ACUERDO DE INTERCAMBIO DE ESTUDIANTES

LOS ANGELES, CALIFORNIA, USA
Universidad de Guadalajara CUdeG") y los Gobernadores de University of California, en
representación de su campus en Los Angeles CUCLA"), desean establecer un marco que
permita la búsqueda de colaboraciones académicas y de investigación mutuamente
benéficas e implementar un intercambio académico y entrenamiento de investigación para
estudiantes de licenciatura y posgrado calificados. Como utilizado en adelante, la
institución "receptora" será la que recibe a los estudiantes y la institución "de origen" se
referirá a la que envía a los estudiantes.
1. Selección y Aprobación
Cada institución revisará las solicitudes de estudiantes de una manera consistente con los
procedimientos de la Universidad y recomendará a los estudiantes más aptos a la
institución socia, por lo menos 4 meses antes de la llegada del estudiante a la institución
receptora. Las recomendaciones deben incluir el nombre del estudiante, una propuesta de
plan de estudios, y una constancia de calificaciones actualizada. La aceptación final será
realizada por la institución receptora. El plan de estudios de cada estudiante deberá ser
aprobado con anterioridad por cada institución. La institución receptora facilitará la
inscripción del estudiante de intercambio en su curso o programa preferido. No obstante,
la institución receptora podrá ser limitada con respecto a la capacidad y disponibilidad de
cursos; por eso, se da por entendido que los estudiantes de grado recibirán prioridad de
inscripción.
2. Reciprocidad
El programa de Intercambio de estudiantes es intencionado para mantener un balance y
reciprocidad durante la vida del Acuerdo. El Intercambio consistirá en cinco estudiantes
por un año entre la institución receptora y la institución socia. El número de estudiantes
intercambiados entre cada institución será revisado anualmente. Si no se logra un
balance, el acuerdo puede ser modificado para incluir un intercambio a base de cuotas
entre las instituciones.
3. Cuotas
Cuando se logre la reciprocidad entre cada institución, los estudiantes de intercambio
pagarán cualquier monto por concepto de colegiatura en su institución de origen y no
deberán de pagar la colegiatura en la institución receptora. Si no se logra un balance, se
podrá implementar un intercambio a base de cuotas. Los términos exactos de las cuotas
de matrícula para un intercambio a base de cuotas, será negociado por ambas
instituciones antes de que las solicitudes sean aprobadas.
Sin embargo, los estudiantes de intercambio podrán ser acreedores de otras cuotas (por
ejemplo, seguro médico, cuotas de laboratorio, cuotas de materiales) por parte de la
institución receptora. Una lista de estas cuotas será acordada por escrito antes de que las
solicitudes sean aprobadas y serán enviadas a los estudiantes prospectos.
5. Idioma
Se espera que los estudiantes sean fluidos en el idioma de instrucción de la institución
socia. La institución receptora tiene la autoridad y responsabilidad
de hacer la
determinación final de la habilidad del idioma del estudiante de intercambio.
6. Duración del Intercambio
El periodo de intercambio no excederá tres cuatrimestres o dos semestres durante el año
académico (excluyendo el verano), y no será con el propósito de obtener un título en la
institución receptora. Los Programas de Verano disponibles en UCLA y UdeG, y los
programas de extensión que ofrecen sus empresas universitarias Centro de Estudios Para
Extranjeros y el Coorporativo Proulex-Comlex, están separados y los estudiantes pueden
inscribirse directamente a esos programas. Una vez completado el intercambio, se espera
que los estudiantes regresen a su institución de origen.
7. Seguro Médico
Cada estudiante de Intercambio deberá mantener una póliza de seguro médico amplio
durante su intercambio. UCLA requiere que los estudiantes visitantes inscritos en un
intercambio compren la póliza de seguro que ofrece UCLA.
La UdeG no requiere que los estudiantes de UCLA compren un seguro médico a través
de ellos. Sin embargo, los estudiantes de intercambio de UCLA deberán comprobar que
están asegurados desde su llegada y a lo largo de la duración de sus estudios en UdeG.
Todos los estudiantes de intercambio de UCLA están matriculados en UCLA y protegidos
por la póliza de seguro de viajero de University of California. Información de cada
institución sobre pólizas, costos asociados, en caso de ser aplicables, serán provistos por
escrito a la institución socia antes de que las solicitudes sean aprobadas.
8. Apoyo Financiero
Los estudiantes de Intercambio bajo este Acuerdo no tienen garantizada ningún tipo de
asistencia financiera por parte de la institución receptora. En el caso de que se ofrezcan
fondos por parte de la institución receptora, queda totalmente a discreción del
departamento patrocinador y/o personal académico. Se aconseja a todos los estudiantes
a buscar apoyos económicos en su institución de origen u otras fuentes de financiamiento
en la extensión disponible.
9. Visas
La institución receptora proveerá una lista por escrito de los documentos requeridos para
obtener la visa. Es responsabilidad del estudiante de intercambio de proveer a la
institución receptora cualquier información para obtener una visa en tiempo adecuado.
10. Otros Gastos del Estudiante
Los estudiantes participantes en este Acuerdo deberán pagar los gastos generados para y
durante su intercambio, como el visado, transporte, libros, equipo, alimentos y otros
gastos incidentales en la institución receptora.
11. Hospedaje
Los arreglos de hospedaje serán responsabilidad de los estudiantes de Intercambio. Los
recursos de hospedaje serán provistos por la institución receptora una vez que el
estudiante sea aceptado en el programa de Intercambio.
12. Estatus del Estudiante
Los estudiantes de Intercambio tendrán los privilegios normales, incluyendo el acceso a
los servicios en el campus, a los cuales otros estudiantes de la institución receptora tienen
acceso y estarán sujetos a las mismas reglas y regulación que todos los estudiantes.
13. Transferencia
de Créditos
La transferencia de créditos será determinada por la oficina encargada de la revalidación
de créditos en cada institución. En UCLA, la Oficina de Admisiones de Licenciatura, para
estudiantes de licenciatura, y la Oficina para Admisiones de Posgrado, para estudiantes
de posgrado. En UdeG, la oficina de Control Escolar del Centro Universitario al que
corresponda el estudiante. Se aconseja a todos los estudiantes que se dirijan a la oficina
correspondiente de su campus de origen antes de partir a su estancia de intercambio a la
institución receptora.
14. Calificaciones
Se proveerá a los estudiantes de intercambio una constancia de calificaciones por parte
de la institución receptora dos meses después de haber completado el programa de
intercambio.
Cada parte nominará a un coordinador ("Coordinador") para trabajar con los estudiantes
de intercambio en las respectivas instituciones de origen en asuntos relacionados a sus
estudios en la institución receptora.
16. Terminación
Cualquier Intercambio de estudiantes puede darse por terminado por la institución socia,
si, en opinión del Coordinador, el estudiante no tiene un progreso aceptable, no está
cumpliendo con los requisitos del intercambio, ha contravenido el código disciplinario de la
institución, o ha violado las leyes del país receptor. Los dos coordinadores deberán
discutir las condiciones de la terminación del estatus del estudiante antes de su
destitución.
17. Seguro de Responsabilidad
UdeG y UCLA mantendrán, de manera compatible con sus políticas locales, fondos o
pólizas de seguros, responsabilidad general y cobertura para responsabilidad general de
automóviles para sus respectivas actividades con relación a la Colaboración. Además,
durante la vigencia del intercambio de estudiantes, cada Parte mantendrá la cobertura de
seguros para sus propios empleados y operaciones.
A este fin, las Partes (UCLA y UdeG) acuerdan defender, indemnizar y eximir de toda
responsabilidad la una a la otra de y contra cualquier y todos las reivindicaciones, daños,
reclamaciones, juicios, multas, indemnizaciones, costos y gastos, incluyendo pero no
limitado
a
los
honorarios
de
abogados
o costos
de juicio
razonables
(REIVINDICACIONES)
incurridos por la Parte indemnizada, sus funcionarios, agentes o
empleados en proporción a y en la medida que tales REIVINDICACIONES resulten de o
sean causados por los actos negligentes u omisiones o mala conducta intencionada de la
Parte que indemniza, sus funcionarios, agentes o empleados. Las Partes acuerdan
cooperarse en defensa de cualquier REIVINDICACiÓN en virtud de esto a expensas de la
Parte que indemniza.
En caso de cualquier litigio u otra reivindicación llevada a juicio por terceros contra UCLA,
UdeG o sus respectivos empleados, personal académico, estudiantes o aprendices
relacionados al Convenio, UdeG y UCLA harán esfuerzos razonables para ayudarle una a
la otra en la defensa de tal litigio o reivindicación, incluyendo ayudarle una a la otra sin
demora con la indagación de cualquier hecho o la identificación de cualquier testigo como
pudiera ser necesario para dicha defensa.
18. Duración y Opción de Emendar, Extender o Terminar
Este acuerdo entrará en vigor una vez firmado por ambas partes. El acuerdo tendrá una
vigencia de cinco años a partir de la fecha de firma abajo y puede ser renovado o
enmendado,
por consentimiento
mutuo de las partes. Las partes acuerdan a
periódicamente revisar las actividades realizadas y el progreso obtenido y a consultar las
enmendaciones concernientes, renovaciones o terminación de este acuerdo. Cualquiera
de las partes puede terminar este convenio en cualquier momento notificando por escrito
a la otra parte, otorgando un periodo de gracia de 30 días, y siempre y cuando ambas
partes cooperen y se aseguren de que los programas activos sean terminados de manera
que protejan debidamente los derechos de los estudiantes de la institución socia y
siempre y cuando, las partes se consulten razonablemente que al momento de la
notificación de término de convenio sea viable para la parte que no promueve la
terminación. La sección 17 sobrevivirá a la terminación de este convenio.
Este Convenio podrá ser enmendado periódicamente si las dos Partes lo acuerdan por
escrito. Tales mutuos acuerdos serán enmiendas a este Convenio, y deberán ser
celebrados por los representantes autorizados de las partes de este Convenio como
listados en la Sección 23, para que sean efectivos. Ambas Partes se comprometen a
resolver cualquier disputa con respecto a los términos de este Convenio para buscar
resoluciones mutuamente aceptables.
Ambas partes serán consideradas contratistas independientes; este Convenio no creará
una asociación, empresa conjunta o arreglo de compartir costos, excepto como
establecido expresamente en el presente.

Nada contenido en este convenio tiene la intención o hará acreedor a una tercera parte
(incluyendo, pero no limitando, a cualquier estudiante de intercambio) como beneficiario
de cualquier derecho u obligación por parte de la UdeG o UCLA.
UdeG y UCLA se reservan el derecho, al pedir por escrito, examinar y/o auditar cualquier
y todos los archivos y documentos de la otra institución que estén relacionados a este
Convenio, consistente con las leyes y políticas y/o los procedimientos aplicables.
Este Convenio expresa el entendimiento y acuerdo entero entre las partes con respecto al
contenido. Ninguna enmienda, cambio, renuncia o terminación de este convenio será
efectiva sin ser realizada por escrito, y firmada y entregada por los representantes
autorizados de las partes, como designados en el presente. Este Convenio podrá ser
traducido al español. En caso de que la versión en español difiera del original en inglés,
prevalecerá la versión en inglés.

STUDENTEXCHANGEAGREEMENT

THE REGENTS OF THE UNIVERSITI OF CALIFORNIA,
ON BEHALF OF ITS LOS ANGELES CAMPUS, USA
The Universidad de Guadalajara ("UdeG") and the Regents of the University of California, acting on behalf of its Los
Angeles campus ("UCLA"), sometimes referred to below as "Parties," wish to establish a framework as set forth
herein ("Agreement") to enable them to pursue mutually beneficial academic and research collaborations; and
implement academic exchange and research training for qualified students. As used below the "host" institution shall
be the receiving institution and the "partner" institution shall refer to the sending institution.
Each institution will screen exchange student applicants in a manner consistent with its respective procedures and
recommend the most suitable student applicants to the other institution at least four months prior to the exchange
student's arrival on campus. Recommendations must include the name of the intended exchange student, a
proposed course of study, and an up-to-date transcript. Final acceptance of student applicants will be made by the
host institution. The course of study for each applicant must be approved in advance by each institution. The host
institution will seek to facilitate the enrollment of the exchange student in his or her preferred courses or program of
study. However, the host institution may be limited by issues of course capacity and availability. It is, therefore,
understood that the degree-matriculated
students at the host institution will be given enrollment priority.
The student exchange program is intended to be balanced and reciprocal over the life ofthe agreement. The
exchange shall consist of 5 students from each institution, who may be undergraduate students or graduate students
(all of whom are referred to below as "exchange students"), annually between the host and partner institution. The
number of students exchanged between each institution shall be reviewed annually. If a balanced reciprocity is not
achieved, the agreement may be modified to include fee-based exchange between institutions (fees charged by the
host institution).

Exchange students will be expected to be proficient in the language of instruction at the host institution. The host
institution has the authority and responsibility to make the final determination oflanguage proficiency for a visi;ilt
exchange student.
The period of exchange will normally not exceed three qualters or two semesters during the academic year (summer
excluded), and shall not be for purposes of obtaining a degree at the host institution. While at the host institution,
exchange students are expected to take a full aeademie eourse load. Summer programs available at UCLA and UdeG,
plus UdeG extension programs offered by CEPE and PROULEX-COMLEX are separate and exchange students may
enroll directly to those programs. Upon completion, exchange students are expected to return to their home
institution.
Each exchange student must maintain a comprehensive health insurance policy for the duration of his or her
exehange. UCLA requires that visiting exehange students purchase a health insuranee polie)' through UCLA. UdeG
does not require that UCLA exchange students purchase a health insurance poliey through UdeG. Nonetheless, UCLA
exchange students must show proof of insurance upon arrival and for the duration of study at UdeG. AlI UCLA
exehange students are registe red at UCLA and eovered by the University of California Traveler Insurance policy. If
applicable, information about institutional health insurance policies and associated costs at the host institution will
be provided in writing to the partner institution before applications are approved.
Exchange students under this agreement are not guaranteed any financial assistance from the host institutions. In
the event that funding is provided by the host institution, it is entirely at the discretion of the sponsoring department
and/or faculty member. AlI exchange students are encouraged to seek funding from their home institution or other
funding sources to the ell.1:entavailable.
The host institution will provide a list of the doeumentation needed to obtain a student visa in writing. It is the
responsibility ofthe exchange student to provide the host institution any required information for obtaining a visa in
a timely fashion.
Exchange students under this agreement will be obligated to pay the costs of visas, travel, books, equipment,
other incidental expenses at the host institution.

At UdeG, students may register at the office of "Control Escolar" loeated at the Universit:y Center. AlI exehange
students are adviscd to meet with the appropriate home campus office for counseling regarding academic credit
matters prior to departing for their term at the host institution.

Any student's exchange can be terminated by the host institution if it has been determined that the exchange student
is not making acceptable progress, is not fulfilling the requirements of the exchange, has contravened the host
institution's disciplinary code, or has violated the laws of the host country. The two Coordinators from both
institutions must discuss conditions leading to the termination of the status of the exchange student prior to the
dismissa1.
UdeG and UCLA shall each maintain, in a manner compatible with their local practices, funds or insurance policies,
general liability and business automobile liability coverage for their respective activities in connection with the
Agreement. In addition, throughout the term of the Student Exchange, each Party will maintain its usual and
customary insurance or self insurance for its own employees and operations.
UdeG and UCLA hereto agree to defend, indemnify and hold each other harmless from and against any and all c1aims,
damages, demands, lawsuits, judgments, fines, awards, costs and expenses, inc1uding but not limited to reasonable
attorneys' fees and court costs (CLAIMS) incurred by the Indemnified Party, its officers, agents or employees in
proportion to and to the extent such CLAIMS result from or are caused by the negligent acts or omissions or wi11ful
misconduct of the Indemnifying Party, its officers, agents or employees. The Parties agree to cooperate with each
other in defense of any CLAIMS hereunder at the expense of the Indemnifying Party.

This agreement will become effective when signed by both parties. The agreement will have a term of five years from
the signature date on the last page, and may be renewed by mutual written agreement of the parties. The parties

renewal or termination of this agreement. Either party may terminate this agreement at any time by providing 30
days' written notice of such termination to the other party, provided that the Parties shall cooperate to ensure that
programs then in place are terminated in a manner that appropriately protects the rights of students from the partner
institution and provided that the Parties reasonably consult at the time that notice of termination is served on the
non-terminating
party. Section 17 shall survive termination ofthis Agreement.
This Agreement may be amended from time to time if the two Parties agree in writing. AlI such mutual agreements
shall be amendments to this Agreement, and must be executed by the appropriately delegated representatives of the
parties to this Agreement as listed in Section 23, in order to be effective. Both Parties commit to resolving any
disputes on the terms ofthis Agreement by seeking friendly, mutually acceptable resolutions.
Both parties shall be independent contractors; this Agreement shall not create a partnership,
costsharing arrangement, except as expressly set forth herein.

Although creating intellectual property ("IP") is not anticipated by exchange students, in the event that an exchange
student is assigned to work in a faculty member's research laboratory, to the extent legally able they will assign any
resulting patentable IP that is conceived and reduced to practice to the host institution.
Neither Party will use the name of the other, either expressly or by implication, in any publicity, solicitation or
advertisement without the written approval of the other party to this Agreement.

Nothing contained in this Agreement is in tended to or shall make any third party (including without limitation, any
exchange student) a beneficiary of any rights or obligations of UdeG and UCLA under this Agreement.
UdeG and VCLA each reserves the right, upon written request, to examine and/or audit any and all records and
documents ofthe other institution relating to this Agreement consistent with applicable laws and policies and/or
procedures.
This Agreement embodies the entire understanding and agreement between the parties with respect to the subject
matter contained herein. No amendment, changes to or waivers or termination of this agreement shall be effective
unless made in writing and signed and delivered by authorized representatives ofthe parties, as designated herein.
This Agreement may be translated into Spanish. In case its Spanish translation deviates from the original Agreement
in English, the English version prevails.
