The Federation of European Bars is open to all Bars established in a member
state of the Council of Europe and It is concerned with individual and democratic
representation of the European Bars.
It adheres to the principles which were established in the creation of the Conference of Principal Bars of Europe: observing the fundamental principles set out
in the European Convention on Human Rights bearing in mind the grouping of
cultures and civilizations which are Common to the Member Bars; the need to
guarantee for individuals and businesses the service of independent lawyers; the
need for an independent organization which ensures respect for the essential
principles of the profession of lawyer in Europe; consideration of the particular
role fulfilled by the European Bars in the defence of all liberties against every
political economic and judicial authority.
Today, the FBE represents 210 European Bars with 800.000 Lawyers.
We thank the Florence Bar Association for inviting us to their wonderful,
adorable city.

As Chairman of the Florence Bar Association and in the name of the entire
Board, it is with great pride that I announce our city as the location for the forthcoming 2011 Congress of the Federation of European Bars which will be held
from May 26th to 28th.
It is an honor for us to host an international event of this standing, and even
more in Florence, which in 2011 will open its new Courthouse.
The entire legal community of Florence, together with our Civic Associations,
will accompany you throughout this project, in our march to uphold justice, a
road we share daily at home and abroad.

Is Florence a city of Art or a masterpiece?
The historical center of Florence is so rich in masterpieces that it is hard to separate the city from its works; UNESCO has included it amongst the common heritage
of mankind with the following motivation: <<from the “roman quadrilateral” in the
Piazza della Repubblica area to the narrow and impervious roads of the medieval
city, right down to the splendor of the fifteen hundred Pitti Palace and to the transformation undergone for the period when Florence was Capital City, one can relive
the whole story of the city. The concentration of such a rich and valuable artistic,
but also scientific-naturalistic heritage in an enclosed and well defined area such
as the historical center, makes Florence unique and precious; extraordinarily beautiful churches, museums and art collections, historical gardens, squares, avenues,
ancient palaces: Florence may well be defined “an open air museum”, not just a
container of masterpieces but a masterpiece itself.>>

SOCIAL SECURITY FOR LAWYERS IN EUROPE
Comparative summary of specific national arrangements (descriptive
part); comparison between pension systems or ordinary or alternative
systems of social security in different States; implications on the tax side;
ethical implications; how see lawyers the existing systems.
1- GENERAL THEMES
• the present and desired state of social protection in different States;
• adapting systems (where they already exist) to the supranational European perspective;
• verifying the relevance of compulsory systems;
• the disadvantage of inscription at the bar (where it already exists) in relation to the general tax
system and the lack of consistency in how ethical norms are applied (between the different
States and the different bars of the same State);
• the possible advantages of an autonomous superannuation system;
• the basic free market alternative.
2- STATE INSURANCE FOR LAWYERS AS A SYSTEM (AN ALTERNATIVE TO THE
INDIVIDUAL’S PRIVATE INITIATIVE):
• is it a good thing for the national bar associations and for individual lawyers?
• is direct management by lawyers a good idea?
• should the territorial bars play a role (peripheral organisation and/or ethical control)?
• should it form part of a system of state protection for the national bars (including insurance, etc.)?
• might it be managed effectively by a common, autonomous European mutual providence
organisation?
3- STATE INSURANCE FOR LAWYERS AS A LEGAL COMPULSORY SYSTEM
(WHERE IT ALREADY EXISTS):
• is it in compliance with the general principle of free competition?
• is it compatible with a lawyer’s self-determination, independence and competitiveness?
• is a basis for solidarity and coverage useful for the bars?
• is self-determination to be preferred for the individual lawyer on the European market?
• does it guarantee equality of treatment for determination with the tax system?
• is it in conformity with the principal of gender equality (reduction of the maternity allowance)?
• should it also have an ethical dimension, and to what degree?

I SISTEMI PREVIDENZIALI FORENSI IN EUROPA
Panoramica delle singole situazioni nazionali (parte descrittiva); compa
razione con gli ordinari o alternativi sistemi pensionistici / assistenziali nei
vari Stati; eventuale connessione con i sistemi fiscali; eventuale rilievo deontologico; opinione sui sistemi vigenti da parte della generalità degli
avvocati
1- TEMI OBIETTIVO
• lo stato dei bisogni previdenziali reali e percepiti;
• l’adeguatezza dei sistemi (ove esistenti) alla prospettiva sovranazionale europea;
• la verifica della opportunità di sistemi obbligatori;
• l’handicap del collegamento (ove esistente) al sistema fiscale generale e della disomogeneità del
l’applicazione (tra i vari Stati e tra i vari Ordini dei medesimi Stati) delle regole deontologiche;
• l’eventuale vantaggio di un sistema sovranazionale autonomo;
• la semplice alternativa del libero mercato.
2- LA PREVIDENZA FORENSE COME SISTEMA
(ALTERNATIVO ALLA LIBERA INIZIATIVA DEI SINGOLI):
• è vantaggiosa per le Avvocature nazionali e per i singoli avvocati?
• è opportuna la gestione diretta da parte degli avvocati?
• è positivo un ruolo degli Ordini territoriali (organizzativo periferico e/o di controllo deontologico)?
• potrebbe essere parte di un sistema welfare delle Avvocature nazionali (esteso ad assicurazioni etc)?
• potrebbe essere utilmente esercitato da una Cassa di Previdenza Forense Europea, comune ed autonoma?
3- LA PREVIDENZA FORENSE COME SISTEMA LEGALE
ED OBBLIGATORIO (DOVE ESISTENTE):
• è conforme al principio generale della libera concorrenza?
• è compatibile con l’autodeterminazione, indipendenza e competitività dell’avvocato?
• è utile alla categoria il contenuto solidaristico ed assistenziale?
• sarebbe preferibile per il singolo avvocato l’autodeterminazione nel mercato europeo?

LA PREVISIÓN SOCIAL DE LOS ABOGADOS EN EUROPA
Panorámica de las situaciones nacionales particulares (parte descriptiva);
comparación con los sistemas de pensiones o asistenciales ordinarios o
alternativos en los diversos estados; eventuales conexiones con los sistemas fiscales; eventual relevancia deontológica; opiniones de la generalidad de los abogados sobre los sistemas vigentes.
1- TEMAS GENERALES
• la situación actual de la previsión en diversos estados;
• el estado de las necesidades reales y perceptibles de la previsión;
• la adecuación de los sistemas (donde existen) a la perspectiva supranacional europea;
• la verificación de la conveniencia de los sistemas obligatorios;
• el hándicap de la colegiación (donde existe) respecto al sistema fiscal general y de la no
homogeneidad de la aplicación (entre los diversos estados y los diversos colegios de un mismo
estado) de las normas deontológicas;
• la eventual ventaja de un sistema supranacional autónomo;
• la sencilla alternativa del libre mercado.
2- LA PREVISIÓN SOCIAL DE LOS ABOGADOS COMO SISTEMA (ALTERNATIVA
A LA LIBRE INICIATIVA DEL INDIVIDUO):
• ¿ es ventajosa para las Abogacías nacionales y para los abogados individuales?
• ¿es oportuna la gestión directa por parte de los abogados?
• ¿es positivo que los Colegios territoriales desempeñen un papel (organizativo periférico y/o de con
trol deontológico)?
• ¿ podría ser parte de un sistema de asistencia social de las Abogacías nacionales (abarcando
seguros, etc)?
• ¿podría ser gestionado provechosamente por una Mutualidad Europea de Prevision de los
Abogados, común y autónoma?

LA PREVOYANCE SOCIALE DES AVOCATS EN EUROPE
Tour d’horizon des situations nationales spécifiques (partie descriptive);
comparaison entre les systèmes de retraite ou d’assistance ordinaires ou
alternatifs dans les différents États; éventuelles connexions avec les systèmes fiscaux; éventuelle portée déontologique; opinions de la plupart
des avocats sur les systèmes en vigueur.
1- THEMES GENERAUX
• la situation actuelle de la prévoyance dans différents États;
• l’état des besoins de prévoyance réels et perceptibles;
• l’adaptation des systèmes (là où il existent) à la perspective supranationale européenne;
• la vérification de la pertinence des systèmes obligatoires;
• le handicap de l’inscription au barreau (là où elle existe) par rapport au système fiscal général et
de l’absence d’homogénéité de l’application (entre les différents États et les différents barreaux
d’un même État) des normes déontologiques;

• la gestion directe de la part des avocats est-elle opportune?
• est-il positif que les barreaux territoriaux jouent un rôle (organisationnel périphérique et/ou de
contrôle déontologique)?
• pourrait-elle faire partie d’un système de protection sociale des barreaux nationaux (incluant
assurances, etc.)?
• pourrait-elle être gérée de façon profitable par une mutuelle européenne de prévoyance des
avocats, commune et autonome?
3- LA PREVOYANCE SOCIALE DES AVOCATS EN TANT QUE SYSTEME LEGAL
ET OBLIGATOIRE (LA OU ELLE EXISTE):
• est-elle conforme au principe général de libre concurrence?

SOZIALE SICHERHEIT FÜR ANWÄLTE IN EUROPA
Überblick über die Altersvorsorge in verschiedenen Staaten ; Vergleich
nationaler ordentlicher und alternativer Rentensysteme bzw.
Fürsorgesysteme; Allfällige fiskalische Auswirkungen; deontologische
Bedeutung, Beurteilung der geltenden Systeme durch die Anwaltschaft.
1- HAUPTTHEME
• aktueller Stand und anzustrebende Situation;
• die Angemessenheit vorhandener Systeme aus der supranationalen Perspektive;
• die Prüfung der Zweckmäßigkeit der obligatorischen Teilnahme;
• der Nachteil oder Vorteil in Verbindung mit dem staatlichen Steuersystem und allfällige ethische
Zusammenhänge;
• der Vorteil eines autonomen oder supranationalen Systems;
• die Alternative des freien Marktes und der Kapitalmärkte.
2- DIE VORSORGE ALS SYSTEM
• ist dies vorteilhaft für die nationalen Anwaltschaften und für die einzelnen Rechtsanwälte und
Rechtsanwaltsanwärter?
• st die direkte Verwaltung durch die Rechtsanwälte angebracht?
• könnte die Verwaltung durch eine europäische, gemeinschaftliche und autonome Versorgungskasse
zweckmäßig sein?
• könnte diese Teil eines gemeinnützigen Systems sein (Versicherungen, Gruppenverträge etc.)?
• wäre eine Rolle der Regionalkammern wünschbar?
3- DIE VORSORGE ALS OBLIGATORISCHES RECHTSSYSTEM
• Konformität mit dem allgemeinen Prinzip des freien Wettbewerbs?
• Kompatibilität mit der rechtsanwaltlichen Selbstbestimmung, Unabhängigkeit und
Konkurrenzfähigkeit des Rechtsanwalts?
• Ist der solidarische und fürsorgliche Inhalt vorteilhaft?
• Würde dies für den einzelnen Rechtsanwalt zu mehr Selbstbestimmung im europäischen
Markt führen?
• Garantiert diese die Gleichberechtigung wenn sie mit dem staatlichen Steuersystem wie immer
verknüpft ist?
• Konformität mit dem Prinzip der geschlechtlichen Gleichberechtigung?
• Sollte oder hat diese eine ethische Bedeutung, wenn ja in welchem Maße?

Cancellation Policy. Cancellation of registration will be accepted only against a written request

TOUR 1 - SANTA MARIA NOVELLA CHURCH AND CLOISTERS
Departure at 9.00. Meeting point in front of the entrance of the Palazzo dei Congressi. Return at
12.30 pm.
Visit to the Santa Maria Novella Church, built in Gothic style by the Dominicans between 1279 and
1357, and its cloisters decorated with a remarkable fresco cycle by some of the most important Florentine painters of the 16C.
At the end visit to the Officina Profumo-Farmaceutica di Santa Maria Novella overlooking the Chio-
stro Grande of the Dominican convent. The charming chemist’s shop still produces its own perfumes and soap according to antique recipes. It boasts a collection of antique pharmacy jars, 17C
vases and beautiful 18C and 19C furniture.
TOUR 2 - RENAISSANCE SCULPTURE
Departure at 9.00. Meeting point in front of the entrance of the Palazzo dei Congressi. Return at
12.30 pm.
Visit to the Bargello Museum, located in a medieval fortress built in 1255 as city hall, the oldest seat
of government which survives in Florence. Walk on to Orsanmichele built in 1337 as a grain market
and later converted into a church.
TOUR 3 - IN THE FOOTSTEPS OF MICHELANGELO
Departure at 9.00. Meeting point in front of the entrance of the Palazzo dei Congressi. Return at
12.30 pm. Visit to the Accademia Museum, which conserves the most important masterpieces of
sculpture by Michelangelo, to the Medici Chapels - situated behind the apse of the church of San
Lorenzo - which include the celebrated Sagrestia Nuova, private mausoleum built by Michelangelo
in the first half of the 16C for the Medici family. Visit to the Laurentian Library a remarkable
monument of Mannerism architecture.
