In connection with the questions raised in your letter of 3rd December 2013 please be
informed as follows:
Flight Time Limitation – Duration of Home Stand-by
As from July 2008 the flight time limitations are governed across Europe by Subpart Q
of Annex III to Regulation (EEC) No 3922/91 of 16 December 1991 on the
harmonization of technical requirements and administrative procedures in the field of
civil aviation, as amended by Regulation (CE) No 859/2008 (the “European FTL
Regulation”).
Further, in compliance with art. 6 of Regulation (EEC) No 3922/91, since we are a
Spanish carrier whose air operator certificate is under the supervision of the Spanish
aviation authorities (Agencia Estatal de Seguridad Aérea - AESA), we are also applying

the Spanish FTL regulations if more protective to our crew than the European FTL
Regulation. Please find below a detail of the applicable Spanish regulations regarding
flight time limitations (jointly the “Spanish FTL Regulations”)
a) Royal Decree No 1952/2009 of 18 December, approving the requirements
relating to flight time limitations, activity and rest of commercial air transport
crew (Real Decreto 1952/2009, de 18 de diciembre, por el que se adoptan
requisitos relativos a las limitaciones del tiempo de vuelo y actividad y
requisitos de descanso de las tripulaciones de servicio en aviones que realicen
transporte aéreo comercial);
b) Operative Circular 16-B, of 31 July 1995, approved by the Director-General of
Civil Aviation, on flight time limitations, maximum air activity and minimum rest
periods for crew (Circular Operativa 16-B, de 31 de julio de 1995, del Director
General de Aviación Civil, sobre limitaciones de tiempo de vuelo, máximos de
actividad aérea y periodos mínimos de descanso para las tripulaciones); and
c) Operative Circular of 17 December 2010, approved by the Director-General of
Civil Aviation, by which certain requirements relating to flight time limitations,
activity and rest of commercial air transport crew are interpreted and clarified
(Circular del Director General de Aviación Civil, de 17 de diciembre de 2010, por
el que se aclaran e interpretan los requisitos vigentes relativos a las limitaciones
del tiempo de vuelo y actividad y requisitos de descanso de las tripulaciones de
servicio en aviones que realicen transporte aéreo comercial)
Please be informed that we strictly apply the above mentioned rules in our
rostering.
With regard to the duration of the home standby, it is worth to note that according to
OPS 1.1125, paragraph 2.1, all forms of standby other than airport standby shall be
regulated by the authority that has granted the air operator's certificate (i.e. the
Spanish authorities). To this extent, the Spanish FTL Regulations provide for a
maximum duration of the home standby of 24h. However, we should highlight that
according to Volotea policy, we are programming a maximum home SBY of 18h, which
is significantly below the maximum permitted.
Finally and just for your information, we call your attention to the fact that, while the
Italian FTL regulations provide for a shorter duration of the home standby (i.e. 14h),
the Spanish FTL Regulation is more protective for crew in many cases. Please find
below some examples:

Maximum Flight Duty Time Daily Limit:
o In Spanish FTL maximum flight duty time for a day is up to 2 hours
shorter.

Minimum rest out of base for pilots is longer (i.e. more protective) in the
Spanish FTL Regulation. It is worth to note in this case we are applying the
same rest for cabin attendants (i.e 10.5h), which improves the minimum rest
under the Italian FTL rules.

In sum, Volotea is fully complying with the applicable FTL Regulations and, in some
cases, applying more protective conditions than those set forth in the regulations.
Italian Health Service
With regard to your question please be informed that Volotea is fully compliant with
the Italian laws regarding the use of the Italian Health Service by our cabin crew
(Servizio Sanitario Nazionale - SSN). However, we will ask for information on the SASN
(Servizio Assistenza Sanitaria Naviganti) in order to evaluate the services they offer for
crews.
