The allocation of responsibility for payment of the false or forged check, the
analysis of some of the requirements of the note, the figure of note representation, blank
promissory note, the validity of the clause in the loan that includes a promissory note loan
guarantee and enforceability of the exceptio doli, are issues inwhich the various Provincial
Courts have been speaking of in different ways.
Recently, the Supreme Court has issued, on one side, series of statements which

comes to finish the unequal existing doctrine, for example in the field of representation or
in repay loan guarantee. On the other hand, some of our High Court decisions have been
intended to clarify certain points relating to the constitution of the note or the origin of the
exceptio doli.
With respect to the blank promissory note, it is also analyzed its configuration, the
time-limit in which it should be completed and the effects of the underlying relationship in
relation to third parties.

La imputación de la responsabilidad del pago del cheque falso o falsificado, el
análisis de algunos de los requisitos del pagaré, la figura de la representación en el pagaré,
el pagaré en blanco, la validez de la cláusula en el préstamo que incorpora un pagaré en
garantía del préstamo y la oponibilidad de la exceptio doli son cuestiones sobre las que las
distintas Audiencias Provinciales se han venido pronunciando de una manera dispar.
Recientemente, el Tribunal Supremo ha dictado, de un lado, una serie de
pronunciamientos donde viene a acabar con la desigual doctrina existente, por ejemplo, en
el ámbito de la representación o en lo perteneciente al préstamo con garantía de pagaré. De
otro lado,
otras decisiones de nuestro Alto Tribunal han tenido como objeto aclarar
determinados extremos referidos a la constitución del pagaré o a la procedencia de la
exceptio doli.
En lo concerniente al pagaré en blanco, se analiza además, su configuración, el
momento-límite en el cual debe estar cumplimentado y los efectos de la relación subyacente
en relación con los terceros.
