Illinois’ Parental Notice of Abortion Law

1. Under Illinois law if you decide to have an abortion and you are under 18 your doctor must notify an “adult
family member” before you can have the abortion.
2. An “adult family member” is someone who is your parent, grandparent, step-parent who lives with you, or
your legal guardian. With your permission, the doctor can tell whichever adult family member you choose.
3. NOTIFICATION is NOT CONSENT! Notification just means that your doctor lets the adult family member of
your choice know that you will have an abortion. The adult family member does not have to give you
permission to get the abortion and does not have the right to tell you you cannot get the abortion.
4. You do not have to notify an adult family member if:
 an adult family member goes to the doctor with you or gives up their right to notice in writing.
 your doctor decides that there is a medical emergency.
 you give your medical provider a written statement that says you are a victim of sexual abuse, neglect
or physical abuse by your adult family member.
 you are married, divorced, widowed or emancipated.
 you get an order from the court that says you don’t have to give notice after a successful “judicial
bypass” hearing.
5. A “judicial bypass” is when a judge gives an order that allows a minor to have an abortion without
notifying an adult family member. The judicial bypass hearing is free, fast and confidential. You also have a
right to a free lawyer.
6. The ACLU of Illinois Judicial Bypass Coordination Project has FREE lawyers who are specially trained to help
minors who want a judicial bypass. You can call, text or email for information on the parental notice law and

1. Bajo la ley de Illinois si decides tener un aborto y tienes menos de 18 años tu doctor tiene que notificar a un
“miembro adulto de tu familia” antes de que podrás tener el aborto.
2. Un “miembro adulto de tu familia” puede ser tu padre o madre, abuelo/a, padrastro o madrastra con quien tu vivas, o tu
guardián legal. Con tu permiso, el doctor puede notificar a cualquier miembro adulto de tu familia que eliges.
3. ¡NOTIFICACIÓN NO ES CONSENTIMIENTO! Notificación solo significa que tu doctor deja saber al miembro adulto
de tu familia de elegido que tú tendrás un aborto. El miembro adulto de tu familia no tiene que darte consentimiento
para el aborto y no tiene el derecho de decirle que no puedes tener el aborto.
4. No tienes que notificar a un miembro adulto de tu familia si:
 un miembro adulto de tu familia viene contigo al doctor o renuncia a su derecho a la notificación por escrito.
 tu doctor decide que hay una emergencia médica.
 le das a tu proveedor médico una declaración escrita que dice que eres una víctima de abuso sexual,
negligencia, o abuso físico por un miembro adulto de tu familia.
 eres casada, divorciada, viuda, o emancipada.
 obtienes una orden de la corte que dice que no tienes que dar notificación después de una audiencia exitosa
acerca de la excepción judicial.
5. Una “excepción judicial” (“judicial bypass” en inglés) es cuando un juez da una orden que permite a un menor
tener un aborto sin notificar a un miembro adulto de su familia. La audiencia de la excepción judicial es gratuita,
rápida, y confidencial. También tienes un derecho a un abogado/a gratuito.
6. El Proyecto de Coordinación de las Excepciónes Judiciales de la ACLU de Illinois tiene abogados/as GRATUITOS
