En la Gaceta Oficial N° 40.775, de fecha 27 de
Octubre de 2015, fue publicada la Providencia
mediante la cual se corrige por error material la
Providencia Administrativa Nº 070/2015, donde
se
regulan
las
modalidades
para
la
determinación, fijación y marcaje de precios en
todo el territorio nacional. (Reimpresión G. O N°
40.774 de fecha 26 de octubre de 2015).
An Order providing for amendments, due to
material error, to Administrative Order
No.070/2015 was published in Official Gazette
No.40,775 of October 27, 2015. The amended
Administrative Order is aimed at regulating the
modalities for price determination, setting, and
marking throughout the national territory.

Los cambios más resaltantes de la normativa son
los siguientes:

En el Artículo dos (2) de la Providencia, se
modifica el nombre de “Precio Máximo de Venta
del
Productor,
Importador
o
Prestador
Intermediario (PMVPI), y se cambia a “Precio
Máximo de Venta del Productor o Importador”
(PMVPI). El PMVPI queda definido como el precio
más alto, expresado en bolívares, que puede
asignar a determinado bien o servicio quien
produce o importa el bien.
También se cambia el concepto de Precio
Máximo de Venta del Productor o Importador y
se define como el precio más alto, expresado en
bolívares, que pueda asignar a determinado bien
o servicio, el sujeto de aplicación que produce o
importa dicho bien.
Asimismo se modificó el concepto de “Margen de
Intermediación”, que pasa a ser la relación
porcentual entre el Precio Máximo de Venta al
Público (PMVP), y el Precio Máximo de Venta del
Productor o Importador (PMVPI).
Se modificó el Artículo tres (3), y se alteraron las
definiciones de las categorías de precio
reguladas.
In Article two (2), the denomination of
Manufacturer/Importer/Supplier
Suggested
Retail Price (PMVPI, by its acronym in Spanish)
was
modified
to
Manufacturer/Importer
Suggested Retail Price (PMVPI). PMVPI is thus
defined as the highest price expressed in bolivars
assigned to a product or service by its producer
or importer.
The Manufacturer/Importer Suggested Retail
Price (PMVPI) is also defined as the highest price
expressed in bolivars assigned to a product or
service by the producer or importer subject to
this law.
“Intermediation Margin” is henceforth to be
construed as the percentile ratio between the
Maximum Retail Price (PMVP) and the
Manufacturer/Importer Suggested Retail Price
(PMVPI).
Article three (3) was also amended and the
definitions of the regulated price categories were
thus modified.
Se modificó el artículo 6 donde se establece que
el Margen máximo de intermediación permitido
para toda la cadena de distribución es de hasta
sesenta por ciento (60%).
Article 6 providing for the maximum
intermediation margin allowed for the entire
distribution chain of up to sixty percent (60%)
was likewise amended
En cuanto a variedades y excepciones, se
reforma el artículo 8 quedando redactado de la
siguiente forma: ”Cuando se trate de
variedades o de excepciones de productos ,
bienes, mercancías, o de presentaciones con
características, cuyo Precio Justo no hubiere
sido determinado, el sujeto de aplicación deberá
presentarlo a dicha Superintendencia a los fines
de realización de los análisis y estudios
referentes al impacto en la estructura de costos
sobre el precio final del bien o servicio, así
como la pertinencia, o no, de la fijación de su
precio por parte de dicha Superintendencia, de
conformidad con las disposiciones de esta
Resolución.”
Article 8 was modified with regards to the
product varieties and exceptions, and it shall
now read as follows: ”Those varieties and
exceptions of products, goods, merchandise,
and presentations, whose Fair Price were not
determined, shall be submitted to the SUNDDE
to perform the analyses and studies of the
impact on the cost structure from the final
product or service price, and the pertinence or
not of their price setting by the SUNDDE under
the provisions of this Order.”
El artículo 10, referente al establecimiento
voluntario de márgenes inferiores, se modifica
quedando redactado de la siguiente forma: “En
todo caso, los productores, importadores y
comercializadores de los bienes y servicios,
pueden establecer márgenes de ganancia y de
intermediación menores a los establecidos en
esta Providencia.”
Por último, se modificó el artículo 18 referente
a la prohibición de doble marcaje y enmiendas,
quedando redactado de la siguiente forma: “En
ningún caso se podrá marcar más de un Precio
Máximo de Venta al Público (PMVP) en un
mismo bien o servicio, remover las etiquetas,
tachar o enmendar el precio indicado
originalmente, ni fijar en listas precios
superiores a los marcados. Si se detectan
tachaduras o enmiendas, o se han fijado en
listas Precio Máximo de Venta al Público (PMVP)
superiores a los marcados, los sujetos de
aplicación serán objeto de las sanciones de ley.”
Article 190 relating to voluntary setting of
lower profit margins was modified and it shall
now read as follows: “Producers, importers and
retailers of products or services may set profit
and intermediation margins below those
established in this Order.”
Lastly, Article 18 regarding the prohibition of
double marking and alterations was also
modified and it shall now read as follows:
“Marking of more than one Maximum Retail
Price (PMVP) for a single product or service,
tag removal/erasure, or alterations to the
originally-marked price, and listing of new
prices over those previously marked, shall not
be allowed under any circumstances. If any
amendment or alteration is detected, or if the
Maximum Retail Price (PMVP) listed exceed
those previously marked, penalties shall apply
on those breaching the Law.”
