ADOPTION OF AN AMENDMENT TO ANNEX A
The Secretary-General ofthe United Nations, acting in his eapacity as depositary,
communicates the following:
At its fiflh meeting held in Geneva from 25 to 29 April2011, the Conference ofthe Parties to
the above Convention adopted an amendrnent to Annex A by deeision SC-5/3 to list the ehemiea1
"technical endosulfan and its related isorners" in the annex.
In aeeordanee with paragraphs 3 (b) and 3 (e) and paragraph 4 ofarticle 22 ofthe Convention,
any Party that is unab1e to aeeept an amendment to Annex A, B or C shall so notify the depositary, in
writing, within one year from the date ofeommunieation by the depositary ofthe adoption ofthe
amendment. The depositary shall without delay notify all Parties of any sueh notifieation received. A
Party may at any time withdraw a previous notification of non-acceptance in respectof any amendment
to Annex A, B or C, and the arnendment shall thereupon enter into force for that Party subject to
paragraph 3 (e) of artie1e 22. On the expiry of one year from the date of the communication by the
depositary ofthe adoption ofthe amendment to Annex A, B or C, the arnendment shall enter into force
for all Parties that have not submitted a notifieation in aecordanee with the provisions of paragraph 3 (b)
of article 22.
In accordance with paragraph 4 of article22, an amendment to Annex A, B or e shall not enter
into force with respect to any Party thathas madea declaration with respectto any amendment to those
Annexes in accordance with paragraph 4 of article 25, in which case any such amendrnent shall enter
into force for sueh a Party on the ninetieth day after the date of deposit with the depositary of its
instrurnent ofratification, acceptance, approval or accession with respectto such arnendrnent.
The texts ofthe arnendrnent to Annex A, as contained in the above-mentioned decision ofthe
Conference of the Parties, in the six authentic languages are transrnitted herewith.

ADOPTlON D'UN AMENDEMENT A L'ANNEXE A
Le Secrétaire général de l'Organisation des Nations Unies, agissant en sa qualité de dépositaire,
communique :
La Conférence des Parties ala Convention susmentionnée a adopté, par décision Se-5/3, lors
de sa cinquieme réunion, tenue Geneve du 25 au 29 avril2011, un amendement !'annexe A
concernant l'tnscription de la substance chimique « endosulfan technique et ses isomeres » daos
a
a
!'annexe.
Les alinéas b) et e) du paragraphe 3 et le paragraphe 4 de I'article 22 de la Convention
disposent que toute Partie qui n'est pas en mesure d'accepter un amendernent aux annexes A, B ou e en
donne par écrit notification au dépositaire dans l'année qui suit la date de cornrnunication par le
dépositaire de l'adoption de l'amendement. Le dépositaíre informe sans délai toutes les Parties de toute
notification recue. Une Partie peut atout moment retirer une notification antérieure de non-acceptation
d'un amendement aux annexes A, B ou e, et cet amendement entre alors en vigueur al'égard de cette
Partie sous réserve des dispositions de l'alinéa e) du paragraphe 3 de l'article 22. A I'expiration d'un
délai d'un an acompter de la date de communication par le dépositaire de l'adoption d'un amendement
aux annexes A, B ou C, l'amendement entre en vigueur al'égard de toutes les Parties qui n'ont pas
communiqué de notification en application des dispositions de l'alinéa b) du paragraphe 3 de l'article
22.
Le paragraphe 4 de I'article 22 de la Convention dispose qu'un amendement aI'annexe A, B
ou e n'entre pas en vigueur al'égard d'une Partie qui a fait une déclaration au sujet des amendements a
ces annexes en application du paragraphe 4 de l'artlcle 25, auquel cas l'amendement entre en vigueur
pour cette Partíe le quatre-víngt-dixiéme jour suivant la date de dépót aupres du dépositaire de son
instrument de ratiflcation, d'acceptation ou d'approbation dudit amendement ou d'adhésion acelui-ci.
On trouvera ci-joint, dans les six langues authentiques, les textes de l'amendement a l'Annexe
A, tels qu'énoncés dans la décision susmentionnée de la Conférence des Parties.

The Conference ofthe Partíes,
Havtng considered the risk profile and risk rnanagement evaluation for endosulfan
(technical endosulfan, its related isomers and endosulfan sulfate) as transmitted by the Persistent
Organic PoIlutants Review Committee;'
Taking note of the recommendation by the Persistent Organic Pollutants Review Committee
to list technical endosulfan, its related isomers and endosulfan sulfate in Annex A to the Convention,
with specific excnrptions,"
l. Decides to amend part 1 of Annex A to the Stockholrn Convention on Persistent Organic
Pollutants to list therein technical endosulfan and its related isomers, with specific exemptions for
production as allowed for the parties listed in the Register of Specific Exemptions andJor for use on
crop-pest complexes as listed in accordance with the provisions of a new part VI of the annex by
inserting the following row:

identified as persistent organic pollutants.
3. Decides to insert a new Part VI in Annex A as follows:

The production and use of endosulfan shall be eliminated exeept for parties that have
notified the Secretariat oftheir intention to produce andJor use it in accordance with Article 4 ofthe
Convention. Specific exemptions may be available for the use of endosulfan for the following

des dérogations spécifiques, et/ou son utilisation dans les combinaisons culture/parasite inscrites
confonnément aux dispositions d'une partie VI de l'Annexe, en ajoutant la ligne suivante :
