DECARLOS RESTAURANT: PAGUE LA INDEMNIZACIÓN A LOS EMPLEADOS DESPEDIDOS SIN CAUSA JUSTA Mi nombre es Norma Escobar y soy guatemalteca. Yo hago esta petición porque no estoy de acuerdo con que los dueños de restaurantes o cualquier trabajo le botan a uno sin hacer nada. Sean que solo piensan en ellos y en el bienestar de los trabajadores no. En el tiempo que uno les esta trabajando, les esta entrando el dinero, y es por todo nosotros los trabajadores. Trabajamos por poco dinero, porque venimos a trabajar. Que paso? En mi trabajo fue un despido sin justificación. Me entre a trabajar en DeCarlos Restaurant en Abril del 2015, como dishwasher. Yo gane el salario mínimo de $10.50, aunque empezaron a pagar el mínimo el 5 de julio, no el 1 de julio como se debería. Es un trabajo pesado, levantando los costales de papa, cebolla, guardando delivery, y lavando por la cantidad de gente que viene a comer. El lunes 26 de octubre, cuando me presenté al trabajo, ya estaba otra persona trabajando en mi lugar. No hubo explicación porque no iba a trabajar. El chef solamente dijo por teléfono, “go home”, que me fuera a casa. Mi companera de trabajo me dijo que el chef la había dicho a ella que necesitaba un hombre de dishwasher, no una mujer. Cual ha sido el impacto del despido? Ahorita no estoy trabajando, y no entra el dinero. Gasto en renta, en comida, teléfono, y mandarles a mis dos hijos que son menores de edad y que estudian allá en Guatemala. Cual es el motivo? Quiero que me paguen una indemnización de $2,400, dos meses de trabajo, y que ellos siempre les paguen la indemnización de dos meses a cualquier persona despedida sin una causa justa. Si de la noche a la mañana se queda uno sin trabajo, entonces del trabajo vivimos, comemos, pagamos los gastos, y es injusto lo que ellos hacen. Es como si solamente pensaran en el bienestar de ellos y no el trabajador. Pidiendo a la gente trabajadora que nos apoyen para que todos los dueños de empresas, restaurantes, no se porten de esta forma con nosotros los trabajadores, porque nosotros somos personas humanas que piensen que todos somos hijos de Dios, seamos de cualquier país. No es justo lo que hacen, porque eso le ha pasado a muchas personas, no solo a mi, pero se queda impune y la gente se queda callada. Es bueno que todos nos unamos para poder hacer justicia que ya las personas no se porten asi y dejar sin trabajo a uno sin motivo, sin complaint, sin nada, o por solamente no caerle bien a la persona. Eso no es correcto. No le agrada a Dios. Les agradezco a las personas que están de acuerdo conmigo y que firmen esta petición. I am starting this petition because I do not agree with restaurant owners or any businesses that fire a worker for no reason. They only think about themselves and not about the well­being of the workers. By working for them, they are earning money because of us, the workers. We work for little money, because we’ve come to this country to work. What happened? I was fired for no reason from my job. I started to work at DeCarlos Restaurant in April, 2015, as a dishwasher. I earned the minimum wage of $10.50 per hour, although they started to pay me that wage on July 5, 2015, not on July 1 like they should have. It’s hard work, lifting sacks of potatoes, onion, putting away the deliveries, and washing for the number of people that go there to eat. On Monday, October 26, when I went to work, there was already someone else working in my place. There was no explanation for why I was not scheduled to work. The chef only said over the phone, “go home.” My coworker told me that the chef had told her that he needed a man to be the dishwasher, not a woman. How did being fired impact me? Now I’m not working, not earning money. But I still have to pay rent, buy food, pay my phone, and send money to my children who are studying in Guatemala. What is my goal? I want for DeCarlos Restaurant to pay me a severance of $2,400, two months’ wages, and for them to always pay a severance of two months’ wages to anyone fired without just cause. If from one day to another you’re left without work ­ and we need to work to live, we eat, pay our bills ­ it’s unjust what the bosses do. It’s as if they only think about their own well­being and not the well­being of the workers. I ask that all working people support us so that all the business and restaurant owners don’t behave this way with us, their workers, because we are human beings who believe that we are all children of God, no matter what country we’re from. It isn’t fair that they can do that, because this has happened to many people, not just to me, but they aren’t punished and the people stay silent. It is good for us to unite so that we can achieve justice and make it so that they can’t behave this way and leave someone without a job without a reason, who never had any complaints, with nothing, or just because they don’t like them.
