GENERALIDADES

GENERALITIES
1.1.
Todos los vuelos hacia, desde o sobre el
territorio de Colombia y los aterrizajes en
dicho territorio estarán sometidos a los
reglamentos
vigentes
de
Colombia
relativos a la Aviación Civil.
1.1.
Every flight to, from or over and landings
in Colombian territory shall be subject to
Colombian vigent regulations related to
the civil Aviation.
1.2.
Las aeronaves que vuelen hacia el
territorio de Colombia o salgan del
mismo, harán su primer aterrizaje o su
salida
final
de
un
aeropuerto
internacional (ver AD 1.3).
1.2.
Aircraft which arrive or leave the
Colombian territory, shall make its first
landing or final departure
of an
international airport (see AD 1.3.).

Los vuelos regulares internacionales
explotados
por
empresas
aéreas
extranjeras hacia o en tránsito por
Colombia, deben cumplir los siguientes
requisitos:

International scheduled flights operated
by foreign airlines to Colombia or in
transit through it, must achieve the
following requirements:

REGULAR FLIGHTS
a) Cuando exista tratado o convenio con
el Estado bandera, la designación,
permiso de funcionamiento y demás
aspectos administrativos, se sujetarán en
primer
lugar
a
las
disposiciones
expresadas en el tratado o convenio
vigente y luego en las normas legales y
reglamentarias colombianas.
a) When a treatment or agreement exist
with the flag state, designation, operating
permission and other administrative
matters will be mainly held to the
provisions stated in the treatment or a
valid agreement and then in the
Colombian laws and regulations.
b) Cuando no exista tratado o convenio
con el país de bandera, el permiso de
funcionamiento se concederá o no,
teniendo en cuenta las conveniencias
nacionales, la seguridad pública, los
intereses económicos del transporte
aéreo y con sujeción a los convenios,
tratados
o
pactos
internacionales
suscritos por el gobierno de Colombia,
ciñéndose siempre al principio de
reciprocidad real y efectiva.
b) When the treatment or agreement
with the flag state does not exist, the
operation permission shall be granted or
not, taking in count the national interest,
public safety, economic interests of air
transport and the holding to international
agreements,
treatments
or
pacts
subscribed by the government of
Colombia and merely provided by the
real and effective reciprocity principle.
c) La solicitud de permiso de operación
para establecer un servicio internacional
de transporte público exista o no tratado
o convenio con el país bandera, debe
presentarse a la Unidad Administrativa
Especial de Aeronáutica Civil.

establish an international public transport

Las
aeronaves
de
los
estados
contratantes del Convenio sobre aviación
civil internacional, firmado en Chicago en
1944, en vuelos internacionales regulares
sin derecho de tráfico en el país, pueden
sobrevolar el territorio de Colombia y
hacer escalas con fines no comerciales,
para lo cual deben tramitar el respectivo
plan de vuelo. Toda escala debe
efectuarse
en
un
aeropuerto
internacional. No requieren permiso
previo de la autoridad aeronáutica
colombiana.

2.1.2
The aircraft of the agreement contracting
states about International Civil Aviation
signed in Chicago in 1944, in regular
international flights without traffic rights
in the country, may overfly and layover in
Colombian territory for non-commercial
objectives, for which they should process
the respective flight plan. Any scale must
take place at an international airport. Not
require prior permission from the
Colombian aviation authority.

The arrival, operation and stayover of
foreign aircraft in commercial air
services, scheduled or not, as well as
State aircraft shall be submitted to prior
authorization in the bilateral and
multilateral valid agreements about the
specific topic, or reciprocity condition.
When such flights involve commercial
traffic
rights,
the
corresponding
authorization shall be granted by La
Oficina de Transporte Aéreo.
El ingreso, operación y permanencia de
aeronaves
extranjeras
de
servicios
aéreos comerciales, regulares o no, así
como el de aeronaves de Estado, estará
sometido a autorización previa, de
conformidad con lo previsto en los
acuerdos bilaterales o multilaterales
vigentes sobre la materia, o a condición
de reciprocidad. Cuando tales vuelos
impliquen derechos comerciales de
tráfico, la correspondiente autorización
será otorgada por la Oficina de
Transporte Aéreo.
2.2.
Requisitos de documentación para
autorizar las aeronaves

Documentation requirements for the
aircraft approval
In the case of foreign registered aircrafts
operated by Colombian operators of
commercial public air transport, they
must obtain the required authorization
from La Oficina de Registro Aeronáutico,
to operate the foreign registered aircraft
in Colombia, prior the registration of the
certificate or contract pursuant to which
is acquired as the operator on it and the
fulfillment
of
the
demanded
requirements. This authorization shall be
carried in the aircraft with the other
documents on board.
En el caso de aeronaves con matrícula
extranjera que sean explotadas por
operadores colombianos de servicios
aéreos comerciales de transporte público,
estos deberán obtener la correspondiente
autorización de la Oficina de Registro
Aeronáutico, para explotar la aeronave
con matrícula extranjera en Colombia,
previo el registro del acto o contrato en
virtud del cual se adquiere la calidad de
explotador sobre la misma y el
cumplimiento de los demás requisitos
exigibles. Dicha autorización deberá
portarse en la aeronave junto con los
demás documentos de a bordo.
2.2.1
Para obtener autorización para la entrada
y salida de sus aeronaves hacia y desde
Colombia, los explotadores de líneas
aéreas
deberán
presentar
los
documentos de aeronave mencionados a
continuación. Todos los documentos
enumerados deben ajustarse al formato
normalizado de la OACI establecidos en
los apéndices correspondientes del Anexo
9 OACI y son aceptables cuando se
presentan en español, y se llenen en
forma legible. No se requiere visados en
relación con tales documentos.
2.2.1
To obtain permission for arrival and
departure of their aircraft to and from
Colombia, the airline operators must
submit the aircraft documents listed
below. All the documents listed must
comply with the ICAO standard format
set out in the relevant appendixes wich
correspond to the appendix 9 of ICAO
and are acceptable when they are in
spanish, and get filled legibly. The visa is
not required in terms to such documents.

b. If the passenger are not embarked or
disembarked and if the cargo are loaded
or unloaded is not necessary to submit
the aircrafts documents to the authorities
mentioned up, with exception of the
General Declaration.

Si un explotador de aeronaves se
propone emprender un vuelo (o una serie
de vuelos) no regular (es) hacia Colombia
con el fin de embarcar o desembarcar
pasajeros, mercancías o correo, es
necesario que solicite a la Dirección de
Servicios a la Navegación Aérea de la
Unidad
Administrativa
Especial
de
Aeronáutica Civil, autorización para llevar
a cabo tales operaciones con no menos
de 24 horas de anticipación al aterrizaje
previsto. La solicitud deberá contener la
siguiente información, en el orden que se
indica a continuación:
3.1.1
If an aircraft operator intends to launch a
flight (or series of flights) which are not
regular (s) to Colombia in order to
embark or disembark passengers, cargo
or mail, you must apply to the Dirección

Vuelos no regulares sin derechos
comerciales: Las aeronaves de los
estados contratantes del convenio sobre
aviación civil internacional firmado en
Chicago en 1.944, pueden sobrevolar el
territorio de Colombia y hacer escalas
con fines no comerciales (escala técnica)
para
lo
cual
deben
tramitar
oportunamente el respectivo plan de
vuelo. Toda escala debe efectuarse en un
aeropuerto internacional. No requieren
permiso
previo
de
la
autoridad
aeronáutica colombiana.
3.1.2
Non-scheduled
flights
without
commercial rights: Aircraft of the
contracting states of the Convention on
International Civil Aviation signed in
Chicago in 1.944, may fly over Colombian
territory and make layovers for noncommercial purposes (technical layover)
for which they must arrange timely
respective flight plan. Any layover must
take place at an international airport. Not
require prior permission from the
Colombian aviation authority.

4.1
Sobrevuelo, entrada y salida de
aeronaves privadas extranjeras: Las
aeronaves privadas matriculadas en
cualquiera de los estados contratantes
del convenio sobre aviación civil firmado
en Chicago en 1.944, pueden sobrevolar
el territorio de Colombia y entrar y salir
del mismo, para lo cual deberán tramitar
oportunamente el plan de vuelo.
4.1
Overflight, entry and departure of
foreign private aircraft: Private aircraft
registered in any of the contracting states
of the Convention on Civil Aviation signed
in Chicago in 1944, may fly over
Colombian territory and enter and leave
thereof, for which they must timely
processing the flight plan.

anterior, las aeronaves de aviación
general o no comercial, requieren
autorización especial para su ingreso y
permanencia en el territorio colombiano,
en los siguientes casos:

general aviation (non commercial) for
Colombian or foreign who enter in
Colombian territory, in accordance with
Articles 5 and 24 of the 1944 Chicago
Agreement

Colombia, shall be admitted temporarily
and without special authorization, up
to a term of forty-eight (48) hours, just if
they enter and exit through the same
airport

- Nombre del explotador solicitante, con
indicación de su número telefónico y
dirección AFS, correo electrónico o
código postal, a donde se enviaría la
respuesta.
- Name of the applicant operator,
including his/her phone number and
address AFS, email or postal code,
where the response is sent.
- Nombres de los tripulantes a cargo, con
indicación de sus números de licencias,
expedidas o convalidadas por el Estado
de matrícula de la aeronave.
- Names of the crew in charge, along
with their numbers of licenses issued or
validated by the State of aircraft
registration.
- Cantidad de ocupantes no tripulantes
que ingresarán y saldrán del país en la
aeronave.
- Number of occupants who does not
belong the crew who enters and exits
the country in the aircraft.
- Aeropuerto (s) de entrada y salida
hacia y desde el territorio colombiano
(deberán ser aeropuertos internacionales) y fechas previstas al efecto.
- Airport (s) of entry and exit to and from
Colombia (to be international airports)
and deadlines for this purpose.
- Fechas y horas aproximadas, previstas
para la entrada y salida.
- Aproximated dates and times, provided
for the entry and exit.
- Lugar o lugares (ciudad y aeropuerto)
donde permanecerá u operará la
aeronave.
- Place or places (city and airport) where
it will remain or operate the aircraft.
- Lugar (dirección y teléfono) donde se
podrá localizar a la tripulación en
Colombia.
- Place (address and phone number)
where you can find the crew in
Colombia.
- Motivo de la permanencia. Si el motivo
fuese
para
efectuar
vuelos
de
demostración, deberá informarse el
nombre del o los interesados en dicha
demostración.
Si
se
tratase
de
reparación
o
mantenimiento,
se
indicará el nombre del taller, tipo de
trabajo y duración aproximada de los
mismos.
- Reason of the stay. If the reason were
to make demonstration flights must
know the names or interested about
the demonstration. If it were about
repairing or maintenance, state the
name of the workshop, type of work
and approximate duration thereof.

amparen
la
responsabilidad
del
explotador, en relación con daños a
terceros en la superficie y por abordaje
que pudiera causar la aeronave en
Colombia.
c. Copies of insurance policies that
protect the operator's liability in
relation to public liability and collision
surface that could cause the aircraft in
Colombia.
d. Cuando el ingreso de la aeronave
extranjera
tenga
por
objeto
la
realización de trabajos de reparación o
mantenimiento, o cuando durante su
permanencia sea necesario efectuarle
servicios diferentes a los de tránsito,
tales trabajos deberán ser efectuados
en talleres autorizados por la UAEAC y
certificados para el tipo de aeronave y/
o servicio en cuestión y deberá
aportarse
la
autorización
correspondiente
de
la
autoridad
aeronáutica del Estado de matrícula de
la aeronave. Así mismo, la Oficina de
Control y Seguridad Aérea, deberá dar
su visto bueno previo a la ejecución de
los trabajos e impartirá su autorización
cuando hayan de efectuarse vuelos de
prueba.
d. When the arrival of foreign aircraft
intended to carry out repairing or
maintenance, or if during its stay is
necessary to make different services
than traffic, such works must be
carried out at workshops approved by
the UAEAC and certified for the aircraft
type and / or service in question and
must be provided proper authorization
from the aeronautical authority of the
State of aircraft registration. Likewise,

Autorización de permanencia a corto
plazo
4.4.1
Approval of short-term stay
La autorización de que tratan los
numerales anteriores se concederá por
un término que no exceda de quince (15)
días. Si el término concedido inicialmente
fuere inferior, podrá autorizarse su
extensión hasta completarlos.
The authorization of the preceding
paragraphs shall be granted for a term
not exceeding fifteen (15) days. If the
term is less than originally granted, the
extension may be allowed to complete.
Si la aeronave hubiera entrado sin
autorización especial por un período
inferior a 48 horas, y se requiriera
prolongar su permanencia, se podrá
solicitar la correspondiente autorización
por el tiempo adicional sin exceder los 15
días. En este caso la solicitud deberá
contener la información y anexos
previstos en el numeral anterior. Si no se
solicitara y obtuviera la prórroga, a la
aeronave no se le permitirá ningún vuelo
diferente al que corresponda a su salida
del país.
If the aircraft had entered without special
authorization for a period of less than 48
hours and was required to extend their
stay, they may request permission for
additional time which not exceed 15
days. In this case the request shall
contain the information and exhibits
provided in the preceding paragraph. If
not were obtained the extension, the
aircraft will be not allowed any flights
that no corresponds to its departure.
Vencidos los quince días iniciales, se
podrá solicitar su prórroga hasta por 15
días más.
If the initial fifteen days expired, you can
request its extension up to extra 15 days.
En todo caso, no se autorizará la
permanencia de la aeronave en territorio
colombiano por más de 30 días.
In every case, the stay of the aircraft in
Colombia for more than 30 days.
Si la aeronave debiera efectuar vuelos
sucesivos de entrada y salida, así se
indicará en la solicitud inicial; caso en el
cual, su permanencia total en Colombia
no podrá ser superior a quince días
dentro del respectivo mes calendario.
If the aircraft should make consecutive
flights in and out, it would be indicated in
the initial application in which case, its
total stay in Colombia may not exceed
fifteen days in the respective month.
No obstante lo anterior, si al vencimiento
del plazo indicado o su prórroga, se
demostrasen
dificultades
técnicas,
relativas al mantenimiento, reparación u
operación de la aeronave, o a condiciones
meteorológicas, u otras circunstancias,
que terminantemente impidan su salida,
podrá solicitar una prórroga especial para
su permanencia en el país, hasta que
sean superadas tales dificultades, sin
exceder de treinta (30) días.
However, if the stated deadline expire,
demonstrating
technical
difficulties
concerning the maintenance, repair or
operation of the aircraft, or weather
conditions or other circumstances that
strictly prevent their departure, could be
requested a special extension to remain
in the country, until they overcome these
difficulties, without exceeding thirty (30)
days.

En éste caso la aeronave quedará
suspendida de toda actividad de vuelo
mientras permanezca en Colombia y tan
sólo se le autorizarán vuelos de prueba
(en
el
caso
de
reparación
o
mantenimiento) o el que corresponda a
su salida definitiva del país.

Colombia and is only authorized test
flight (in the case of repair or

Sin perjuicio de lo previsto en el numeral
anterior, la UAEAC podrá autorizar la
permanencia de aeronaves con matrícula
extranjera,
empleadas
en
aviación
corporativa o ejecutiva hasta por
períodos de seis (6) meses prorrogables,
siempre y cuando su explotador sea una
persona jurídica nacional o extranjera
que acredite negocios permanentes en
Colombia y en el Exterior, que ameriten
frecuentes entradas y salidas de la
aeronave hacia y desde territorio
colombiano o su permanencia por
períodos prolongados.

Sin perjuicio de las autorizaciones o
vistos buenos previos que deban impartir
a las aeronaves extranjeras, la Oficina de
Transporte Aéreo (para ejercer derechos
de tráfico), la Oficina de Registro
Aeronáutico

extranjeras) y la Oficina de Control y
Seguridad
