión. Los
nombres de los cinco miembros de la Comisión especial se incluirán en una propuesta de
resolución parlamentaria acordada entre el Ministro Principal y el líder de la oposición.
Las respectivas posturas del Gobierno y la oposición sobre esta cuestión son bien conocidas y
los correspondientes argumentos se enumeraron en el reciente debate parlamentario sobre la
propuesta de resolución.
El Gobierno mantiene su compromiso de que la Comisión especial lleve a cabo una revisión de
la Constitución de 2006, que podría dar pie (o no) a una propuesta de reforma de ciertas
partes del texto con el fin de avanzar en el proceso de retirada de Gibraltar de la lista de
territorios no autónomos elaborada por la Organización de Naciones Unidas.
La oposición participa con base en el entendimiento de que el Gobierno no busca redefinir la
relación de Gibraltar con el Reino Unido y de que no perjudicará su postura de que la
Constitución de 2006 brinda a Gibraltar el máximo nivel de autogobierno sin llegar a la
independencia, y de que la relación entre Gibraltar y el Reino Unido no se basa en el
colonialismo.
Teniendo en cuenta el calendario del Parlamento, que incluye el presupuesto, la Comisión no
podrá iniciar realmente su labor hasta pasado el verano y por lo tanto, hasta después del
referéndum sobre la permanencia del Reino Unido y Gibraltar en la Unión Europea, que se
celebrará el 23 de junio de este año. No obstante, se constituirá la Comisión especial y sus
asesores técnicos comenzarán a recopilar la documentación necesaria para iniciar el trabajo
tras el receso estival.

BETWEEN THE GOVERNMENT AND THE OPPOSITION

Constitutional Review Select Committee
The Government and the Opposition have agreed a way forward in respect of
the Constitutional Review Select Committee of Parliament.
As a result, the Leader of the Opposition has agreed to nominate two members
to the Select Committee. The names of the five Members of the Select
Committee will be put to Parliament in a Motion agreed by the Chief Minister
and the Leader of the Opposition.
The respective positions of the Government and of the Opposition on this
matter are well known and the arguments were rehearsed during the recent
debate on the Motion in Parliament.
The Government is committed to a review by the Select Committee of the 2006
Constitution which may or may not result in a proposal to reform parts of the
Constitution but which will seek to further the process for Gibraltar to be
removed from the list of non-self-governing territories maintained by the United
Nations.
The participation of the Opposition is on the understanding that the
Government is not seeking to redefine Gibraltar’s relationship with the United
Kingdom and will be without prejudice to their position that the 2006
Constitution provides Gibraltar with the maximum level of self-government
short of independence and the relationship between Gibraltar and the United
Kingdom is not one based on colonialism.
It is now clear, given the parliamentary timetable which includes the Budget,
that the work of the Select Committee will not begin in earnest until after the
summer and therefore after the Referendum to be held on the 23rd June this
year on the UK and Gibraltar's continued membership of the European Union.
The Select Committee will however be constituted and its technical advisers will
start to compile the documentation required in order to commence work after
the summer recess.
