THE MINISTER OF COMMUNICATIONS, TRANSPORT, PUBLIC WORKS
AND HOUSING
Exercising the powers conferred upon him by section 194(f) of the Political Constitution
of the Republic of Guatemala, sections 20 and 27(c) and (f) of the Executive Authority
Act, sections 47 and 48 of the Government Procurement Act, Decree no. fifty-seven
dash ninety-two (57-92) of the National Congress,
AGREES THE FOLLOWING:
TO APPROVE THE ELEVEN (11) CLAUSES in contract number seventeen dash
ninety-nine dash DGC dash Emergencia [Emergency] (17-99-DGC-EMERGENCIA),
signed on February the thirteenth (13) nineteen ninety-nine (1999), by and between
Engineer JOSÉ WILFREDO GARCÍA BARRIENTOS, in his capacity as Director
General of the General Roads Directorate, and JUAN JOSÉ ESTRADA MAYEN,
Legal Representative of the corporation “TRANSPORTES J.J. ESTRADA,” which
undertook the Rehabilitation works on the Railroad Track, section Mile 163 to 169
Cucajol – Carrizo; section Mile 165 from 22 to 25 Dolores; section Mile 147 Cromo
– El Progreso; section Mile 194 to 191 from 7 to 14 La Barrera – Rodriguitos, a
structure that was damaged by HURRICANE MITCH. The contract amount is for
GTQ two million, seven hundred and twenty-three thousand, three hundred and sixtytwo, sixty-three cents (GTQ 2,723,362.63), Value Added Tax included, charged against
item no. 99-013-11-01-055-51-331-30-52109, from loaned funds, and counterpart item
no. 99-013-11-01-055-51-331-30-41037 from the Government’s General Budget.

BARREDA/RODRIGUITOS, HEREBY CERTIFIES THAT, TO SUCH EFFECT, SHE
HAD BEFORE HER MINUTES No. 4, LITERALLY READING: ------------------------MINUTES No. 4 In the Municipality of San Antonio La Paz, El Progreso Department,
at 10 a.m. on this 15th day of November nineteen ninety-eight, Engineer JORGE
MARIO CORONADO BROLO, the Supervisor appointed by the General Roads
Directorate of the Ministry of Communications, Transport, Public Works and Housing,
and Contractor JUAN JOSE ESTRADA from the Company J.J. ESTRADA, hereby
convene to record the following: ------------------------------------------------------------------FIRST: Supervising Engineer JORGE MARIO CORONADO BROLO, delegate of the
General Roads Directorate of the appropriate Ministry, personally states the need to
undertake the works to enable the use of the railroad line, section Mile 163 to 169 El
Cucajol/Carrizo, section Mile 165 from 22 to 25 Dolores, section Mile 147 Cromo - El
Progreso, section Mile 194 to 191 from 7 to 14 La Barrera/Rodriguitos, that was
damaged by HURRICANE MITCH. He adds that, to this effect, he has received from
Engineer JORGE MARIO CORONADO BROLO, Supervisor, the charts with the work
items that need to be executed for the rehabilitation of the line section identified herein.
SECOND: In turn, Contractor JUAN JOSÉ ESTRADA MAYEN states that he has
reviewed, jointly with the Supervisor, the charts with the work items that are annexed as
ANNEX “A,” “B,” “C,” and “D” hereto, undertaking to perform the works as specified
by the GENERAL ROADS DIRECTORATE representatives. ------------------------------THIRD: The appearing parties declare to acknowledge the contents hereof and, there
being nothing further to record, this meeting is adjourned in the same place and on the
same date specified above, at 11:30 a.m. Agreeing to endorse the necessary copies to be
referred as appropriate, and having read these minutes, they ratify, accept and sign them
