the procedures and formal obligations

En Gaceta Oficial N° 40.950 de fecha 22 de julio de 2016,
fue publicada la Resolución N° 019 emanada del Ministerio
del Poder Popular para el Turismo, mediante la cual se
establece el trámite y los deberes formales que deben
cumplir los prestadores de servicios turísticos de
alojamiento, agencias de viajes y turismo y transportes
turísticos en materia de turismo receptivo, de conformidad
con el convenio cambiario N°36.
Resolution No.019, published in Official Gazette No.40,950
of July 22, 2016, issued by the People’s Ministry of
Tourism, providers for the procedures and formal
obligations imposed on lodging operators, tourism service
providers, travel and tourism agencies, and tourism and
inbound tourism transportation companies, under Exchange
Agreement No.36.
La Resolución tiene por objeto regular los requisitos,
mecanismos y trámites para la emisión de la “Constancia de
Prestador de Servicios Turísticos a los fines cambiarios”.
This Resolution is aimed at regulating the requirements,
mechanism and procedures for the issue of the “Tourism
Service Provider to Exchange Effects” certificate.
Son sujetos de aplicación de dicha Resolución, los
“Prestadores de Servicios Turísticos” tales como los
dedicados al alojamiento, agencias de viajes y turismo,
transporte turístico y turismo receptivo; en los términos
definidos en el Convenio Cambiario que regula esta materia.
Entities subject to this Resolution include lodging operators,
travel and tourism agencies, tourism and inbound tourism
transportation companies, in the terms defined in the
Exchange Agreement ruling this matter.
Asimismo, se crea el “Patrón Nacional de Prestadores
Turísticos para realizar Operaciones en Divisas”, al cual
deben incorporarse los prestadores de servicios turísticos
descritos en el Artículo 4 de la referida Resolución.
Likewise, the figure of National Registry of Tourism Service
Providers to Conduct Foreign Exchange Transactions is
created, to which tourism service providers described in
Article 4 of the referred to Resolution must be
incorporated.
Los prestadores de servicios turísticos deberán solicitar la
“Constancia de Prestador de Servicios Turísticos a los fines
cambiarios”, a través del formato emitido por la página web
del Ministerio (www.mintur.gob.ve) a la Dirección General
de Registros y Licencias, adjuntando el documento que
acredite el carácter de representante legal o apoderado,
además de la Declaración Jurada debidamente firmada
mediante la cual manifieste que su representada presta
servicios a turistas internacionales o visitantes no
residentes de la República Bolivariana de Venezuela.
Tourism service providers will request the aforesaid
Certificate using the form issued on the Tourism Ministry
website (www.mintur.gob.ve) addressed to the General
Office of Registration and Licenses, enclosing the document
crediting the legal representative or proxy designation,
jointly with a duly-signed Sworn Statement declaring that
the agent provides services to international tourists or
visitors not domiciled in the Bolivarian Republic of
Venezuela.
La “Constancia de Prestador de Servicios Turísticos a los
fines cambiarios”, deberá ser exigida por la institución
bancaria ante la cual se tramitarán los acuerdos operativos
respectivos, a los fines de la aplicación y autorización de
los procesos y operaciones establecidos en el Convenio
Cambiario que regula esta materia, de acuerdo a los
términos y condiciones indicados en el mismo y demás
normativa emanada de Banco Central de Venezuela y la
SUDEBAN.
Tourism Service Provider to Exchange Effects Certificate
will be requested from the bank responsible for the
operating arrangements, in order to apply for and authorize
the processes and transactions defined the Exchange
Agreement ruling this matter, in the terms and conditions
therein indicated, and in pursuance to the orders issued by
the Central Bank of Venezuela and SUDEBAN.
Se prevé que mensualmente y dentro entro de los tres
(3) primeros días siguientes al cierre del período
mensual, los prestadores de servicios turísticos deberán
remitir al Ministerio del Poder Popular para el Turismo,
el listado
con la identificación de los turistas
extranjeros que hayan atendido y el monto en divisas de
la respectiva operación, conforme con los formatos o
mecanismos electrónicos indicados por el Ministerio.
La entrada en vigencia de la presente Resolución será a
partir de su publicación en la Gaceta Oficial de la
República Bolivariana de Venezuela.
Se deroga la Resolución N° 030 de fecha 12 de junio de
2014 emanada del Ministerio del Poder Popular para el
Turismo, publicada en Gaceta Oficial N° 40.435 de
fecha 17 de junio de 2014.
Monthly, within the first three (3) days following the
month close, tourism service providers will file with the
People’s Ministry of Tourism, a list of the foreign
tourists served and the foreign-currency amount of the
respective transactions, on the electronic forms or
mechanisms defined by the Ministry.
The Resolution came into effect as of the date of its
publication in Official Gazette of the Bolivarian Republic
of Venezuela.
Resolution No.030 of June 12, 2014, issued by
People’s Ministry of Tourism, published in Official
Gazette No.40,435 of June 17, 2014, is thereby
repealed.
