Do Yard Drivers Need to be Qualified?
How is this for an answer? It depends. If yard trucks have to operate on a roadway, even if they only have
to cross the road or driving on it a short distance, the drivers would be subject to the Federal Motor Carrier
Safety Regulations.
If the property the yard trucks are operating in is accessible to the public (no signs or gates keeping the
general public out), then the drivers would be subject to the regulations. In both of these cases the driver
would be subject to the following:
 The driver qualification requirements in Part 391
 CDL Licensing
 Drug and alcohol testing, including passing a pre-employment test before operating a commercial
motor vehicle and being in a random testing pool if the driver is required to have a CDL.
 The hours-of-service regulations in Part 395
 The operational regulations in Part 392
 The vehicle would be subject to registration / plates, parts and accessories in Part 393
 And the vehicle would be subject to the inspection and maintenance in Part 396
However, if kept off the road separated from the public highway by signs or gates (the general public is not
allowed to drive in the area), and the truck never goes onto a public roadway or into an area accessible by
the public, then the driver is not subject to driver regulations and the vehicle is not subject to regulations
either.

¿Qué le parece esta respuesta? Depende. Si los camiones del depósito deben operar en una carretera,
aunque solo deban cruzar la carretera o deban conducir por ella una distancia corta, los conductores estarán
sujetos al Reglamento Federal de Seguridad del Transporte Automotor.
Si el público tiene acceso a la propiedad en la que operan los camiones del depósito (es decir, si no hay
señales ni puertas que mantengan al público en general afuera), entonces los conductores estarán sujetos al
reglamento. En ambos casos, el conductor estará sujeto a lo siguiente:
 Requisitos de calificación del conductor de la Sección 391
 Licencia de conductor comercial (Commercial Driver's License, CDL)
 Pruebas de alcohol y drogas, incluido aprobar una prueba previa al empleo antes de conducir un
vehículo motorizado comercial y participar en pruebas grupales aleatorias si se requiere que el
conductor tenga una licencia de conductor comercial.
 Reglamento de horas de servicio de la Sección 395
 Reglamento operativo de la Parte 392
 El vehículo estará sujeto a las matrículas/placas, las piezas y los accesorios de la Sección 393
 Y el vehículo estará sujeto a la inspección y al mantenimiento de la Sección 396
Sin embargo, si se mantiene en una carretera separada de la autopista pública con señales o puertas (es
decir, que el público general no tiene autorización para conducir en el área), y el camión nunca ingresa a la
carretera pública ni a un área a la que el público tiene acceso, entonces el conductor no está sujeto al
reglamentos del conductor y el vehículo tampoco está sujeto al reglamento.
