Ordinance No. 2013- 13
An ordinance calling a runoff election to determine City Council Member Super
District 5 for the City of Victoria, establishing procedures for holding this election,
designating the precincts and polling places, appointing certain officers to conduct
said election, providing for severability, declaring an emergency, and providing an
effective date.
Whereas the results of the Election held on May 11, 2013 for the position of City
Council Member Super District 5, indicate that no candidate in the race for this position
received a majority of all votes cast for the position;
Whereas City Council finds (1)this election was duly called and notice thereof
was duly given, 2
( )this election was held under and in strict conformity with applicable
laws, 3)
( only duly qualified voters of the City voted in this election, and (4)due returns
of this election was made by the proper officers;
Whereas Article VII,Section 2 of the Victoria City Charter requires that a runoff
election to fill this position be held between the two candidates who received the highest
number of votes, with this election being held not earlier than the 20 or later than the
45 day after the date the final canvass of the main election is completed, and the election
results indicate one candidate has received the highest number of votes for this position;
Now therefore, be it ordained by the City Council of the City of Victoria:
In accordance with the laws of the State of Texas and the Charter of the City of Victoria,

Texas a runoff election in the voting precinct that applies to this position, in the City of Victoria for the
purpose of electing City Council Member Super District 5, shall be held on June 15, 2013.
2.
This election shall be conducted and held at the applicable precinct and the respective
polling place designated on Exhibit "A,"
and Exhibit `B,"
and the persons listed on the attached Exhibit
B"are hereby appointed officers to conduct this election at the respective applicable election precinct
and polling place listed in the attached Exhibit `B"that are located in the territorial limits of the City of
Victoria, Texas.
3.
The Victoria County Elections Administrator, George Matthews, is hereby appointed
administrator and early voting clerk for this election. The Victoria County Elections Administrator will
conduct the election, handle the administrative details, and provide the returns of the city election for
canvassing by the City Council, all in accordance with the City Charter and the Constitution and laws of
the State of Texas.
4.
The use of a direct recording entry voting system for election day and early voting in
person is hereby authorized. The use of optically scanned paper ballots for early voting by mail is further
authorized.
5.
Kathy Salyer is appointed Presiding Judge of the Early Voting Ballot Board for
canvassing the early voting ballots for this election.
6.
The Mayor is hereby authorized and directed to issue an Order of Election and a Notice
of Election, which shall be published and posted in accordance with state law.

By approving and signing this ordinance, the Mayor of the City of Victoria officially

confirms as his action all matters recited in this ordinance which may, by law, come within his
jurisdiction.

If any portion of this ordinance, or the application thereof to any person or circumstances,
shall be held invalid or unconstitutional by a Court of competent jurisdiction, the remaining provisions
hereof shall nevertheless be valid, the same as if the portion or portions held invalid or unconstitutional
had not been adopted.

Ordenanza Num.2013- 13
Una ordenanza llamando una Eleccion de Desempate, para el
proposito de determinar un Miembro del Consejo Super Distrito 5,
para la Cuidad de Victoria, establecer procedimientos para celebrar
la eleccion ;
ciertos
designar los precintos y los lugares de votacion, nombrar
oficiales

eleccion; proporcionar

Mientras que, los resultados de la Eleccion que se llevo acabo el
11 de Mayo de 2013, para la posicion de Miembro del Consejo Super
Distrito 5, indican que ningun candidato en la carrera para esta posicion
recibieron a un la mayoria de todos los votos emitidos para la posicion;
Mientras que, el Consejo de la Cuidad descrube (1)la eleccion
debidamente fue llamada y aviso de eso fue dado, 2)
( la eleccion fue
celebrada

solamente los votantes de la Cuidad debidamente calificados, votaron en

Mientres que, Articulo VII, Seccion 2 del Estatuto de la Cuidad

numero de votos, con esta eleccion ser celebrada no antes de 20 dias ni

Por lo tanto, ya sea ordenado por el Consejo de la Cuidad de,Victoria, Texas :
1. De conformidad con las leyes del Estado de Texas y el Estatuto de la Cuidad
de Victoria, Texas, una eleccion de desempate en los precintos de votacion que aplican a
esta posicion, en la Cuidad de Victoria para el proposito de elegir un Miembro del
Consejo para Super Distrito 5, sera celebrada el 15 de Junio de 2013.

queda nombrado administrador y empleado de la votacion adelantada para esta eleccion.
El Administrador de Elecciones del Condado de Victoria realizara la eleccion, manejara
los detalles administrativos, proporcionara los rendimientos de la eleccion para que se
haga un escrutinio por el Consejo de la Cuidad, todo de conformidad con el Estatuto de la
Cuidad y la Constitucion y las leyes del Estado de Texas.
4. El uso de un sistema de grabacion electronica directa de votacion para el dia de
la eleccion y la votacion adelantada

persona,
queda autorizado.
El
uso
de boletas de

5. Kathy Salyer es nombrada Juez Presidente de la Junta de Votacion para hacer

6. El Alcade queda autorizado y dirigido a emitir una Orden de Eleccion y un
Anuncio de Eleccion, que sera publicado y colocado, todo de conformidad con la ley
estatal.
Con la aprobacion y firma de esta ordenanza, el Alcalde de la Cuidad de

Victoria, oficialmente confirma su accion que todas materias recitadas en esta ordenanza
que pueden, por ley, quedar dentro de su jurisdiccion.
8. Si alguna porcion de esta ordenanza o la aplicacion de cualquier persona o
circunstancia sera considerada invalida o inconstitucional por un Tribunal de jurisdiccion
competente, las restantes disposiciones del presente, sin embargo son validas, el mismo
que si la porcion or porciones consideradas invalidas o inconstitucional no habian sido
aprobadas.
Con el fin de cumplir los plazos establecidos por las leyes, se declara un

requisito
del Articulo II,
9 del Estatuto de la Cuidad, que ninguna

ordenanza sera oprobada finalmente en la fecha de su primera lectura, queda suspendida,
y esta ordenanza se hara efectiva inmediatamente sobre la adopcion.
