de Precios Justos
Publication of Official Notice providing for
amendments, due to material error, of the
Master Law of Fair Prices
En la Gaceta Oficial N° 40.787, de fecha 12 de
noviembre de 2015, fue publicado el Aviso
Oficial mediante el cual se corrige por error
material el Decreto N° 2.092, con Rango, Valor y
Fuerza de Ley Orgánica de Precios Justos, de
fecha 08 de noviembre de 2015.
Official Notice providing for amendments, due to
material error, to the Decree No.2,092 with
Rank. Value and Force of Master Law of Fair
Prices of November 8, 2015, was published in
Official Gazette No.40,787 of November 12,
2015.
Dichas correcciones se efectuaron en el artículo
46 de la Ley, el cual establece las sanciones
aplicables al incumplimiento de formalidades,
específicamente sobre los numerales 1, 3, 8, 9 y
14 de dicho artículo, los cuales quedaron
redactados de la siguiente manera:
Amendments were made to Article 46 of the
Law, which establishes the penalties applicable
to violation of legal formalities, specifically, items
1, 3, 8, 9 and 14 of said article, which shall now
read as follows:
“Artículo 46. Serán sancionados con cierre de
almacenes, depósitos o establecimientos por un
plazo de cuarenta y ocho (48) horas o multa
entre quinientas (500) y diez mil (10.000)
Unidades Tributarias, quienes incurran en alguno
de los siguientes incumplimientos:
1.Incumplir con las formalidades relativas a
marcaje de precios establecidas en el presente
Decreto con Rango, Valor y Fuerza de Ley
Orgánica,
sus
reglamentos,
o
por
la
Superintendencia Nacional para la Defensa de los
Derechos Socioeconómicos.

3.Vender u ofertar bienes o servicios a precios
superiores al precio que correspondiere marcar o
publicar; según la modalidad de precio que
correspondiere, de las establecidas en el
presente Decreto con Rango, Valor y Fuerza de
Ley Orgánica, o por la Superintendencia Nacional
para
la
Defensa
de
los
Derechos
Socioeconómicos.

8.No presentar al funcionario actuante en la
inspección o fiscalización la factura, guía de
movilización, o documento equivalente, que
ampare la legalidad de las mercancías que tiene
almacenadas, a la venta o sean movilizadas.
"Article 46. Closing of warehouses, storage
facilities, or premises for forty-eight (48) hours,
or a penalty ranging from five hundred (500) to
ten thousand (10,000) tax units, shall be
imposed of those who engage in any of the
following violations:
1. Failure to comply with the price marking
formalities set out in the Decree with Rank, Value
and Force of Master Law of Fair Prices, the
Regulations thereto, or by the Office of the
Superintendent for the Defense of SocioEconomic Rights (...)
3. Sale or offering of goods or services at greater
prices than those marked or posted, according to
the applicable price modality among those laid
down in the Decree with Rank, Value and Force
of Master Law of Fair Prices, or by the Office of
the Superintendent for the Defense of SocioEconomic Rights (...)
8. Failure to provide the acting audit or
inspection officer with the invoice, mobilization
waybill,
or
document
equivalent
that
demonstrate the validity of the goods stored,
available for sale, or mobilized.
9.No exhibir en sus anaqueles, estanterías o
demás mecanismos de acceso al público,
determinados productos disponibles en sus
depósitos o almacenes, impidiendo a los usuarios
el acceso oportuno a dichos productos.
9. Failure to display in their shelves, racks, or
other publicly-accessible means, certain products
in stock at their warehouses or storage facilities,
thus preventing user timely access to said
products.
14.La destrucción o alteración de los sellos,
precintos o cerraduras colocados por la
Superintendencia Nacional para la Defensa de los
Derechos Socioeconómicos, o la realización de
cualquier operación destinada a desvirtuar la
aplicación de una medida dictada por ésta sin
que medie suspensión, revocación u orden
administrativa o judicial-. (…)”
14. Destruction or alteration of the stamps, seals
or locks affixed by the Office of the
Superintendent for the Defense of SocioEconomic Rights, or the performance of any
action aimed at undermining the implementation
of any measure ordered thereby, without any
formal suspension, revocation or administrative
or judicial order instructing so (...)“
La Ley, entró en vigencia a partir de su
publicación en la Gaceta Oficial de la República
Bolivariana de Venezuela.
The Law entered into force as of the date of its
publication in Official Gazette of the Bolivarian
Republic of Venezuela.
