PROTOCOL FOR
THE FURTHER PROLONGATION OF THE INTERNATIONAL
SUGAR AGREEMENT OF 1958(l)
The Governments party to this Protocol,
Considering that the International Sugar Agreement of 1958 (hereinafter
referred to as " the Agreement "), which was extended by the Protocol of
1963(2) for the Prolongation of the International Sugar Agreement of 1958
(hereinafter referred to as "the 1963 Protocol") will expire on 31 December
1965;
Desiring to continue the Agreement in force for a further period pending
the entry into force of a new International Sugar Agreement under the
auspices of the United Nations;
Reaffirming their intention urgently to consider possible bases for a new
International Sugar Agreement to replace the Agreement;
Have agreed as follows :
ARTICLE1
(I) Subject to the provisions of Article 2, the Agreement shall continue
in force between the parties to this Protocol until 31 December 1966. Should
a new International Sugar Agreement enter into force before that date, this
Protocol shall cease to have effect on the date of the entry into force of the
new International Sugar Agreement.
(2) Any Government which was not party to the Agreement but which
becomes a party to this Protocol shall thereby be deemed to be a party to the
Agreement as extended in force.
ARTICLE2
Paragraphs (2) and (3) of Article 3. Articles 7 to 25 inclusive, Articles
41 and 42 and paragraphs (4) and (7) of Article 44 of the Agreement shall
be deemed to be inoperative.
ARTICLE 3
( I ) Governments may become party to this Protocol

(a) by signing it; or
(6)by ratifying. accepting or approving it after having signed it subject
to ratification, acceptance or approval; or
(c) by acceding to it.
(2) When signing this Protocol each signatory Government shall formally
state whether. in asordance with its constitutional procedures. its signature
is. or is not. subject to ratification. acceptance or approval.

(1) This

Protocol shall- be open for signature at .London .'from
1 November to 23 December 1965, inclusive, by'the Governments party to
the 1963 Protocol and by the Government of any other country referred to
in Articles 33 or 34 of the Agreement.
(2) Where ratification, approval or acceptance is required. the relevant
instrument shall be deposited with the Government of the United Kingdom
of Great Britain and Northern Ireland.
(3) After 23 December 1965 this Protocol shall be open for accession by
the Government of any country referred to in Articles 33 or 34 of the
Agreement, by deposit of an instrument of accession with the Government
of the United Kingdom of Great Britain and Northern .Ireland.

(4) This Protocol shall also be open for accession .by the Government of
any Member of the United Nations or any Government invited.to.the United
Nations Sugar Conference, 1965 but not referred to in Articles 33 to 34 of the
Agreement, provided that the number of votes to be exercised in the Council
by the Government desiring to accede shall first be agreed upon by the
Council with that Government.
ARTICLE 5

( I j This Protocol shall enter into,.xorce on 1 January 1966 among'those
Governments which have by that' date become parties to this Protocol.
provided that such Governments hold 60 per cent of the votes of the importing
countries and 70 per cent of the votes of the exporting countries under the
Agreement as extended hy the 1963 Protocol on 31 December 1965.
Instruments of ratification, acceptance. approval or accession deposited
thereafter shall take effect on the date of their deposit.
(2) In calculating whether the percentage requirements referred to in
paragraph (I) of this Article have been met, a notification containing an
undertaking to seek ratification, acceptance, approval or accession in
accordance with constitutional procedures as rapidly as possible and if
possible before 1 July 1966. received by the Government of the United
Kingdom of Great Britain and Northern Ireland before 1 January 1966. shall
be taken into account.
(3) If by 1 January 1966 this Protocol has not entered into force, the
Governments which have satisfied the requirements of Article 3 may agree
to put it into force among themselves.
ARTICLE6
Where reference is made in the Agreement or in this Protocol to
Governments or countries listed or referred to in particular articles, any
country not referred to in Articles 33 or 34 of the Agreement the Government
of which either has become a party to the Agreement before 1 January 1964,
or has become a party to the 1963 Protocol or to this Protocol, shall be
deemed to be listed or referred to accordingly.

ARTICLEI
Governments party to this Protocol undertake to pay their contributions
under Article 38 of the Agreement according to their constitutional procedures.
At its first session under this Protocol the Council shall approve its budget
for the year and assess the contributions to be paid by each Participating
Government.
ARTICLE8
(I) The Government of the United Kingdom of Great Britain and Northern
Ireland shall promptly inform all Governments represented at the United
Nations Sugar Conference, 1965, of each signature. ratiEcatiod, acceptance
and approval of this Protocol, of each accession thereto. of each notiEdion
received pursuant to paragraph (2) of Article 5 and of the date of entry into
force of this Protocol.
(2) This Protocol, of which the English, Chinese, French, Russian and
Spanish texts are equally authoritative, shall be deposited with the
Government of the United Kingdom of Great Britain and Northern Ireland.
which shall transmit certified copies thereof to each signatory and acceding
Government.
IN WITNESS WHEREOF the undersigned, having been duly authorised to
this .effect by their respective Governments, have signed this Protocol.

Les gouvernements parties au prtsent Protocole,
Considtrant que l'Accord international sur le sucre de 1958 (ci-aprks
dtnommt " l'Accord "), qui a t t t maintenu en vigueur par le Protocole de
1963 portant prorogation de I'Accord international sur le sucre de 1958
(ci-aprh dtnommt le Protocole de 1963 "), prendra fin le 31 dtcembre 1965,

D6sireux de maintenir I'Accord en vigueur pour une nouvelle ptriode en
attendant l'entrk en vigueur d'un nouvel accord international sur le sucre
sous les auspices des Nations Unies.
RCaffirmant leur intention d'examiner d'urgence les bases qui permettraient
la conclusion d'un nouvel accord international sur le sucre .destine h
remplacer I'Accord,
Sont convenus de ce qui suit:
ARTICLE1
1. Sous rtserve des dispositions de l'article 2. I'Accord est maintenu en
vigueur entre les Parties au prtsent Protocole jusqu'au 31 dtcembre 1966.
Si un nouvel accord international sur le sucre entre en vigueur avant cette
date. le prtsent Protocole cessera d'avoir effet h la date d'entrie en vigueur
d'un nouvel accord international sur le sucre.
2. Tout gouvernement qui n'ttait pas partie h l'Accord mais qui devient
Partie au prtsent Protocole est consider6 comme etant Partie B I'Accord tel
qu'il est maintenu en vigueur.
ARTICLE 2
Les paragraphes 2 et 3 de I'article 3. les articles 7 B 25 inclus, les articles 41
et 42 et les paragraphes 4 et I de l'article 44 de l'Accord sont considtrts comme
etant inoptrants.
ARTICLE3
1. Les gouvernements deviennent parties au prtsent Protocole
a) en le signant; ou
b) en le ratifiant, en l'acceptant ou en l'approuvant aprks l'avoir sign6
sous rtserve de ratification. d'acceptation ou d'approbation; ou
c) en y adhtrant.
2. En signant le prtsent Protocole, chaque gouvernement signataire
indique expresstment si, conformtment h ses proctdures constitutionnelles. sa
signature est ou non soumise h ratification, acceptation ou approbation.

ARTICLE4
1. Le prtsent Protocole sera ouvert a ia signature des gouvernements
Parties au Protocole de 1963 et du gouvernement de tout autre pays vis6
aux articles 33 ou 34 de I'Accord, h Londres, du le' novembre au 23 dtcembre
1965 inclus.
2. Lorsque la ratification, I'approbation ou I'acceptation est requise.
I'instrument pertinent sera dtpost aupris du Gouvemement du Royaume-Uni
de Grande-Bretagne et d'Irlande du Nord.
3. Aprks le 23 dtcembre 1965. le prtsent Protocole sera ouvert i
I'adhtsion du gouvernement de tout pays visi aux articles 33 ou 34 de I'Accord;
I'adhtsion se fera par le dtp6t d'un instrument auprks du Gouvernement du
Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.
4. Le prtsent Protocole sera aussi ouvert h I'adhtsion du gouvernement
de tout Membre de I'Oiganisation des Nations Unies ou de tout gouvernement
invitt B la Conftrence des Nations Unies sur le sucre de 1965, mais non visi
aux articles 33 ou 34 de I'Accord, h condition que le nombre de voix dont
ce gouvernement disposera au Conseil soit prtalablement fix6 d'un commun
accord entre le Conseil et ledit gouvernement.
ARTICLE5
1.
Le prtsent Protocole entrera en vigueur le ls' janvier 1966 entre les
gouvernements qui seront devenus parties 'au prtsent Protocole B cette date.
condition. que ces gouvernements dttiennent 60 pour cent des voix des
pays importateurs et 70 pour cent des voix des pays exportateurs aux termes
de 1'Accord tel qu'il a ttt prorogt par le Protocole de 1963 au 31 dtcembre
1965. Les instruments, de ratification, d'acceptation, d'approbation ou
d'adhtsion dtposts par la suite prendront,effet .i la date de leur dtp6t.

nfticle sont atteints; il sera tenu compte de toute notification r e y e par le

avant le le' janvier 1966 et par laquelle un gouvernement s'engage
s'efforcer d'obtenir aussi rapidement que possible et si possible avant le

ratification, I'acceptation ou I'approbation du prtsent Protocole ou I'adhtsion

3. Si. au le' janvier 1966, le prtsent Protocole n'est pas entrt en vigueur,
les gouvernements qui ont rempli les conditions fixtes par I'article 3 pourront
convenir de mettre le prtsent Protocole en vigueur entre eux.

ARTICLE6
Lorsque. dans I'Accord ou dans le prtsent Protocole, sont vis6 des
gouvernements ou des pays qui sont tnumtrts ou vises dans certains articles,
tout pays non vis6 aux articles 33 ou 34 de I'Accord et dont le gouvernement
est devenu Partie h I'Accord avant le 1" janvier 1964 ou est devenu Partie au
Protocole de 1963 ou a u prtsent Protocole sera considbrt comme faisant
partie des pays tnumtrts ou vis& dans ces articles.

Les gouvernements Parties au present Protocole s'engagent B payer les
contributions qui leur incombent aux termes de I'article 38 de I'Accord
conformtment B leurs procedures constitutionnelles. A la premibe session
qu'il tiendra sous le regime du present Protocole. le Conseil votera le budget
de l'annee et fixera les cotisations h verser par chaque gouvernement
participant.
ARTICLE8
1. Le Gouvernernent du Royaume-Uni de Grande-Bretagne et d'Irlande
du Nord informera sans tarder tous les gouvernements represent& h la
Conference des Nations h i e s sur le sucre de 1965 de toute signature.
ratification, acceptation et approbation du prtsent Protocole. de toute
adhesion B ce Protocole et de toute notification qu'il aura reGue en application
du paragraphe 2 de l'article 5 , ainsi que de la date d'entrte en vigueur dudit
Protocole.
2. Le present Protocole, dont les textes en. langues anglaise. chinoise,
espagnole. franGaise et r u s e font egalement foi, sera dtpost auprks du
Gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord.
qui en transmettra des copies certifites conformes B tous les gouvernements
signataires ou adherents.

EL QUE SE FRORROGA NUEVAMENTE LA VlGENCIA DEL
CONVENIO INTERNACIONAL DEL AZUCAR DE 1958
Los Gobiernos Parte en el presente Protocolo,
Considerando que el Convenio lnternacional del Azdcar de 1958 (en
adelante denominado I C el Convenio ”). cuya vigencia fue prorrogada por el
Protowlo de 1963 para prolongar la vigencia del Convenio Internacional del
Azdcar de 1958 (en adelante denominado “ el Protocolo de 1963 ”) expirarfi
el 31 de diciembre de 1965,
Deseando prorrogar el Convenio vigente por un nuevo period0 hasta que
entre en vigor un nuevo convenio internacional del azdcar con 10s auspicios
de las Naciones Unidas,
Reafirmando su prop6sito de examinar urgentemente las posibles bases
de un nuevo convenio internacional del anicar que venga a sustituir el
Convenio,
Han convenido en lo siguiente:
ART~CULO
1
1. A reserva de lo dispuesto en el arliculo 2. el Convenio continuari en
vigor entre las Partes en el presente Protocolo hasta el 31 de diciembre de
1966. Si con anterioridad a dicha fecha entrara en vigor un nuevo convenio
internacional del azlicar, el presente Protocolo dejar;i de tener efecto en la
fecha en que entre en vigor el nuevo convenio internacional del azdcar.
2. Todo Gobierno que no fuese parte en el Convenio, pero que
sea Parte en el presente Protocolo. se considerarfi por este hecho como Parte
en el Convenio prorrogado vigente.
ARTICULO
2
Los pirrafos 2 y 3 del articulo 3, 10s articulos 7 a 25 ambos inclusive, 10s
articulos 41 y 42 y 10s pirrafos 4 y I del articulo 44 del Convenio se
considerarb no vigentes.
ARTICULO
3
1. Los Gobiernos pueden ser parte en el presente Protocolo:
a) mediante firma; o
b) mediante ratificaci6n. aceptaci6n o aprobaci6n despuks de haberlo
firmado sujeto a ratificaci6n. aceptaci6n o aprobaci6n; o
c) mediante adhesi6n.
2. AI firmar el presente Protocolo. cada Gobierno signatario declararfi
formalmente si su firma est&o no sujeta a ratificaci6n. aceptaci6n o aprobacibn
de conformidad con su procedimiento constitucional.

ARTfCULO 4
I. El presente Protocolo estari abierto a la firma en Londres, desde el
dia 1" de noviembre hasta el dia 23 de diciembre de 1965, ambos inclusive, para
10s Gobiernos Parte en el Protocolo de 1963 y para el Gobierno de cualesquiera
de 10s paises mencionados en 10s articulos 33 y 34 del Convenio.
2. Siempre que se necesite la ratificacion, aprobaci6n o aceptaci6n. se
depositarii el instrumento pertinente ante el Gobierno del Reino Unido de
Gran Bretaiia e Irlanda del Norte.
3. Desputs del 23 de diciembre de 1965. el presente Protocolo estari
abierto a la adhesi6n del Gobierno de cualesquiera de 10s paises mencionados
en 10s articulos 33 y 34 del Convenio, mediante el dep6sito de un instrumento
de adhesi6n ante el Gobierno del Reino Unido de Gran Bretaiia e Irlanda
del Norte.

4. El presente Protocolo estarii asimismo' abierto a la adhesi6n del
Gobierno de cualquier Estado Miembro de las Naciones Unidas o de cualquier
Gobierno invitado a la Conferencia de las Naciones Unidas sobre el Azlicar,
1965, aunque no se le mencione en 10s articulos 33 y 34 del Convenio,
entenditndose que el nlimero de votos de que dispondri en el Consejo el
Gobierno que solicite la adhesi6n seri objeto de un acuerdo previo entre el
Consejo y dicho Gobierno.
ARTfCULO 5
1. El presente Protocolo entrari en vigor el 1" de enero de 1966 entre
aquellos Gobiernos que en esa fecha Sean parte en el presente Protocolo.
siempre que diclios Gobiernos relinan, el 31 de diciembre de 1965. el 60%
de 10s votos de 10s paises importadores y el 70% de 10s votos de 10s paises
exportadores, conforme a lo dispuesto en el Convenio segiln fue prorrogado
por el Protocolo de 1963. Los instrumentos de ratificacibn, aceptacidn,
aprobaci6n o adhesi6n depositados posteriormente surtirin efecto a partir de
la fecba en que se depositen.
2. Para determinar si se ha alcanzado o no el porcentaje que se estipula
en el piirrafo 1 del presente articulo. se tendri en cuenta una notificaci6n.
recibida por el Gobierno del Reino Unido de Gran Bretaiia e Irlanda del
Norte antes del 10 de enero de 1966, que contenga el compromiso de procurar,
a la mayor brevedad y de ser posible antes del lo de julio de 1966, y con
arreglo a 10s procedimientos coostitucionales. la ratificaci6n, aceptaci6n.
aprobaci6n o adhesi6n.
3. Si el presente Protocolo no bubiera entrado en vigor en I" de enero
de 1966, 10s Gobiernos que hayan cumplido 10s requisitos estipulados en el
articulo 3 podrin convenir en ponerlo en vigor entre ellos.
ARTfCULO 6
Cuando en el Convenio o en el presente Protocolo se haga referencia
a Gobiernos o a paises mumerados. o mencionados en determinados
articulos. se considerari como enumerado o mencionado en dicbos articulos
a todo pais no mencionado en 10s articulos 33 y 34. del Convenio, cuyo

ARTiCULO
7
Los Gobiernos Parte en el presente Protocolo se obligan a pagar las
contribuciones estipuladas en el articulo 38 del Convenio, de,conformidad con
sus procedimientos constitucionales. En el primer period0 de sesiones que
celebre, de conformidad con el presente Protocolo. el Consejo aprobarh su
presupuesto para el ejercicio y determinard Ins 'contribuciones que debe pagar
cada Gobierno participante.

I. El Gobierno del Reino Unido de Gran Bretaiia e Irlanda del Norte
informard sin demora a todos 10s Gobiernos participantes en la Conferencia
de las Naciones Unidas sobre el A z ~ c a r ,1965. de cada firma. ratificaci6n.
aceptaci6n y aprobaci6n del presente Protocolo, de cada adhesi6n a1 mismo.
de cada notificaci6n recibida de conformidad con el pdrrafo 2 del articulo 5 y
de la fecha en que entrari en vigor el presente Protocolo.
2. Los textos en chino. espaiiol, francis, inglb y ruso del presente
Protocolo son igualmente autinticos y quedaran depositados e n poder del
Gobierno del Reino Unido de Gran Bretafia e Irlanda del Norte. -que
transmitird copias certificadas de 10s mismos a cada Gobierno signatario o
que se adhiera a este Protocolo.
ARTiCULO

since the Government of the United Kingdom do not recognise the
Nationalist Chinese authorities as the competent Government of
China, they cannot regard signature of the Protocol by a Nationalist
Chinese representative as a valid signature on behalf of China.
The Government of the United Kingdom interpret Article 38 (6)
of the Agreement as requiring the Government of the country where
the Council is situated to exempt from taxation the assets, income
and other property of the Council and the remuneration paid by the
Council to those of its employees who are not nationals of the
country where the Council is situated.
