STATEMENT OF CONDITIONS AND PENALTIES FOR EARLY WITHDRAWAL OF A TIME DEPOSIT
(“STATEMENT OF CONDITIONS AND PENALTIES”)
DECLARACION DE CONDICIONES Y PENALIDADES POR EL RETIRO ANTICIPADO DE UN DEPOSITO A PLAZO FIJO
(“DECLARACION DE CONDICIONES Y PENALIDADES”)
You do not have a right to withdraw principal or interest
from your Time Deposit prior to its maturity date. If we
allow you, at our sole discretion, to make an early withdrawal,
prior to the maturity of the Time Deposit, we will assess the
penalties described below:
Usted no tiene derecho a retirar el principal o interés de su
Depósito a Plazo Fijo antes de su vencimiento. Si nosotros, a
nuestro criterio, le dejamos efectuar un retiro antes del
vencimiento del Depósito a Plazo Fijo, le cobraremos las
siguientes penalidades:

If you make an early withdrawal from a Time Deposit that
has a maturity of 30 days or less, you will be charged the
equivalent of the interest earned on the amounts withdrawn
up to the date of the withdrawal.
1. Si usted efectúa un retiro anticipado de un Depósito a Plazo
Fijo que tiene un plazo de 30 días o menos, le cobraremos el
equivalente del interés acumulado en el monto del retiro hasta
la fecha de dicho retiro.

If you make an early withdrawal from a Time Deposit that
has a maturity of more than 30 days, you will be charged the
equivalent of 30 days of interest earned on the amount
withdrawn. If your Time Deposit has not been in existence
long enough to have earned the amount of the penalty, you
will be charged the amount of interest earned up to the date
of the withdrawal.
2. Si usted efectúa un retiro anticipado de un Depósito a Plazo
Fijo que tiene un plazo de más de 30 días, le cobraremos el
equivalente de 30 días de interés acumulado sobre el monto
del retiro. Si su Depósito a Plazo Fijo no ha acumulado
suficiente interés como para cubrir ésta penalidad, le
cobraremos el interés acumulado hasta la fecha del retiro.

As required by federal law, in no event will the penalty be
less than 7 days of simple interest. In all cases, the minimum
early withdrawal penalty will be US$50.00.
3. La ley federal requiere que ésta penalidad no sea menor de 7
días de interés simple. En todos los casos, el monto mínimo
de penalidad por retiro anticipado será US$50.00.

Notwithstanding the foregoing, we will not impose an early
withdrawal penalty: (a) upon the death of the owner of the
Time Deposit; (b) when any owner of the Time Deposit is
determined to be legally incompetent; or (c) where the Time
Deposit contract provides for an automatic renewal at
maturity and you withdraw the fund within ten (10) calendar
days after the maturity date.
4. No obstante lo anterior, no le cobraremos ninguna penalidad
por cancelar su Depósito a Plazo Fijo antes de su vencimiento
en caso de: (a) defunción del propietario del Depósito a Plazo
Fijo; (b) cuando se declare legalmente incompetente a
cualquiera de los propietarios del Depósito a Plazo Fijo; o (c)
cuando el contrato del Depósito a Plazo Fijo estipule su
renovación automática y usted retire los fondos dentro de un
plazo de diez (10) días a partir de la fecha de su vencimiento.
The terms of the Account Agreement are hereby incorporated by
reference, and except as expressly modified by this Statement of
Conditions and Penalties, all terms and provisions of the Account
Agreement will remain in full force and effect.
Las estipulaciones del Convenio de Cuenta están incorporadas
por referencia a este documento y, excepto por los cambios
hechos en esta Declaración de Condiciones y Penalidades, todas

The English language version of this Statement of Conditions and
Penalties shall control over any translated alternate language
version.
La versión en inglés de ésta Declaración de Condiciones y
Penalidades prevalecerá sobre cualquier otra versión traducida.
I have received a copy of this Statement of Conditions and
Penalties. I have read the above and recognize that I do not
have a right to withdraw from my Time Deposit prior to its
maturity date. I understand that I will be charged penalties if
I make a partial or total withdrawal from my Time Deposit
prior to its maturity date.
He recibido una copia de esta Declaración de Condiciones y
Penalidades. He leído lo anterior y reconozco que no tengo
derecho a efectuar retiros de mi Depósito a Plazo Fijo antes
de su fecha de vencimiento. Entiendo que tendré que pagar
penalidades si hago un retiro total o parcial de mi Depósito a
Plazo Fijo antes de su fecha de vencimiento.
