Raleigh­happened last Tuesday Santo. After a legal battle that lasted four and a half years, the Mexican
Rafael Tiscareño was arrested at the offices of the immigration and customs service (ICE), in Charlotte,
and put into a van to be taken to a prison in Atlanta where they would be deported.
But a few blocks away, the vehicle surprisingly turned on u and returned to the building. Tiscareño
thought that immigration agents had forgotten something or someone, but never imagined that upon
arrival they would leave it free.
"Told me, ' pick up your stuff and you can go, you are free'", featured Tiscareño. "I couldn't believe it, I
thought it was a joke but no, it was true! I was excited so much that I hugged the agent and tell him
thank God because for me that it was a miracle".
The end of a long battle
Tiscareño had gone that morning to the offices of ICE, according to a subpoena while he knew in
advance that he could be arrested, as his lawyer Marty Rosenbluth had warned the previous day.

Tiscareño who went sleepless
the night before thinking if he
was attending the meeting or
not.
"Many people told me that it
wasn't, that I better hide, but
something told me he had to go.
In addition, I was tired, I didn't
want more trouble, if I had to go,

God's hands", recalled the
Mexican.
Tiscareño was quoted by ICE on Tuesday March 31 then to the 3rd of that month a court in the
Fourth Circuit of the Court of appeals in Virginia ruled against a request of their lawyers, who posed as
his removal of the country not only was unjust but absurd.
Rosenbluth, and the Lawyer Derrick Hensle, which have taken the case free of charge, held that
Tiscareño ­ who has no criminal record, has lived in the country for more than 10 years and is the father
of three American children ­ were eligible for the benefit of "cancellation of deportation", while he was
181 days in prison by a criminal court in North Carolinafor illegally entering the country.
According to the law, an undocumented immigrant may not comply with the requirement of "good moral
character" if it has been in prison for more than 180 days.
"The Court basically said that the law is clear and it can not be read otherwise that as it was written, but
for us, this law was made for criminals and Rafael was arrested for an immigration violation and we think
that it should not apply in his case, but we lost", said Rosenbluth, who has defended Tiscareño since
2010.
Tiscareño was one of 20 workers arrested in a RAID of ICE made in the company of construction J &
Framers on November 15, 2010. And it was the only one who was still fighting to avoid being deported.
Following the ruling of the Court in the Fourth Circuit of the Court of appeal, Tiscareño was quoted in the
offices of ICE in Charlotte, but Rosenbluth was carrying with him a last resort: an application of "stay fo
removal", benefit that is applied at the discretion of the Government and stop the deportation of an
individual.
But when they reached the offices of ICE, the agent that charge did not consider the request and
arrested Tiscareño. "Bad news, you have to arrest", recalled the Mexican who told the agent.
"What the Officer explained to me is that under the memorandum of the Secretary Johnson, my client
was considered a priority for deportation. I said 'this is out my hands, I have no authority to cambirar this
decision' ", told the lawyer."

To Rosenbluth was left with no choice but to leave Tiscareño, who was handcuffed, stripped of their
belongings and put in a vehicle to be taken to Atlanta.
"It was one of the worst moments of my career as a lawyer,"said Rosenbluth who said that in his eight
years of practice, never had a client arrested on their date with ICE."I went out there thinking to start a
public campaign to get Rafael, said.
An unexpected miracle
But great was his sorprensa when, as he passed by Greensboro bound to his office in Burlington,
received a call from Tiscareño.
"'I'm free', I said and I couldn't believe it,"recalled the lawyer, who immediately turned and returned to
Charlotte to collect your customer.
Hours later, Rafael came to their home in Raleigh and could embrace with his wife and their three
children, who had laid off that morning.
"It was a very exciting moment", described Rosenbluth, who was the only witness of that meeting.
The family had made plans to return to Mexico once children finish school, if that Tiscareño was arrested.
Rosenbluth said that his client was released because a supervisor of ICE in Atlanta he accepted his
request for "stay of removal" and stopped moving, which means that Tiscareño may remain in the country
indefinitely while it does not commit any crime and may be renewed annually his work permit.
"At the end, after almost five years of insisting on the same grounds finally could convince someone,"
Rosenbluth said. "This is the case that most work has taken me and finally have a result is an amazing
feeling," he added.
For Tiscareño just this week understood that he is finally free, the result is a blessing from God and the
result of doing the right thing.
"My grandfather taught me there are problems that face them, if one flees them will get bigger",
said."Dios has been with me, he sent me to Marty, broke the wives and I freed".
