The SO ad hoc group was formed on Monday, and has its first meeting that evening (aprox 60 people, from 7:00 to 9:00 PM) 2. Extensive exchange of ideas, and three tracks for possible compromise were identified. 3. The group reported back to the WG plenary on Tuesday morning, and agreed to keep on working during the afternoon, with a small group of drafters. 4. Their task was to present possible compromise proposals to a larger group, just after the CSMs ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 12 CKT 9 – Sexual Orientation 4. A group of aprox. 40 people, from the different perspectives on SO, came to the drafting meeting, and worked from 1:00 to 5:30 PM. 5. Another extensive exchange of ideas and discussion of possibilities was held. 6. After long conversations and very important compromises from the various sides of the discussion, finally an alternative wording to make reference to SO - acceptable for all those working at the meeting - was agreed. ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 13 ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 14 CKT 9 – Sexual Orientation 4. Having agreed with the term, the group reviewed all the bracketed DIS, assessing were and how to apply it. 5. All instances where SO appear were indentified and discussed. 6. The general rule was to apply the new term to the CKT9 PWF, replacing “sexual orientation” with “personal relationships”. NEXT TO marital or family status, HIVAID 7. Its noted that, for some, this was seen as having a too similar meaning, while, for others, as not being a perfect equivalence. 8. Nevertheless, for those at the meeting, it was agreed as being an acceptable compromise, that should be proposed to the WG experts. ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 15 CKT 9 – Sexual Orientation These are the instances were changes to the bracketed DIS should be made: 6.3.7.1: CKT-9: [Discrimination involves any distinction, exclusion or preference that has the effect of nullifying equality of treatment or opportunity, where that consideration is based on prejudice rather than a legitimate ground. Illegitimate grounds for discrimination include but are not limited to: race, colour, gender, age, language, property, nationality or national origin, religion, ethnic or social origin, caste, economic grounds, disability, pregnancy, political affiliation or political or other opinion. [36][43][100][101][102][103][117] Emerging prohibited grounds also include PERSONAL RELATIONSHIPS, marital or family status and health status such as HIV/AIDS status. The prohibition of discrimination is one of the most fundamental principles of international human rights law.] ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 16 CKT 9 – Sexual Orientation These are the instances were changes to the brackted DIS should be made: - 6.3.10.2: CKT-9: [An organization should confirm that its employment policies are free from discrimination based on race, colour, gender, religion, national extraction, social origin, political opinion, age, or disability. Emerging prohibited grounds also include PERSONAL RELATIONSHIPS, marital or family status and health status such as HIV/AIDS status, which are in line with the general principle that hiring policies and practices, earnings, employment conditions, access to training and promotion, and termination of employment should be based only on the requirements of the job.] ISO/TMB/WG SR, 8th meeting Copenhagen, Denmark 17 – 21 May 2010 17 CKT 9 – Sexual Orientation Its noted that the term sexual orientation also appears in some comments. In such cases, the term SO shall be replaced with personal relationships.
