If the User is under the age of 18, the User’s parent or guardian must also sign this Waiver and Release at the bottom of this page,
AFTER AGREEING TO THE BELOW:
The User agrees to comply with all posted rules and regulations relating to the use of Downtown Ice ice skating facility (“Rink”) and
to obey all instructions of Rink personnel. If the User is under the age of 18, the parent or guardian of User agrees to assume all
responsibility for causing the User to comply with such rules, regulations and instructions.
The User (or, if the user is under the age of 18, the parent or guardian of the User) agrees that the User’s use of the Rink involves risk
of injury. The User (or, if the User is under the age of 18, the parent or guardian of the User) agrees to ASSUME ALL RISK OF INJURY
that may be sustained by the User or by others that may result from the User’s use of the Rink, and further agrees to ASSUME ALL
RISK OF DAMAGE TO PERSONAL PROPERTY owned by the User or by others, that may result from the User’s use of the Rink.
The User (or, if the user is under the age of 18, the parent or guardian of the User) also agrees to WAIVE any and all claims, causes
of action, damages, proceedings and lawsuits against the San Jose Downtown Association, “ Downtown Ice”, City of San Jose, Redevelopment Agency of the City of San Jose, F.C. Fairmont, SPE, L.L.C, Forest City Commercial Management, Inc., and Forest City
Enterprises, its subsidiaries and affiliates (all of whom are collectively referred to herein as “Indemnitees”), and to fully RELEASE
and INDEMNIFY and HOLD HARMLESS the Indemnitees from any and all damages, losses, claims, causes of action, suits, judgments
and any other liabilities whatsoever resulting from or relating to the User’s use of the Rink or resulting from or relating to any injury
sustained by the User or by others or any damage to personal property owned by the User or by others.
The User hereby authorizes and permits the San Jose Downtown Association to utilize, at their discretion, any telecasts, radio broadcasts, motion pictures, video, photographs of the User participating at Downtown Ice for advertising, publicity, and promotional
purposes without compensation of any kind to User.
Any controversy or claim arising out of or relating to User’s use of the Rink, or arising out of this Waiver and Release, shall be settled by
arbitration in Santa Clara County, California, administered by the American Arbitration Association in accordance with its Commercial
Arbitration Rules, and judgement on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

al final de esta pagina – DESPUES DE ESTAR DE ACUERDO CON LAS SIGUIENTES REGLAS:
El usuario esta de acuerdo en obedecer todas las reglas y reglamentos puestas en el cartel, en relación del uso de la pista de patinar de “Downtown Ice,” y también obedecer todas las instrucciónes del personal de la pista. Si el usuario es menor de 18 años, el
guardián del usuario esta de acuerdo en asumir toda responsabilidad en obedecer dichas reglas, reglamentos e instrucciónes.
El usuario (ó, si el usuario es menor de edad, el guardián del usuario) debe estar de acuerdo que el uso de la pista de patinar puede
implicar serias lesiones al usuario. El usuario (ó, si usuario es menor de edad, el guardián del usuario) esta de acuerdo en ASUMIR
TODOS LOS RIESGOS DE Lesiones que pueden ser sostenidos por el usuario ó otros patinadores, y además esta de acuerdo en ASUMIR
TODO RIESGO DE DAÑO A PROPIEDAD PERSONAL del usuario ó de otros patinadores, que pueda resultar del uso de la pista.
El usuario (ó, si el usuario es menor de edad, el guardián) también esta de acuerdo en renunciar a cualquier tipo de reclamación,
demanda, causa de acción, daño, procedimientos y litígio contra the San Jose Downtown Association, “ Downtown Ice”, City of San
Jose, Redevelopment Agency of the City of San Jose, F.C. Fairmont, SPE, L.L.C, Forest City Commercial Management, Inc., y Forest City
Enterprises, (incluso, todos que son referidos colectivamente como “Indemnidades”), y también de completamente liberar e indemnizar de cualquier daño, pérdida, reclamo, causa de acción, multa, juicio y cualquier otra deuda resultando por el usuario(s) uso de la
pista de patinaje en hielo, ó por el resultado en relación de cualquier lesión sostenido por el usuario ó otra persona, ó cualquier daño
a la propiedad personal.
De este momento en adelante el usuario autoriza y le da permiso a la Asociación del Centro de San José para utilizar a su discreción
cualquier emisión por radio, película, video o foto del usuario participando en “Downtown Ice” para propaganda, publicidad y propósitos promociónales sin compensación de ninguna clase para el usuario.
Cualquier controversia o reclamo que resulte relacionado al uso de la pista o de esta forma de renuncia del patinador, será arbitrado
en el Condado de Santa Clara, California y administrado por la Asociación de Árbitraciones Americano en acuerdo con las Reglas de
Arbitración Comercial, y en el juicio extendido por los arbitros y puede ser admitido en qualquier corte judicial con jurisdicción.
