CONDICIONES GENERALES DE SUMINISTRO
ALCANCE
Las presentes “Condiciones Generales de Suministro” son de aplicación para todas
las operaciones de compra a cualquier proveedor, salvo Acuerdo Previo por escrito
entre éste y T. MECAPREC, S.L.
El mero suministro de cualquier producto o prestación de cualquier servicio,
implica el conocimiento y la aceptación por parte del proveedor de las presentes
“Condiciones Generales de Suministro”
PRECIO
Los precios indicados en nuestro Pedido son válidos para el lugar de entrega en él
referenciado. Cualquier impuesto que pudiera gravar la venta y sea por cuenta del
comprador no es considerado en el Pedido y deberá ser cargado aparte
Cualquier variación respecto a las condiciones de compra especificadas en nuestro
Pedido, deberá ser previamente confirmada con T. MECAPREC, S.L. al suministro
del/los producto/s o prestación del/los servicio/s
FACTURAS
El proveedor quedará obligado a hacer mención en su factura a la referencia
completa de nuestro pedido
Las condiciones generales de pago serán las establecidas en la ley 15/2010 de fecha
5 de julio de 2010.
GENERAL SUPPLY CONDITIONS
SCOPE
The current “General Supply Conditions” are to be applied to all the purchasing
operations of any supplier, with the exception of a Previous Agreement in writing
between the supplier and T. MECAPREC, S.L.
The mere supply of any products or the rendering of any services, implies the
knowledge and acceptance by the supplier of the current “General Supply Conditions”.
GARANTÍA
El proveedor queda obligado a garantizar los productos suministrados contra todo
vicio o defecto (de diseño, construcción, calidad, montaje, … etc) durante el
periodo que legalmente le sea de aplicación, debiendo hacerlo en caso de ausencia
de legislación aplicable por el plazo de 1 año desde la fecha de recepción por
nuestra parte, reservándose T. MECAPREC, S.L. el derecho a aplicar una retención
del 10% del total de la factura hasta el vencimiento de dicho plazo
La constatación de cualquier vicio o defecto implicará su inmediata resolución por
parte del proveedor sin coste adicional alguno para T. MECAPREC, S.L.
CONFIDENCIALIDAD
Cualquier documentación suministrada por T. MECAPREC, S.L. a sus proveedores
para la oferta de sus productos o servicios, así como para su suministro o
prestación, se considerará confidencial, no pudiendo ser reproducida por medio
alguno ni transmitida a terceros sin nuestro previo y expreso consentimiento
Sin nuestra autorización escrita, el proveedor no estará autorizado para hacer
referencia a nuestra condición de cliente
HORARIO DE RECEPCIÓN DE SUMINISTROS
De lunes a viernes de 8 a 13 horas y de 15 a 18 horas durante todo el año
GUARANTEE
The supplier is obliged to guarantee the product supplied against any fault or defect (in
design, construction, quality, assembly, … etc) for a period of legal application, and if
there is no applicable legislation this should be applied for a duration 1 year after the
reception at our installations, and T. MECAPREC, S.L. reserves the right to apply a 10%
retention fee of the total invoice until this period of time has expired.
CALIDAD Y MEDO AMBIENTE
El proveedor garantiza que el suministro de los bienes son de su plena propiedad,
adecuados al fin que se destinan y de primera calidad y primer uso, así como que
cumplen los requisitos de seguridad, calidad y medio ambiente especificados en el
Pedido y en la normativa legal y reglamentaria aplicable, de acuerdo con la
naturaleza de los bienes, obras y/o servicios suministrados.
El proveedor deberá realizar sus propias inspecciones previas a la entrega de los
bienes para asegurar que se cumplen todos los requisitos, debiendo comunicar
cualquier no conformidad a T. MECAPREC, S.L., quién deberá autorizar su
resolución. Con el objeto de agilizar las gestiones para el cumplimiento del plazo
de entrega, el proveedor deberá contar con un sistema interno de actuación para
el seguimiento efectivo de sus suministradores de materiales, componentes y
servicios que afecten al/los bienes objeto del pedido.
T. MECAPREC, S.L. se reserva el derecho de efectuar inspecciones de los bienes
objeto del Pedido y exigir cuantos ensayos sean necesarios, que serán de cuenta
del Proveedor, tanto en las instalaciones del Proveedor como en las de sus
suministradores y pudiendo acudir tanto sólo como acompañado por sus clientes.
El proveedor deberá comunicar estas circunstancias a sus suministradores.
El suministro de cualquier producto deberá acompañarse de un albarán en el que
deberá constar la referencia completa a nuestro pedido.
En el caso de suministro de aparatos o equipos, éstos deberán acompañarse del
correspondiente Manual de Uso y Mantenimiento con las instrucciones de
seguridad.
T. MECAPREC, S.L. exigirá a todo proveedor que realice sus funciones en nuestras
instalaciones el cumplimiento con todos los requisitos legales en materia de
seguridad y salud en el trabajo y de protección del medio ambiente, de
conformidad con el marco legal vigente. Asimismo, el proveedor quedará obligado
al suministro de cualquier documentación acreditativa de tal cumplimiento que le
sea requerida por nuestros mandos, quedando sometido igualmente a las
directrices y consignas que por éstos le sean dadas.
T. MECAPREC, S.L. se reserva el derecho de paralizar cualquier actividad, impedir la
entrada o desalojar de nuestras instalaciones al personal de cualquier proveedor
que infrinja las Normas a las que se refiere el párrafo anterior o las directrices o
consignas de nuestros mandos, siendo de su cargo las pérdidas económicas
generadas.
JURISDICCIÓN
Las partes renuncian expresamente sus propios fueros, sometiéndose a los
Tribunales competentes de Torrelavega.
PRICE
The prices indicated in our Order are valid for the place of delivery expressed therein.
Any tax which may be added to the sale by the buyer is not considered in the Order and
must be charged separately
Any variation with regard to the purchasing conditions specified in our Order, should be
previously confirmed with T. MECAPREC, S.L. when supplying the product or rendering
of the service.
INVOICES
The supplier is obliged to mention in their invoice the complete reference of our order
please
The general terms of payment will be the ones stablished in law 15/2010 date 05 July
2010.
The appearance of any faults or defect will imply the immediate solution by the supplier
without any additional cost to T. MECAPREC, S.L.
CONFIDENTIALITY
All documentation supplied by T. MECAPREC, S.L. to their suppliers for the offer of their
products or services, as well as for the supplying or rendering of a service, will be
considered confidential, and cannot be reproduced by any means nor transmitted to a
third party without the our expressed permission.
Without our written authorisation, the supplier will not be authorised to make any
reference to our condition as a customer.
TIMES OF RECEPTION OF SUPPLIES
From Monday to Friday from 8 am to 1 pm and from 3 pm to 6 pm throughout the
whole year.
QUALITY AND ENVIRONMENT
The supplier guarantees that the supply of the goods are of your full property, adapted
to the end that are destined and of the first quality and the first use, as well as that
fulfill the safety, health, quality and environmental requirements specified in the Order
and in the applicable legal and regulation, in agreement with the nature of the goods,
works and/or supplied services.
The supplier will have to realize his own inspections before the delivery of the goods to
assure that all the requirements are fulfilled, must communicate any non-conformity to
T. MECAPREC, S.L., which will have to authorize its resolution.
In order to improve the negotiations for the fulfillment of the delivery time, the
supplier will have to rely on an internal system of action for the effective follow-up of
its suppliers of materials, components and services that could affect to goods object of
the order.
T. MECAPREC, S.L. saves itself the right to effect inspections of the goods object of the
Order and to demand all the tests be necessary, that will be of account of the Supplier,
so in the facilities of the Supplier as in those of its suppliers and being possible to go so
only as accompanied by our customers. The supplier will have to communicate these
circumstances to its suppliers.
The supply of any product will have to accompany of a delivery note in which there will
have to consist the complete reference to our order.
In case of supply of devices or equipments, these ones will have to accompany of the
correspondent Manual of Use and Maintenance, including safety instructions.
T. MECAPREC, S.L. will demand to any supplier that realizes its functions in our facilities
the fulfillment with all the legal and statory requirements, according to the legislation
and regulation in effect. Likewise, the supplier will remain obliged to the supply of any
supporting documentation of such a fulfillment that is asked by our controls, remaining
submitted equally to the directives and slogans that for they are given.
T. MECAPREC, S.L. saves itself the right to paralyze any activity, to prevent the entry or
to remove from our facilities to the personnel of any supplier that infringes the
Procedure recounts the previous paragraph or the directives or slogans of our controls,
being supplier responsibility the economic generated losses.
JURISDICTION
Both parties do hereby submit to the jurisdiction of the Courts and Tribunals of
Torrelavega.
