I he reby r eport the de tails of w hat pr ecipitated initiation of P reliminary Investigation No. 252004-UMAPC-LEV and the results thereof.
By means of official letter No. 000345-MFG-IP 146-03-MBI dated May 20, 2004, signed by Dr.
Mariana Yépez Andrade, former General District Prosecutor, I learned of the complaint lodged
by Dr. Genaro Peña Ugalde, Deputy Comptroller General of the State, against Texaco Petroleum
Company et a l., so tha t [ the ma tter] mig ht be i nvestigated a nd t he pe rtinent or ders m ight be
issued with respect to the existence of an environmental crime, which is under the jurisdiction of
this U nit. In this r espect, I ini tiated Preliminary Investigation No. 25-2004-UMAPC-LEV on
May 27, 2 004, w hich entailed c arrying out s everal pr oceedings i n or der t o de termine t he
existence of a ny environmental c rime [ as] de scribed i n t he C riminal C ode. H owever, upon
conclusion of the Preliminary Investigation phase, no c onduct was found that would be covered
by t he pe rtinent ar ticles of t he C riminal C ode w hich de scribe c rimes a gainst t he E nvironment
(Arts. 437 A to 437K) because the events occurred prior to the Amendment of the Criminal Code
which contains the description of the environmental crimes and which are clearly set forth and
well g rounded i n t he c ertified c opy of t he r ejection of t his pr oceeding, w hich I a ttach he reto,
which was filed in the province of Francisco de Orellana and in Sucumbíos on A pril 28 of this
year, after a meeting I held with the Deputy General District Prosecutor, Dr. Cecilia Armas d e
Tobar.

Moreover, I should point out that the Preliminary Investigation conducted by this Unit grew out
of Preliminary Investigation No. 146-2003 being conducted by the Office of the General District
Prosecutor, [ which] c ase w as i nitiated be cause of a c omplaint l odged b y Dr. G enaro P eña
Ugalde, Deputy Comptroller General of the State, against Texaco Petroleum Company et al., as
indicated before, which is still being processed in that office and which deals with other types of
crimes.
In c oncluding I should point out t hat, b y m eans of of ficial l etter No. 28 2-2005-UMAPC-LEV
dated M ay 9 of t his year, t he unde rsigned s ent a dul y certified copy of t he e ntire case file
processed in this Unit to Ms. Deputy General District Prosecutor so that she would be aware of it
and issue the pertinent instructions.
