Catching these potential errors before the title paperwork goes to the auction can prevent title problems that will delay a vehicle’s sale by weeks or even months. Title and Disposal Information Standard Title Processing IAA will apply for the appropriate title in the provider’s name. In order to initiate this process the vehicle provider must supply the following documentation: Coversheet – Indicating the type of title to obtain, ACV, and any selling instructions. Properly Executed Title – If the owner held the title at the time of the loss then the provider must send a title that has been properly executed by the owner. If the lienholder possessed the title at the time of the loss then the provider must send the unsigned title with lienholder signed off on title, and an original REG 262 Vehicle/Vessel Transfer and Reassignment Form. Odometer Disclosure – Odometer disclosure is required for vehicles less than 10 model years of age. This can be accomplished on the title or with REG 262 Vehicle/Vessel Transfer and Reassignment Form Lien Release (if applicable) – Lien satisfied and dated on the face of the title or separate notarized lien termination statement on lienholder letterhead, with a vehicle description and owner’s name(s). Vehicle License Fee Refund 65 – California law provides for a prorated refund of the Vehicle License Fee portion of the registration fees paid if the vehicle has become a total loss. If IAA is to apply for VLF refund, the submittal of a completed application for Vehicle License Fee Refund 65 is needed signed by all registered owners listed on the title. If the vehicle is jointly owned all owners must sign this form affirming, under penalty of perjury, they have no tickets and/or convictions of DUI at the time of loss. The DMV will accept the signature of a lessee on the Vehicle License Fee Refund 65. In the case of a deceased owner, the DMV will accept a statement of fact attached to the Vehicle License Fee Refund 65. Side A of the application is for unrecovered total loss and Side B is to be completed for constructive total loss vehicles. Duplicate Title With the insured’s cooperation, IAA can transfer into a salvage title by using the Duplicate Title 227. Lien Release if Applicable and one (1) REG262 Vehicle/Vessel Transfer and Reassignment Form If IAA is not processing the title, please attach to your coversheet along with selling instructions, the properly executed sale document and any additional required forms as outlined above. Page 4 I N S U R A N C E A U T O A U C T I O N S Last Updated 07/2013 Additional Information Deceased Owner Requirements Death of an owner with no probate proceedings – The surviving spouse or next of kin can transfer ownership with an Affidavit for Transfer w/o Probate (REG 5) and a properly signed title by the next of kin (next of kin must sign their own name along with the deceased name). o If the title is unavailable, the next of kin must sign REG 227 (Application For Duplicate – Section 4) releasing their interest in the vehicle. Next of kin would sign their name along with the name of the deceased. The Affidavit for Transfer w/o Probate (REG 5) can only be used if the deceased’s estate is valued at less than $60,000 and 40 days have elapsed since their death. Deceased owner whose estate is being probated – DMV requires certified probate papers from the court and a properly signed title by the executor of the estate (signing both their name and the name of the deceased). If the title is unavailable, the executor must sign Duplicate Title 227 (Application For Duplicate – Section 4) releasing interest in the vehicle; signing their name along with the name of the deceased. Repossessed Vehicle On a repossessed vehicle, the lienholder must release the lien and submit with attached Affidavit of Repossession 119 and REG. 262 Vehicle/Vessel Transfer and Reassignment Form from Lienholder Name Changes If the insured’s name is different than the name that appears on the title (i.e. different last name or nickname instead of first name), a name statement is required. Owner Retain If the vehicle has been declared a total loss by the provider and deemed repairable, the owner may retain the vehicle but must obtain a salvage title. The state requires notification of owner retain with Salvage Vehicle Notice of Retention By Owner 481 or Non-Repairable Vehicle Notice of Owner Retention 480 Un-Recovered Theft Provider can complete title transfer into their name for actively stolen vehicle for insurance purposes only. Salvage Vehicle Vehicles (other than non-repairable vehicle) that have been wrecked, destroyed, or damaged, to the extent that the Provider (owner, leasing co., or financial institution) considers them uneconomical to repair. These vehicles will be issued a Salvage Certificate. Non-Repairable Vehicles with NO resale value except as a source of parts or scrap metal; vehicles recovered from theft that are completely stripped, missing all of the bolts on sheet metal body panels, all of the doors and hatch, all of the interior components, and all of the grill and light assemblies; vehicles that have been completely burned to the extent that there are no more usable or repairable body or interior components, tires and wheels, or drive train components. These vehicles will be issued a NonRepairable Certificate and cannot be rebuilt or subsequently registered for road use. Application is made for this type of sale document at the request of the Provider. Un-Recovered Theft A stolen vehicle that has not been recovered within 60 days of the date the theft of the vehicle was reported to the police. A provider can obtain a Clear Title in their name until the vehicle has been recovered. When the vehicle has been recovered, it must be evaluated to determine if it can be sold with the Clear Title or if application must be made for a Salvage or Non-Repairable Certificate. Owner Retained If the vehicle has been deemed a total loss and the owner wishes to retain possession of the vehicle, the owner has 10 days from the date of the settlement to apply for a Salvage or Non-Repairable Certificate. The Provider must notify the DMV of the total loss owner retention, using Non-Repairable Vehicle Notice of Owner Retention 480 or Salvage Vehicle Notice of Retention By Owner 481, and also notify the owner of their responsibility to comply and the appropriate title. If there is an error on the title please contact the title service center to determine if an error statement is needed. Is a copy of the written estimate needed to process the title? A damage appraisal is not required to process a title. What type of PoA is required if the title is not signed? The state of California prefers the REG 262 Vehicle/Vessel Transfer and Reassignment Form to sign as Power of Attorney, but will accept out of State and generic Power of Attorney’s to accompany out of state title.
