STATEMENT ON NON-DISCRIMINATORY TEACHING OF CATHOLIC
RELIGION IN SPANISH SCHOOLS,

Teaching of religion in Spanish schools is regulated by agreements between
the State and the different religious confessions. There are specific
agreements with the islamic, jewish, evangelic and Roman Catholic
confessions.
The agreements with the Holy See provide for the teaching of Catholic
religion as a subject that must be offered as an option in all schools, on
equal grounds with the rest of subjects in the school curricula. This should
be done in a non-discriminatory way for the pupils, and should be evaluated
in the same way as other subjects, having the same validity in the student's
transcript.
As of now, more 80% of all parents in Spain opt in for the teaching of
Catholic religion to their children. Also, the Spanish Constitution recognizes
that “the public authorities shall guarantee the right of parents to choose for
their children a moral and religious education in accordance with their own
convictions”.
With the 2006 education reform, the range of this subject was severely
degraded, up to the point of disappearing as such in all schools except in
confessional Catholic ones, being replaced by “History and Culture of
religions”. Moreover, there is no alternative subject for pupils who don't
choose this last one, which in many cases leads to the Catholic Religion
subject being taught out of normal school hours. This is a violation of the
agreements between Spain and the Holy See, which has been repeteadly
denounced to no avail.
The recently elected Spanish government is now preparing a new education
reform, and we believe this is a good occasion to amend the present
situation and fulfill all the provisions of the above mentioned agreements.
Recommendations:

To the government of Spain, to fully honor the Church-State
agreements in the forthcoming reform of education laws, in particular
regarding the teaching of Catholic Religion in schools, which should
be imparted on equal grounds with other subjects in a nondiscriminatory way.

PROPUESTA SOBRE LA EDUCACIÓN NO DISCRIMINATORIA DE LA
RELIGIÓN CATÓLICA EN LAS ESCUELAS ESPAÑOLAS,

La enseñanza de religión en las escuelas españolas está regulada por
acuerdos entre el Estado y las diferentes confesiones religiosas. Existen
acuerdos específicos con las confesiones islámica, judía, evangélica y la
Iglesia Católica.
Los acuerdos con la Santa Sede contemplan la enseñanza de la Religión
Católica como una asignatura que debe ser ofrecida como opción en todas
las escuelas, en igualdad de condiciones con el resto de asignaturas del
currículum escolar. Esto debe hacerse en una forma no discriminatoria para
los alumnos, y debería ser evaluada de la misma forma que otras
asignaturas, teniendo la misma validez en el expediente académico.
Actualmente más del 80% de los padres españoles elige la enseñanza de la
religión Católica para sus hijos. Además, la Constitución Española establece
que “los poderes públicos garantizarán el derecho de los padres a elegir una
educación moral y religiosa de acuerdo con sus propias convicciones”.
Con la reforma educativa de 2006, la importancia de esta asignatura fue
severamente menoscabada, hasta el punto de desaparecer como tal en
todas las escuelas excepto en las católicas, siendo reemplazada por
“Historia y Cultura de las religiones”. Aún más, no hay una asignatura
alternativa para los alumnos que no elijan esta última, lo que en muchos
casos lleva a que la asignatura de Religión sea impartida fuera del horario
normal. Esto es una violación de los acuerdos entre España y la Santa Sede,
que ha sido repetidamente denunciada sin efecto.
El recientemente elegido Gobierno de España está preparando una nueva
reforma educativa, y creemos que esta es una buena ocasión para corregir
la situación actual y cumplir todos los puntos de los acuerdos mencionados.
Recomendaciones:
• Al Gobierno de España, que contemple el completo cumplimiento de
los acuerdos Iglesia-Estado en la futura reforma educativa, en
particular en lo concerniente a la enseñanza de Religión Católica en
las escuelas, que debería ser impartida en igualdad de condiciones
con otras asignaturas, de una forma no discriminatoria.
