Nuevas obligaciones formales para empresas alemanas en operaciones intracomunitarias
Desde el uno de septiembre 2013, las empresas alemanas, que efectúen entregas
intracomunitarias, han de aportar - dependiendo de las modalidades de la entrega - un
documento adicional que demuestre que la mercancía efectivamente llegó a un país
miembro de la UE. Esta prueba adicional se llama “Gelangensbestätigung” (comprobante de
entrada).
Este documento adicional es optativo en los casos que un tercero (un transportista
independiente, contratado por el proveedor) se hace cargo del transporte, siempre que el
proveedor dispone de otros documentos habituales de transporte que reflejan en
movimiento, por ejemplo el documento CMR.
Obligatoriamente el proveedor debe documentar la entrega a otro país miembro de la UE,
cuando el mismo o el comprador personalmente se ocupan del transporte de los bienes. Lo
último suele ocurrir muchas veces en la compra individual de vehículos en Alemania para un
empresario.
Aunque los empresarios alemanes tienen un plazo hasta el 31 de diciembre de este año
para introducir las nuevas obligaciones formales, es de esperar, que a partir de ahora los
proveedores alemanes de mercancía requieren a sus compradores que firmen un
documento que se parecerá al siguiente formulario:
“Certification of the entry of the object (goods) of an intra-Community supply into another EU
Member Stat (Entry Certificate)
(Name and address of the customer of the intra-Community supply, if applicable, email
address)
I as a customer hereby certify my receipt/the entry of the following object of an intraCommunity supply
(Quantity of the object (goods) of the supply)
(Standard commercial description – in the case off vehicle, identification number)
(Date, the object (goods) of the supply was received in the Member State of entry if the
supplying trader transported or dispatched the object (goods) of the supply or if the customer
dispatched the object (goods) of the supply.)
