Y OBRAS MENORES QUE NO PRECISEN DE LICENCIA URBANÍSTICA
La LOUA (art. 169) establece los actos sujetos a licencia urbanística municipal, encontrándose en dicho artículo las obras de
construcción, edificación e implantación de instalaciones de toda clase de suelo así como las de modificación o reforma, cuando
afecten a la estructura, disposición interior o aspecto exterior, así como las de demolición.Dicha normativa se encuentra especificada, en cuanto a obras menores, en el art. 44 del PGOU.-Según dicho artículo precisan
licencia lo siguiente: vados, quioscos, rótulos, anuncios, postes, toldos, marquesinas, ejecución de obras interiores en locales no
destinados a vivienda que no modifiquen su estructura, reparación de cubiertas y azoteas, colocación de puertas y ventanas, de rejas,
construcción, reparación o sustitución de tuberías de instalaciones, desagües y albañales, pozos, modificación de balcones, repisas o
elementos salientes, formación de aseos en locales, construcción de escaparates, reposición de elementos alterados por accidente o
deterioro de fachadas, muros, vallas, piscinas.
Toda persona es susceptible de necesitar realizar pequeñas obras que no están incluidas en las indicadas anteriormente, las cuales
no precisan de licencia sino de una mera comunicación al Ayuntamiento.
Es por lo que se facilita a los propietarios estas actuaciones:
•
Eximiendo de la obligación de solicitar licencia para los trabajos de pintura y otros actos no incluidos en el art. 44 del PGOU
o en el art. 169 de la LOUA.

Facilitando el modelo de comunicación que deberá realizar a este Ayuntamiento, con la indicación de que, si la realización de
los mismos precisa ocupación de vía pública se deberá solicitar al Departamento correspondiente.
Excepciones.- Siempre precisarán licencia de obras:
•
Las obras en Casco urbano de Mijas Pueblo, en zona protegida por estar catalogada como Bien de Interés cultural.
•
Las que precisen informes sectoriales (por estar afectando a zona de litoral, de carreteras, ríos, arroyos, vías pecuarias, etc)
•
Las que afecten a vía pública o dominio público
•
Las que se realicen en suelo no urbanizable o suelo urbanizable
•
Las que afecten a edificaciones en situación de fuera de ordenación o asimilado a fuera de ordenación.
•
Las que tengan por objeto legalizaciones de obras realizadas sin licencia
En un plazo de diez días podría usted recibir informe de los Servicios Técnicos del
Ayuntamiento indicando que la obra es contraria a la normativa o que precisa licencia de
obras, por lo que se recomienda no comenzar la obra hasta pasado diez días hábiles desde la
comunicación, ya que el Reglamento de Disciplina Urbanística de Andalucía obliga a iniciar
expediente disciplinario y sancionador en los casos de realizar obras sin licencia que vulnere
la normativa urbanística.
Communication of Painting, Emergency Repairs and Minor Works that do not need a Building License
Article 169 of the LOUA establishes what type of work requires an urban building license and includes all
construction, edification and installation of any type of flooring and also any modification and reforming when
the structure, interior or exterior disposition is affected and in cases of demolition.
When referring to minor work, these regulations are specified in article 44 of the PGOU that states that the
following need a license: parking signs, kiosks, signs, announcements, posts, awnings, canopies, any work carried
out in commercial premises that do no modify the structure, repairing decks and roofs, installing doors and
windows, iron grills, building, repairing or replacing installation and water pipes, wells, modification of
balconies, ledges and protruding elements, installation of bathrooms in commercial premises, building of shop
windows, repairing or replacing damaged elements of building facades, walls, fencing and swimming pools.
At some point, anyone could need to carryout small jobs that are not included in those mentioned above and
these are the ones that do not need a license, only communication to the Town Hall. Because of this, we have
approved the following:
Exempting of the obligation to apply for a license for all the jobs of painting and others that are not
included in article 44 of the PGOU or in article 169 of the LOUA.
• Providing the communication form that has to be presented to this Town Hall at the same time indicating
that if the work requires the occupation of public roads, a separate application for this has to be made.
Exemptions: - The following will always need a building license.
• Building work carried out in the urban area of Mijas village, a protected area that is catalogued as “Area
of Cultural Interest”.
• Those that require a sectorial report (if in the affection area of sea, roads, river, streams, animal tracks
etc…)
• Those that affect public roads or land.
• Those that are carried out in Un-urbanised or Urbanised land.
• Those that are carried out on buildings that are in any type of irregular situation.
• Those that are being carried out with the purpose of legalising work carried out illegally.

In a period of 10 working days you may receive a report from the Municipal Technical Department indicating
that the work does not adjust to the regulations or that it needs a license. For this reason we recommend
that you wait for this period before starting the work, because, if a license is required, and the work is
carried out without one, the Town Planning Disciplinary Regulations oblige us to open a file and you could be
fined.
