We are in the process of obtaining relevant records relative to the present matter. Upon receipt, we will forward a copy to you for your review. We are asking for a Medical-Legal report after reviewing the records and/ or denial of causation. As you are aware, a treating physician may perform a Medical-Legal report per the Brower en banc decision. Pursuant to Labor Code Sec. 4620, a Medical-Legal Report is reasonable if a contested claim exists. A contested claim exists when the employer knows or reasonably should know that the employee is claiming entitlement to any benefits arising out of a claimed industrial injury and one of the following exists: 1. The employer rejects liability for a claimed benefit 2. The employer fails to accept liability for benefits after the expiration of a reasonable period of time within which to decide if it will contest the claim. 3. The employer fails to respond to a demand for payment of benefits after the expiration of any time period fixed by the statute for payment of indemnity. Title 8, CCR 9793(c )(2) defines a comprehensive Medical-Legal evaluation as an evaluation of an injured worker which results in the preparation of a narrative medical report by a Qualified Medical Evaluator, Agreed Medical Evaluator or the primary treating physician for the purpose of providing or disproving a contested claim. Therefore, if you have knowledge that “any benefit” has been rejected, unauthorized or ignored, you are entitled to prepare a Medical-Legal report.
