NOTICE OF SCHOOL BOND ELECTION
TO THE RESIDENT QUALIFIED ELECTORS OF
SILSBEE INDEPENDENT SCHOOL DISTRICT
TAKE NOTICE that an election will be held in the Silsbee Independent School District on November 5, 2013, in obedience to an order duly entered by the Board of
Trustees of the District on August 13, 2013, which order reads substantially as follows:

WHEREAS, this Board of Trustees of the Silsbee Independent School District (hereinafter sometimes referred to as the "District") deems it necessary and advisable to
call the election hereinafter ordered in order to provide adequate public school facilities for all the students of the Silsbee Independent School District; and
WHEREAS, the meeting of this Board of Trustees at which this Order was adopted was open to the public and public notice of the date, time, place and purpose of said
meeting was given, all as required by Chapter 551 of the Texas Government Code.
THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF SILSBEE INDEPENDENT SCHOOL DISTRICT THAT:
1.
An election shall be held, and notice is hereby given that an election will be held, between the hours of 7:00 a.m. and 7:00 p.m. on November 5, 2013, in the
Silsbee Independent School District, for the purpose stated herein, at the following designated polling place within the District:
First Assembly of God Church
950 Highway 96 South
Silsbee, Hardin County, Texas
Said District shall constitute a single election precinct for said election, which in accordance with Section 4.004(d), Texas Election Code, for purposes of this
election is a consolidation of Hardin County election precincts 2, 9, 10 and 11.
2.
The Presiding Judge and Alternate Presiding Judge for the election precinct shall hereafter be appointed by the District. The Presiding Judge shall appoint
not more than three qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as the Presiding Judge, the Alternate
Presiding Judge shall be one of such clerks. In the absence of the Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge in the election
precinct.
3.
Early voting by personal appearance shall be conducted from October 21, 2013, through November 1, 2013, inclusive. The Central Administration Office of
the Silsbee Independent School District, 415 Highway 327 West, Silsbee, Texas 77656, which is a public place within the District, is hereby designated as the main early voting
place where early voting by personal appearance shall be conducted. The early voting clerk and Presiding Judge shall be Karen Powell, whose business address is 415 Highway
327 West, Silsbee, Texas 77656. Kirsten Phillips, Sharon Dickard and Tricia Brooks are hereby appointed as deputy early voting clerks. Such office or place of early voting by
personal appearance shall be open from 8:00 a.m. until 4:30 p.m. on each day for voting which is not a Saturday, a Sunday or an official state holiday, except that such office shall
be open from 7:00 a.m. to 7:00 p.m. on each of October 21, 2013 and October 22, 2013.
In addition to the foregoing, the following places are hereby designated as temporary branch polling places for early voting at the times and on the dates specified:

The Central Administration Building of the Silsbee Independent School District, 415 Highway 327 West, Silsbee, Texas 77656, shall be the voting place for
all early voting by mail. The Presiding Judge for early voting by mail shall be Karen Powell, whose mailing address is Silsbee Independent School District, 415 Highway West,
Silsbee, Texas 77656, to which all ballot applications and early voting ballots shall be sent. Early voting by mail shall be conducted during the same period as early voting by
personal appearance, except that envelopes containing mailed ballots must arrive at the address on the carrier envelope before the polls are required to close on Election Day, unless
otherwise determined to be timely pursuant to Article 86.007, Texas Election Code.
5.
An Early Voting Ballot Board is hereby created for the purpose of processing early voting results and shall consist of Leigh Waldrep, whose address is 415
Highway 327 West, Silsbee, Texas 77656, as Presiding Judge, and four other qualified members to be appointed by Leigh Waldrep, in accordance with Article 87.001, et seq. of
the Texas Election Code.
6.
Richard Bain, a duly qualified person, is hereby appointed to serve as Presiding Judge, Central Counting Station, and he shall perform the duties and assume
the responsibilities inherent in that office. The manner in which said election shall be conducted shall be governed by the Texas Education Code and the Texas Election Code and
this Board of Trustees will furnish all necessary ballots and other election supplies requisite to said election.
7.
The conduct and manner in which said election shall be conducted shall be governed by and in accordance with the Texas Education Code, the Texas
Election Code, the Voting Rights Act Amendments of 1975, and the rules of the Department of Justice.
8.
A substantial copy of this Order shall serve as proper Notice of said election and the President of the Board of Trustees shall cause said Notice to be
published in English and Spanish one time, not earlier than the 30th day or later than the 10th day prior to the date set for the election in a newspaper published in and of general
circulation in said District, and the President of the Board of Trustees shall also cause this Order to be posted where notices are customarily posted in the Silsbee Independent
School District at least twenty-one (21) days before the date of the election.
9.
At said election, the following Proposition shall be submitted in accordance with law:
PROPOSITION
Shall the Board of Trustees of the Silsbee Independent School District be authorized to issue and sell bonds of the District, in one or more series, in the
aggregate principal amount not to exceed $29,900,000, for the purpose of constructing and equipping new school buildings on existing school campuses, to pay for
demolition of existing school buildings, and for renovating, improving, expanding, upgrading, making additions to, rehabilitating and equipping existing school
buildings in the District, to include the following projects in such order of priority as determined by the Board of Trustees, to-wit:
(1)
construction and equipping of a new elementary school;
(2)
demolition of existing school buildings, including but not limited to, John H. Kirby Elementary School and Gymnasium and Read-Turrentine
Elementary School and Gymnasium and related site clean-up;
(3)
conversion of Laura Reeves Elementary School into a Pre-Kindergarten and Kindergarten Early Childhood School, including installation of
security systems and securing front entrance; repairs, replacements and upgrades to the heating, air conditioning and ventilation system; electrical upgrades; lighting
replacements and upgrades; plumbing fixtures and piping upgrades and replacement; repairs, replacement and upgrades to the roof and insulation; and related
rehabilitation, renovations, repairs and upgrades to the existing Laura Reeves Elementary School Building and equipping thereof; and
(4)
rehabilitation, renovations, additions to, repairs and equipping of Edwards-Johnson Memorial Middle School, including installation of security
systems and securing front entrance; repairs, replacements and upgrades to the heating, air conditioning and ventilation system; electrical upgrades; lighting
replacements and upgrades; plumbing fixtures and piping upgrades and replacement; and related rehabilitation, renovations, repairs and upgrades to the EdwardsJohnson Memorial Middle School and equipping thereof;
and with any remaining surplus funds, if any, to be used for contingency and for the construction, renovation, additions to, improving and equipping of any other
existing school buildings and any school campus grounds in the District and for land acquisition; which bonds may be issued in various series or issues, may be sold at
any price or prices, shall mature serially or otherwise and bear interest at such rate or rates (fixed, variable, floating, adjustable or otherwise) as shall be determined by
the Board of Trustees of the District within its discretion at the time of issuance, but not to exceed the maximum maturity dates and interest rates now or hereafter
authorized by law at the time of issuance; and shall the Board of Trustees be authorized to levy and pledge and cause to be assessed and collected annual ad valorem
taxes on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on said bonds as they become due and the
cost of credit agreements, if any, executed in connection with the bonds, all as authorized by the Constitution and the laws of the State of Texas?
10.
The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST"
the aforesaid Proposition with the ballots to contain such provisions, markings and language as required by law and with such Proposition to be expressed substantially as follows:

BUILDINGS IN THE DISTRICT (INCLUDING THE REHABILITATION, RENOVATING, EXPANSION AND
IMPROVEMENT THEREOF), TO INCLUDE THE FOLLOWING PROJECTS IN SUCH ORDER OF PRIORITY AS
DETERMINED BY THE BOARD OF TRUSTEES:
(1)
CONSTRUCTION AND EQUIPPING OF A NEW
ELEMENTARY SCHOOL, (2) DEMOLITION OF JOHN H. KIRBY ELEMENTARY SCHOOL AND GYMNASIUM AND
READ-TURRENTINE ELEMENTARY SCHOOL AND GYMNASIUM, (3) CONVERSION OF LAURA REEVES
ELEMENTARY SCHOOL INTO A PRE-KINDERGARTEN AND KINDERGARTEN EARLY CHILDHOOD SCHOOL
AND (4) REHABILITATION, RENOVATIONS, ADDITIONS TO, REPAIRS AND EQUIPPING OF EDWARDSJOHNSON MEMORIAL MIDDLE SCHOOL, AND WITH ANY SURPLUS FUNDS TO BE USED FOR CONTINGENCY
AND FOR REMOVAL OF AND CONSTRUCTION RENOVATION, ADDITIONS TO AND EQUIPPING OF ANY
OTHER SCHOOL BUILDINGS AND SCHOOL GROUNDS IN THE DISTRICT

11.
In all respects, said election shall be conducted in accordance with the Texas Election Code.
12.
The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Order for all purposes and are
adopted as a part of the judgment and findings of the Board of Trustees of the District.
13.
All orders and resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Order are hereby repealed to the extent of such
conflict, and the provisions of this Order are and remain controlling as to the matters ordered herein.
14.
This Order shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America.
15.
If any provision of this Order or the application thereof to any person or circumstance is held to be invalid, the remainder of this Order and the application of
such provision to other persons and circumstances is nevertheless be valid, and this Board of Trustees hereby declares that this Order would have been enacted without such invalid
provision.
16.
It is officially found, determined, and declared that the meeting at which the Order is adopted was open to the public and public notice of the time, place and
subject matter of the public business to be considered at such meeting, including this Order, was given, all as required by Texas Government Code chapter 551, as amended.
17.
This Order is in force and effect from and after its final passage, and it is so ordered.

CONSIDERANDO, este Consejo de Administración del Distrito Escolar Independiente de Silsbee (más adelante designado a veces como el "Distrito") juzga necesario
y recomendable proclamar la elección pedida de aquí en adelante para proporcionar instalaciones adecuadas de escuelas públicas para todos los estudiantes del Distrito Escolar
Independiente de Silsbee; y
CONSIDERANDO, la reunión de este Consejo de Administración en la cual esta Orden fue adoptada estuvo abierta al público y se dio un aviso público de la fecha,
hora, lugar y propósito de dicha reunión, todo según lo requerido por el Capítulo 551 del Código de Gobierno de Texas.

Se lleve a cabo una elección, y se da un aviso por este medio que se llevará a cabo una elección, entre las horas de las 7:00 a.m. y las 7:00 p.m. el 5 de
noviembre del, 2013, en el Distrito Escolar Independiente de Silsbee, para el propósito indicado aquí, en el siguiente lugar de votación señalado dentro del Distrito.

El dicho Distrito constituirá un solo distrito electoral para dicha elección, de acuerdo con la Sección 4.004(d), Código de Elección de Texas, para los

2.
El juez de presidencia y el juez de presidencia alterno para el recinto de votación serán de aquí en adelante designados por el distrito. El juez de presidencia

La Votación anticipada presentándose en persona se llevará a cabo desde el 21 de octubre del, 2013, hasta el 1 de noviembre del, 2013, inclusivo. La Oficina
Central de Administración del Distrito Escolar Independiente de Silsbee, 415 Highway 327 West, Silsbee, Texas 77656, el cuál es un lugar público dentro del Distrito, se señala por
este medio como el lugar principal de la votación anticipada donde se llevará acabo la votación anticipada presentándose en persona. La oficinista de votación anticipada y el juez
de presidencia será Karen Powell, quien tiene la dirección de negocio 415 Highway 327 West, Silsbee, Texas 77656. Kirsten Phillips, Sharon Dickard y Tricia Brooksse designan
por este medio como diputadas oficinistas de la votación anticipada. Tal oficina o lugar de votación anticipada presentándose en persona deberá está abierta desde las 8:00 a.m.
hasta las 4:30 p.m. cada día para votar que no sea un sábado, un domingo o un día Feriado oficial del estado, con excepción de que esa dicha oficina deberá estar abierta desde las

La Oficina Central de Administración del Distrito Escolar Independiente de Silsbee, 415 Highway 327 West, Silsbee, Texas 77656, será el lugar de votación
para toda la votación anticipada por correo. El juez de presidencia para la votación anticipada por correo será Karen Powell, cuya dirección de correo es Silsbee Independent
School District, 415 Highway 327 West, Silsbee, Texas 77656, a donde todas las solicitudes de papeletas de votación y las papeletas de votación anticipada serán enviadas. La

6.
Richard Bain, una persona debidamente calificada, se designa por este medio al servicio como juez de presidencia, Estación de Conteo Central, y él realizará
los deberes y asumirá las responsabilidades inherentes en esa oficina. La manera en la cual dicha elección se llevará a cabo será gobernada por el código de Educación de Texas y
el Código de Elección de Texas y este Consejo de Administración proporcionará todas las papeletas de votación necesarias y otros materiales de elección requeridos para dicha
elección.
7.
La conducta y manera en las cuales dicha elección se llevará a cabo será gobernada por y de acuerdo con el Código de Educación de Texas, Código de
Elección de Texas, Enmiendas del Acta de Derechos al Voto de 1975, y los reglamentos del Ministerio de Justicia.
8.
Una copia substancial de esta orden servirá como Aviso apropiado de dicha elección y el Presidente del Consejo de Administración hará que dicho aviso sea
publicado en inglés y en español por una vez, no más antes que el trigésimo día o más que el décimo día antes de la fecha dispuesta para la elección en un periódico publicado en y
de circulación general en dicho Distrito, y el Presidente del Consejo de Administración también hará que esta orden sea fijada donde se fijan los avisos por costumbre en el Distrito
Escolar Independiente de Silsbee por lo menos veintiún (21) días antes de la fecha de la elección.
9.
En dicha elección, la siguiente proposición será presentada de acuerdo con la ley:
PROPOSICIÓN
Se le pudiese autorizar al Consejo de Administración del Distrito Escolar Independiente de Silsbee a publicar y vender bonos del Distrito, en uno o más
series, en la cantidad principal agregada que no exceda $29,900,000, con el propósito de construir y equipar nuevos edificios escolares en existentes campos escolares,
pagar para la demolición de edificios escolares existentes, y para renovar, mejorar, ampliar, actualizar, hacer anexos, restaurar y equipar edificios escolares existentes
en el Distrito, a incluir los proyectos siguientes en tal orden de prioridad así determinado por el Consejo de Administración, juicio:
(1)
construcción y equipar una nueva escuela primaria
(2)
demolición de edificios escolares existentes, incluyendo pero no limitado a, la Escuela Primaria John H. Kirby y Gimnasio y la Escuela Primaria
Read-Turrentine y Gimnasio y limpieza a fondo del sitio relacionado;
(3)
convertir la Escuela Primaria Laura Reeves a un Jardín de infancia y escuela de temprana edad Jardín de infancia, incluyendo instalación de
sistemas de seguridad y asegurar la puerta principal de enfrente, reparaciones, reemplazos y actualizaciones a los sistemas de calefacción, aire acondicionado y
ventilación; actualizaciones al sistema eléctrico; reemplazos y actualizaciones del alumbrado; actualizaciones de artefactos de plomería y tubería y reemplazos;
reparaciones, reemplazos y actualizaciones del techo y aislamiento; y restauración, renovaciones, reparaciones y actualizaciones relacionadas al edificio existente de la
Escuela Primaria Laura Reeves y el equipar de ello; y
(4)
restauración, renovaciones, anexos, reparaciones y el equipar la Escuela Intermediaria Edwards-Johnson Memorial, incluyendo instalación de
sistemas de seguridad y asegurar la puerta principal de enfrente, reparaciones, reemplazos y actualizaciones a los sistema de calefacción, aire acondicionado y
ventilación; actualizaciones al sistema eléctrico; reemplazos y actualizaciones del alumbrado; actualizaciones de artefactos de plomería y tubería y reemplazos;
reparaciones, reemplazos y actualizaciones al techo y aislamiento; y restauración, renovaciones, reparaciones y actualizaciones relacionadas a la Escuela Intermediaria
Edwards-Johnson Memorial y el equipar de ello;
y con cualquier fondos sobrantes, si los hay, utilizados para los propósitos de contingencia y para la construcción, renovación, anexos, mejorías y equipar
cualquier otro edificio escolar existente y cualquier terreno escolar en el Distrito y para la adquisición de terreno; cuales bonos pueden ser emitidos en varias series o
emisiones, pueden ser vendidos a cualquier precio o precios, serán pagaderos en serie o de otra manera y producirán interés en tal tarifa o tarifas (fijadas, variantes,
flotante, ajustables o de otra manera) como será determinado por el Consejo de Administración del Distrito dentro de su discreción a la hora de la emisión, pero no
exceder las fechas pagaderas máximas y tipos de interés de ahora o de aquí en adelante autorizado por la ley; y autorizarán al Consejo de Administración a imponer y
prometer y causar a ser evaluado y recaudado anualmente impuestos con arreglo al valor sobre toda la propiedad imponible en el Distrito, suficiente, sin límite en
cuanto a tarifa o cantidad, para pagar el principal de y el interés en los dichos bonos y el costo de acuerdos de crédito, si lo hay, hechos en conexión con los bonos, todo
como lo autorizado por la Constitución y las leyes del Estado de Texas?
10.
Las papeletas en blanco oficiales para la dicha elección serán preparadas de acuerdo con el Código de Elección de Texas para permitir que los votantes voten
"A FAVOR" o "EN CONTRA" de la proposición antedicho con las papeletas en blanco abarcando tales cláusulas, marcas y lenguaje según lo requerido por la ley y con tales

11.
En todos los respectos, la dicha elección se llevará a cabo de acuerdo con el Código de Elección de Texas.
12.
Los relatos contenidos en el preámbulo de esto se encuentran por este medio ser verdaderos, y tales relatos se hacen por este medio parte de esta Orden para
todos los propósitos y se adoptan como parte del juicio y conclusiones del Consejo de Administración del Distrito.
13.
Todas las órdenes y resoluciones, o partes de eso, las cuales están en conflicto o en contradicción con cualquier cláusula de esta Orden se revocan por este
medio al grado de dicho conflicto, y las cláusulas de esta Orden están y siguen controlando en cuanto a los asuntos mandados aquí.

Esta Orden será interpretada y se cumplirá de acuerdo con las leyes del Estado de Texas y de los Estados Unidos de América.

Si alguna cláusula de esta Orden o la aplicación de ello a cualquier persona o circunstancia llega a ser inválida, el resto de esta Orden y la aplicación de tal
cláusula a otras personas y circunstancias es sin embargo válido, y este Consejo de Administración declara por este medio que esta Orden habría sido decretada sin tal cláusula
inválida.
16.
Se encuentra oficialmente, determinado, y declarado que la reunión en la cual se adoptó la Orden estuvo abierta al público y se dio aviso público de la hora,
lugar y tema del negocio público a ser considerado en tal reunión, incluyendo esta Orden, se dio, todo según lo requerido por el Código de Gobierno de Texas Capítulo 551, según
lo enmendado.
17.
Esta Orden entra en vigor y efecto desde y después de su aprobación final, y es así que es mandada.
