AYUNTAMIENTO DE RUTE Declarada abierta la sesión por la Presidencia, y antes de proceder al examen de los asuntos incluidos en el orden del día, el Sr. Alcalde agradece al público su asistencia a la última sesión ordinaria del pleno y excusa la no asistencia de los Sres. Concejales D. Manuel Sánchez Ronda, D. Julián Jesús Medina Yébenes y Dª Isabel Delgado Escobar. A continuación se procede al examen de los siguientes asuntos arriba relacionados e incluidos en el Orden del Día de la convocatoria: PUNTO Nº 1: APROBACIÓN, SI PROCEDE, DEL BORRADOR DEL ACTA DE LA SESIÓN ANTERIOR (23/04/2015). Dada cuenta del borrador del acta de la sesión anterior, el Sr. Alcalde-Presidente pregunta a los Sres. Concejales si tienen alguna observación que hacer. El Sr. Alcalde concede la palabra al Sr. Portavoz del Grupo Municipal de IU quien manifiesta que por su parte no hay objeciones que realizar al acta. A continuación, toma la palabra el Sr. Portavoz del Grupo Municipal del PP, quien manifiesta su conformidad al acta. A continuación, y por unanimidad de los Sres. Concejales asistentes se acuerda prestarle su aprobación y su trascripción al Libro de Actas, firmándola el Sr. Alcalde y la Secretaria de la Corporación. PUNTO Nº 2: SORTEO PÚBLICO PARA LADESIGNACIÓN DE LOS MIEMBROS DE LAS MESAS ELECTORALES PARA LAS ELECCIONES LOCALES A CELEBRAR EL DÍA 24 DE MAYO DE 2015. Por la Secretaria general se informa que se trata de la designación de los componentes de las mesas electorales para las Elecciones Locales, a celebrar el próximo día 24 de mayo de 2015, señalando que, de acuerdo con lo dispuesto en los artículos 25, 26 y 27 de la vigente Ley Orgánica 5/1985, de 19 de junio, del Régimen Electoral General, la formación de las mesas electorales compete a los Ayuntamientos, bajo la supervisión de la Junta Electoral de Zona. La Corporación se da por enterada del contenido de las indicadas normas legales y seguidamente procede a la realización del sorteo público para la designación de los Presidentes y Vocales titulares y Toledo, 2 • Teléfono 957 532 500 • Fax 957 532 714 • 14960 RUTE (Córdoba) EXCMO. AYUNTAMIENTO DE RUTE suplentes de cada una de las Mesas Electorales para las Elecciones Locales, a celebrar el día 24 de mayo de 2015. Dicho sorteo se realiza mediante el programa informático CONOCE, suministrado por la Oficina del Censo Electoral, entre la totalidad de las personas censadas en la sección correspondiente, que cumplen los requisitos exigidos, obteniéndose el resultado que a continuación se detalla. Así mismo se recoge la relación de los suplentes 3º, 4º y 5º designados para cada mesa y cargo, que quedarán en reserva por si alguna de las personas que han sido designadas como titulares y suplentes 1º y 2º presentaran excusa para desempeñar el cargo y fuera aceptada por la Junta Electoral de Zona. Secretaria quien procede a la lectura en extracto del dictamen favorable emitido acerca de este punto por la Comisión Informativa reunida en sesión ordinaria el día 23 de abril de 2015, cuyo tenor literal es el siguiente: “En relación al expediente tramitado por la Secretaria del Ayuntamiento de Rute para la elaboración de la Ordenanza de Transparencia, Acceso a la Información y Reutilización. del Ayuntamiento de Rute. Resultando que en virtud de lo dispuesto en la Disposición Final Novena de la Ley de19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno, las Entidades Locales deberán adaptarse a las obligaciones contenidas en la Ley de Transparencia en un plazo máximo de dos años. PUNTO Nº 4: APROBACIÓN, SI PROCEDE, DE LA PROPUESTA DE ALCALDÍA PARA INSTAR A LA CONSEJERÍA DE TURISMO DE LA JUNTA DE ANDALUCÍA LA DECLARACIÓN DE INTERÉS TURÍSTICO DE LAS FIESTAS DE LA VIRGEN DE LA CABEZA DE RUTE. Por la Presidencia se concede la palabra a la Sra. Secretaria quien procede a la lectura en extracto del dictamen favorable emitido acerca de este punto por la Comisión Informativa reunida en sesión ordinaria el día 23 de abril de 2015, cuyo tenor literal es el siguiente: “En relación al escrito presentado por D. Antonio Pacheco Montes, en representación de la Real Cofradía de Mª Santísima de la Cabeza Coronada, en fecha 15 de abril de 2015 (NRE 2862), por el que solicita que el Ayuntamiento de Rute inste a la Consejería de Turismo y Comercio de la Junta de Andalucía, Toledo, 2 • Teléfono 957 532 500 • Fax 957 532 714 • 14960 RUTE (Córdoba) EXCMO. AYUNTAMIENTO DE RUTE la declaración de las Fiestas de la Virgen de la Cabeza de Rute como fiestas de interés turístico de Andalucía. Resultando que de conformidad con los art. 2 y 4 del Decreto 251/2005 de 22 de noviembre, por el que se regulan las Declaraciones de Interés Turístico de Andalucía, podrán ser objeto de declaración de Interés Turístico, entre otras, las fiestas y acontecimientos, que contribuyan de forma destacada al desarrollo de los valores propios y de tradición popular de Andalucía, favoreciendo el mejor conocimiento de los recursos turísticos de Andalucía y el fomento, desarrollo y difusión del turismo, y que cumplan los requisitos establecidos en el art. 4.2 del mismo texto legal. De acuerdo con lo anterior y de conformidad con lo establecido en el art. 6.2 a) del Decreto 251/2005 de 22 de noviembre, por el que se regulan las Declaraciones de Interés Turístico de Andalucía, en virtud del cuál “podrán solicitar la declaración de Interés Turístico de Andalucía, cuando se trate de fiestas y acontecimientos, la Diputación Provincial o el Ayuntamiento del municipio en cuyo ámbito territorial tengan lugar, así como otras entidades públicas o privadas de dicho ámbito directamente relacionadas con la fiesta o acontecimiento de que se trate”, esta Alcaldía-Presidencia, en uso de sus atribuciones propone al Pleno la adopción de los siguientes acuerdos: PRIMERO. Iniciar los trámites necesarios para la declaración de las Fiestas de la Virgen de la Cabeza de Rute como fiestas de interés turístico de Andalucía por parte de la Consejería de Turismo y Comercio de la Junta de Andalucía SEGUNDO. Dar traslado del presente acuerdo al interesado y a la Consejería de Turismo y Comercio de la Junta de Andalucía, para su conocimiento y a los efectos oportunos.” Tras la lectura, toma la palabra el Sr. Alcalde y explica que no pudo incluirse en el orden del día del anterior pleno esta propuesta porque la solicitud de la Cofradía se presentó con posterioridad a la convocatoria del Pleno celebrado el día 23 de abril y al celebrarse éste con carácter extraordinario no pudo incluirse como asunto urgente. Concluye dando la enhorabuena a la Cofradía de Mª Santísima de la Cabeza Coronada y dice estar convencido que conseguirán que las Fiestas de la Virgen de la Cabeza de Rute sean declaradas como fiestas de interés turístico de Andalucía. PUNTO Nº 6: DACIÓN DE CUENTA DE LAS RESOLUCIONES DE ALCALDÍA. La Secretaria general que suscribe informa al Pleno de esta Corporación de los Decretos y Resoluciones de Alcaldía dictados desde el último Pleno celebrado el día 12 de marzo de 2015, comprendidos entre los números 318/2015 al 657/2015, los cuales se han trascrito al Libro de Resoluciones de la Alcaldía que se encuentra en la Secretaría General a disposición de los Sres. Concejales que deseen consultarlo. PUNTO Nº 7: DACIÓN DE CUENTA DEL ESTADO DE EJECUCIÓN DEL PRESUPUESTO. Por el Sr. Interventor de Fondos se da cuenta sobre el estado de ejecución del presupuesto en los siguientes términos: “De conformidad con lo dispuesto por el artículo 207 del RD legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, la Intervención de la Entidad Local remitirá información sobre la ejecución de los Presupuestos Municipales. Dando cumplimiento al referido precepto, se suministran los siguientes datos representativos del Estado de Ejecución del Pre supuesto de Gastos e Ingresos. 1. El Presupuesto del Ayuntamiento de Rute para el ejercicio 2015, aprobado en sesión plenaria de 13 de noviembre de 2014, y publicada su aprobación definitiva en el B.O.P. de Córdoba núm. 247, de 26 de diciembre de 2014. 2. El estado de ejecución del presupuesto a 23 de abril de 2015 es el siguiente: El presupuesto de gastos se aprobó con unos créditos iniciales de7.157.045,68 €. AYUNTAMIENTO DE RUTE modificaciones presupuestarias realizadas, los créditos definitivos ascienden a 9.989.010,97 €. Se ha ejecutado un 22,39 % de lo presupuestado, ya que se han reconocido obligaciones por importe de 2.236.779,88 €, de las cuales se han pagado el 83,64 % (1.870.779,60 €), resultando un pendiente de pago por obligaciones reconocidas en el ejercicio de 366.000,28 € (16,36 % de las mismas). En relación al procedimiento de ejecución presupuestaria debe apuntarse los siguientes aspectos: - Se han realizado 10 modificaciones presupuestarias, habiéndose efectuado tanto incorporación de remanentes de crédito del año anterior como transferencias de crédito y generación de créditos por ingresos afectados. Las modificaciones aprobadas en el período comprendido desde el último Pleno ordinario son: - Transferencias de crédito: Subvenciones nominativas - Generación de crédito: Convenio Programa Ayuda a domicilio 2015 Subvención Programa Envejecimiento activo 2015 Subvención Empleo Social 2015 Subvención Programa "Dile no a las drogas" En cuanto al presupuesto de ingresos, este presenta un total de previsiones iniciales de 7.943.357,31 €, habiéndose aumentado las mismas hasta llegar a unas previsiones definitivas de 10.775.322,60 €, con unos derechos reconocidos netos por importe de 3.466.445,72 €, lo que representa el 32,17 % sobre las previsiones definitivas. Los ingresos recaudados ascienden a 1.185.885,37 € (32,69 % de los derechos reconocidos netos).” PUNTO Nº 8: DACIÓN DE CUENTA DEL INFORME DE INTERVENCIÓN SOBRE EVALUACIÓN TRIMESTRAL DEL CUMPLIMIENTO DEL OBJETIVO DE LA LEY 3/2004 DE LUCHA CONTRA LA MOROSIDAD. AYUNTAMIENTO DE RUTE Por el Sr. Interventor de Fondos se da cuenta sobre el cumplimiento de la Ley 3/2004 de Lucha contra la Morosidad en los siguientes términos: “Esta Intervención a mi cargo formula el siguiente informe dirigido al Pleno de la Corporación en relación con el expediente para la evaluación del cumplimiento trimestral de la Ley 15/2010, de 5 de julio de modificación de la Ley de Lucha contra la Morosidad, que versa sobre las facturas que incumplen el plazo previsto para el pago de las obligaciones de la Entidad Local, y sobre las facturas o documentos justificativos al final del trimestre con más de tres meses de su anotación en el Registro de facturas, que se encuentren pendientes del reconocimiento de la obligación. A la vista de los datos de ejecución de los Estados de Tesorería a 31 de marzo de 2015, y de conformidad con la Ley 3/2004, de 29 de diciembre, por la que se establecen medidas de lucha contra la morosidad en las operaciones comerciales, modificada por la Ley 15/2010, de 5 de julio, emito el siguiente INFORME PRIMERO. Conforme al apartado 3 del artículo 4 de la Ley 15/2010, de 5 de julio, de modificación de la Ley 3/2004, de 29 de diciembre, por la que se establecen medidas de lucha contra la morosidad en las operaciones comerciales, los Tesoreros o, en su defecto, Interventores de las Corporaciones locales elaborarán trimestralmente un informe sobre el cumplimiento de los plazos previstos en esta Ley para el pago de las obligaciones de cada Entidad local, que incluirá necesariamente el número y cuantía global de las obligaciones pendientes en las que se esté incumpliendo el plazo. Al respecto se debe reseñar que el Real Decreto Legislativo 3/2011, de 14 de noviembre, por el que se aprueba el texto refundido de la Ley de Contratos del Sector Público en su artículo 216.4, precisa que la Administración tendrá la obligación de abonar el precio dentro de los treinta días siguientes a la fecha de aprobación de las certificaciones de obra o de los documentos que acrediten la conformidad con lo dispuesto en el contrato de los bienes entregados o servicios prestados. La Administración deberá aprobar las certificaciones de obra o los documentos que acrediten la conformidad con lo dispuesto en el contrato de los bienes entregados o servicios prestados dentro de los Toledo, 2 • Teléfono 957 532 500 • Fax 957 532 714 • 14960 RUTE (Córdoba) EXCMO. AYUNTAMIENTO DE RUTE treinta días siguientes a la entrega efectiva de los bienes o prestación del servicio, salvo acuerdo expreso en contrario establecido en el contrato y en alguno de los documentos que rijan la licitación. Pues bien, transcurrido el primer trimestre del ejercicio 2015, el número de facturas reconocidas respecto de la cuales se está incumpliendo el plazo de pago de 30 días asciende a 261 facturas, siendo su cuantía global de 388.911,60 €, con un período medio del pendiente de pago de 436,72 días. Asimismo, se debe reseñar que durante el primer trimestre del ejercicio 2015 se han realizado dentro del período legal 98 pagos por importe de 80.210,41 €, siendo el número de pagos que exceden los 30 días de 648 (por importe de 646.143,46 €). Estos datos derivan en un periodo medio de pago de 104,19 días. SEGUNDO. Por otra parte, se debe reseñar que de acuerdo con el Real Decreto 635/2014, de 25 de julio, por el que se desarrolla la metodología de cálculo del periodo medio de pago a proveedores de las Administraciones Públicas y las condiciones y el procedimiento de retención de recursos de los regímenes de financiación, previstos en la Ley Orgánica 2/2012, de 27 de abril, de Estabilidad Presupuestaria y Sostenibilidad Financiera, se incumple la normativa sobre morosidad, ya que el período Período Medio de Pago global del Excmo. Ayuntamiento de Rute a fecha de 31 de marzo de 2015 asciende a 53,16 días (superándose los 30 días como máximo legalmente establecido). TERCERO. Por todo ello se informa desfavorablemente respecto al cumplimiento de los plazos fijados en la Ley 3/2004, de 29 de diciembre, por la que se establecen medidas de lucha contra la morosidad en las operaciones comerciales, modificada por la Ley 15/2010, de 5 de julio, y respecto al PMP establecido en el Real Decreto 635/2014, de 25 de julio, por el que se desarrolla la metodología de cálculo del periodo medio de pago a proveedores de las Administraciones Públicas y las condiciones y el procedimiento de retención de recursos de los regímenes de financiación, previstos en la Ley Orgánica 2/2012, de 27 de abril, de Estabilidad Presupuestaria y Sostenibilidad Financiera. Por otra parte, se debe reseñar que la superación del periodo medio de pago a los proveedores reflejado en la normativa sobre morosidad provoca el incumplimiento del principio de sostenibilidad financiera, en los términos del artículo 4 de la Ley Orgánica 2/2012, de 27 de abril, de Estabilidad Presupuestaria y Sostenibilidad Financiera (modificada por la Ley Orgánica 9/2013, de 20 de diciembre, de control de la deuda Toledo, 2 • Teléfono 957 532 500 • Fax 957 532 714 • 14960 RUTE (Córdoba) EXCMO. Asimismo se comunica que los aspectos reflejados en este informe se han remitido al Ministerio de Hacienda y Administraciones Públicas con fecha 7 de abril de 2015 a través de la Oficina Virtual para la Coordinación Financiera con las Entidades Locales.” Toma la palabra el Sr. Alcalde para felicitar al equipo de gobierno ya que se trata del último pleno de este mandato y no existen reparos que trasladar al pleno. PUNTO Nº 9: RUEGOS Y PREGUNTAS. El Sr. Alcalde concede la palabra al Sr. Portavoz del Grupo Municipal de IU, D. José Macías, quien agradece el buen ambiente existente entre todos los concejales y desea lo mejor a los partidos de cara a la próxima campaña electoral. Finalmente, toma la palabra el Sr. Alcalde para felicitar a los 16 concejales por el trabajo realizado y por contribuir al buen desarrollo del municipio y principalmente por eliminar la crispación que ha habido durante muchos años, pues han conseguido lograr el consenso entre todos.
