Proyecto de Reforma Laboral 2012 Lic. Mariano Esparza Vazquez: Es por todos nosotros conocido que el Presidente Felipe Calderón presentó una iniciativa de reforma preferente el pasado 1 de Septiembre del 2012 ante el Congreso, simultáneamente con la presentación de su sexto y último informe de Gobierno. Nuestra Ley Federal del Trabajo vigente, data de 1970, es decir, de hace 42 años, lo cual es un indicador de que efectivamente, una refo reforma laboral es requerida por la sociedad pues los términos y las condiciones de la vida han variado, es decir, han cambiado. La Cámara de Diputados publicó el pasado 28 de Septiembre del 2012, el proyecto de reforma laboral que está aprobando al President Presidente Felipe Calderón, con modificaciones, eliminando algunos puntos de la propuesta inicial (Tal como lo relativo a normatividad Sindical) y adhiriendo algunos otros a favor de la propuesta. Dicha propuesta modificada por la cámara de Diputados, ha sido enviada ada al Senado de la República para su correspondiente revisión, para el efecto de que sea ahora el Senado el que defina lo siguiente: a) Se apruebe el proyecto tal como está, en cuyo caso podríamos estar contando ya con una Reforma Laboral, ó b) Se modifique ique y por ende regresa a la Cámara de Diputados para discusiones adicionales de acuerdo a lo que el Senado puntualice, en cuyo caso, la reforma laboral podría tardar más meses en aprobarse. Lo hecho hasta ahora mediante la presentación de esa iniciativa preferente de reforma laboral y su seguimiento preferente, es sin duda un paso histórico en pro de la sociedad Mexicana y constituye un indicativo de modernidad y eficiencia ante los ojos Extranjero. del empresario Mexicano y La reforma sin duda, podría aumentar a la inversión en nuestro País y le permitiría al trabajador mayores opciones para su desempeño en el trabajo. La industria Maquiladora es una fuente importante de generación de empleos en nuestro País y sabemos que el empleo, propicia estabilidad económica conómica para el País pero sobre todo, constituye una fuente de ingreso económico para el trabajador, para su familia y por ende, para la sociedad. El fomentar y contar con fuentes de empleo, coadyuva con la reducción de índices de inseguridad, pues al tener ner el empleo, el trabajador ó la trabajadora encuentran una forma honesta de allegarse de dinero y de constituir el sostén de su familia ó de contribuir con la misma. De acuerdo a datos proveídos por la Secretaría de Economía, actualmente (2012), contamos con: • • • • • • • • 994 “Maquiladoras” en Baja California; 661 “Maquiladoras” en Nuevo León; 474 “Maquiladoras” en Chihuahua; 394 “Maquiladoras” en Coahuila; 365 “Maquiladoras” en Tamaulipas; 302 “Maquiladoras” en el Estado de México; adoras” en Jalisco; 299 “Maquiladoras” 226 “Maquiladoras” en Guanajuato, etc. Contar con una Maquiladora implica que existe inversión, y es conocido que la inversión (en Maquiladoras) proviene del extranjero, sea de Estados Unidos, Corea, Japón, Francia, Canadá, China, Nueva ueva Zelanda, entre otros, por lo que no hay duda de que la reforma laboral y la certeza jurídica, coadyuvarían con un mensaje de confianza al inversionista y por ende, existirían mejores posibilidades de seguir invirtiendo para las empresas ya establecidas s en México, pero sobre todo, sería un mensaje positivo para la inversión extranjera que aún está dudosa de asentarse en México. Los puntos relevantes de la iniciativa de reforma laboral que coadyuvan con la estabilidad de Patrones y Trabajadores en Empresas sas Nacionales ó Maquiladoras son: a) Las empresas conocidas como “Outsourcing”, que son empresas que proveen de personal a otras empresas, tendrán oportunidad de proveer de mayor certeza jurídica al Empleado; b) En el caso de los trabajadores Mexicanos que sean enviados al extranjero a trabajar, la Ley Federal del Trabajo velaría por sus derechos y sus prestaciones; j) Ya sería obligación registrar empleados ante el FONACOT; k) Se prohibiría de manera discriminación en el empleo; d) Se definiría un periodo de prueba de capacitación inicial de 3 meses, periodo dentro del cual un candidato a trabajador recibiría salario y el patrón estaría en posibilidad de comprobar que el trabajador responderá a las necesidades de la empresa (Esto también es algo que ya existe a nivel internacional). El trabajador no deberá incurrir en faltas de e) probidad o violencia en contra de los clientes ó proveedores del Patrón, pues será causa de recisión sin responsabilidad para el Patrón; f) Asimismo, se regulará que no exista acoso ni hostigamiento sexual en la fuente de empleo, pues también sería causa de recisión; g) Los salarios caídos se limitarían a 12 meses de salarios y en caso de que el juicio laboral dure más de esos 12 meses, existe aún una formula adicional del 2% de intereses; La Ley permitiría contratar bajo el esquema h) de “Horas”; i) En determinados casos, la empresa tendría que instalar accesos para personas con capacidades distintas; la Se confirmaría la obligación obl del patrón de l) proveer capacitación y adiestramiento a los trabajadores y; m) Habría disposiciones especiales relacionadas con el transporte y con guarderías. n) c) Se definiría la existencia de un periodo de prueba de 30 días para los trabajadores, lo cual coadyuvaría con el esfuerzo del trabajador para mantener su empleo, y el plazo sería de 180 días en caso de puestos directivo ó gerenciales (Esto es algo que ya existe en otros Países); tajante, Claro, entre otras disposiciones. Lo relativo al tema sindical no está tendiendo reformas ormas al momento, pero no es un asunto que cause agravio a la confianza del inversionista ó del empresario, pues un hombre de negocios es ajeno a las relaciones de estricta observancia obreroobrero sindicales. La reforma laboral aún está en su proceso de aprobación, ción, pero lo que se observa hasta ahora es que si existe intención de reflejar modernidad y mayor certeza jurídica a la estabilidad en el empleo y a la inversión, lo cual es un indicativo de que México quiere y puede mejorar. The amendment without a doubt could increase the investment in our Country and would allow to the employee more options for his work performance. Lic. Mariano Esparza Vazquez: As publicly known, on September 1, 2012, simultaneously to his sixth and last Annual Government Report,, the President Felipe Calderon presented to the Federal Congress a an initiative of amendment to the Mexican Labor Law (the “Amendment”). Our current Federal Labor Law was initially enacted on 1970 without fundamentall changes changes, namely, since 42 years ago, which indicates that the Amendment proposed by the President is required by the society since the social terms and conditions have changed during the time. The Mexican House of Representatives published on September 28th, 2012, the Labor Law Law’s Amendment Draft, approved by the President Felipe Calderon, with some modifications, eliminating some points of the initial draft (such as those related to union regulations) and adding some others in favor to the Amendment (the “Amendment Draft”). This Amendment Draft was sent to the Federal Senate for review and approval, which shall define the following: a) Approve the Amendment Draft as proposed, in which case we could have an enacted Labor Law Amendment soon; or, b) Modify the Amendment Draft raft and hence return it to the Mexican House of Representatives in order to discuss additional changes according to the comments stated by the Federal Senate. The work done so far with the presentation of this Federal Labor Law Amendment dment preferential initiative and its preferential tracking is, without a doubt, a historical step in benefit of the Mexican Society and is an indicator of modernity and The Manufacturing Industry is a very important source of employment ment in our country, c and we know that employment ment assists in the stability stabil of any country’s economy, but most importantly, is generates workers’ source of income to his family and in consequence, for the society. In accordance to the data provided by the Ministry of Economy, as of this year 2012 we count with: • • • • • • • • 994 “Maquiladoras” at Baja California. 661 “Maquiladoras” at Nuevo Leon. 474 “Maquiladoras” at Chihuahua. 394 “Maquiladoras” at Coahuila. 365 “Maquiladoras” at Tamaulipas. 302 “Maquiladoras” at State of Mexico. 299 “Maquiladoras” at Jalisco. 226 “Maquiladoras” at Guanajuato, Guana etc. *”Maquiladora” means a Manufacturing Company with facilities manufacture and produce finished goods mainly for exportation. to To have a Maquiladora implies that investment exist, and d is known that the investment (in a Maquiladora) comes from foreign investors, such as United States, Korea, Japan, France, Canada, China, New Zeeland, among others; others therefore, there is no doubt that the Amendment would contribute with a message of trust to the investors and hence, better possibilities of continuing cont investing in established companies in Mexico, but specially, it would be a positive message for the foreign investors tors that are doubting of settling their investment in Mexico. The highlights of this Amendment that assist in the stability of the Employer loyer and the Employee in Domestic Companies or Maquiladoras are: a) The Companies known as Outsourcing, which are companies that provide personnel to other companies, would have the opportunity to provide more legal security to the Employee. b) In case that a Mexican employee is sent out of the country to work, the Federal Labor Law would ensure their rights and benefits. j) It will be employer's obligation to register employees before the FONACOT. k) The discrimination in the work source will be strictly prohibited. l) The employer's obligation to provide training ing to the employee will be confirmed. m) Special provisions related to the employee transportation and daycare matters will be included. n) The 30 day employee probation period c) would be defined, which would contribute with the employee´s effort to keep the job, and a 18 180 day period would be applied for directors and managers (this type of regulations are currently valid in other Countries). d) A 3 month training period would be defined, in which the prospective employee should receive a salary and the employer would be in possibilities of review if the employee responds to the companies needs (this is a regulation that already exist in the international field). e) The employee shall not incur in any probity fault or violence against employer´s clients or suppliers, otherwise, erwise, there could be a cause of termination without any responsibility to the employer. Also, there will be more regulations f) regarding sexual harassment in the source of employment, otherwise there could be a cause of termination as well. g) The fallen llen salaries will be limited to 12 month salary and in case that the Labor Trial takes more than 12 months, there will be an additional formula of 2% of interest. h) The law would allow hiring employees under "Hourly" basis. i) In some cases, the companyy would have to install handicap access to disable persons. Among others. There are no changes regarding Unions matters at the moment; however, this is not an issue that could cause an affectation to the trust of investors or businessman, because as a businessman is estrange to the relations between the Unions and Employees. The Amendment is still in a process of approval, but what we can see so far is the intention to reflect modernity and more legal security to the employment stability and to the investment, which indicates that Mexico wants and can improve.
