do hereby grant to RUO PATENTES Y MARCAS and/or ALESSANDRO RUO a
full and sufficient Power of Attorney to apply , jointly or separately, before the
national Bureaux and Authorities, for the recordal of domain names, sanitary
registrations, application and issuance of patents and trademarks of all kinds,
registrations and/or renewals of trademarks and service marks, industrial designs,
utility models, plant breeder rights, trade names and slogans, to file defenses and
oppositions against applications from third parties and all industrial property matter
and Copyrights in Peru, and with consumers protection, advertising, unfair
competition and free competition issues, licenses and assignments, being empowered
to take all necessary steps before the said authorities for the objects stated above,
including, without limiting to, prepare and file applications and descriptions, pay
taxes, order the publications, made declarations, prove exploitations, receive and file
documents and evidences, receive notifications, file and reply reconsiderations,
appeals and objections, lodge oppositions, request certified copies, withdraw
applications, voluntarily renounce to registered Industrial Property rights, apply for
cancellation or nullity of Industrial Property rights in the name of third parties, to
request recordal of licenses, assignments, mergers, changes of name and any
agreement which would modify the records of a particular registration, to accept
assignments of Industrial Property rights that third parties perform on our behalf; to
celebrate transactional agreements; including arbitration clauses; to prepare and file
actions of unfair competition and of Violation and/or Infringements of Industrial
Property rights and Copyrights, including violations of the Advertising Legislation
and Consumer Protection before the appropriate Authorities with all the faculties
required for the corresponding proceeding, including the request of inspections, to
appoint and accept the appointment of examiners, to conduct preparatory proceedings,
to answer infringement and unfair competition actions filed by third parties against
our company, with full power of representation; to attend conciliation hearings;
celebrate transactional and/or conciliation agreements, produce proofs, absolve
interrogatory documents and to defend petitions for cancellation or nullity of
registrations. Likewise they are empowered to appeal, apply for and file statements
with faculty for celebrating transactions and/or conciliations. They are also
empowered to file and reply civil and/or penal actions, including impugnation actions
of administrative resolutions, in the judicial channel, and to defend actions initiated
against our company, with all such powers as may be required including to make
arrangements, submit to arbitrators, request declarations and testimonies, to desist and
to appeal, with special powers as stated in Articles 74 and 75 of the Civil Procedure
Code, to file actions before the Penal Courts for violation of Industrial and Intellectual
Property committed by third parties against rights of our company, to appear before
the Courts, to appeal and celebrate transactional and/or conciliation agreements.
Likewise, they are empowered to receive and/or make payments either in cash or by
cheque or any other negotiable instrument, and collect certificates of judicial deposit.
This document expressly ratifies the validity of all applications, acts or petitions that
the above-mentioned persons had conducted in our name in respect to any Industrial
Property matter and or Copyrights which has been effected before the issuance and
signature of this document. The agents will also enjoy the faculties to substitute this
power if they think proper and revoke such substitution if necessary.

poder suficiente amplio y bastante para recabar conjunta o separadamente, de
las Oficinas y Autoridades nacionales que corresponda, la obtención de registro
de nombres de dominio, registros sanitarios, patentes de invención y marcas de
todo tipo, registros y/o renovaciones de marcas de producto y de servicio, diseños
industriales, modelos de utilidad, variedades vegetales, nombres y lemas
comerciales, presentar defensas u oposiciones a solicitudes de terceros y todo
otro asunto de Propiedad Industrial y Derechos de Autor en el Perú, y asuntos de
defensa del consumidor, publicidad, competencia desleal, libre competencia,
licencias y cesiones, facultándoles de manera expresa para dar todos los pasos
necesarios ante dichas autoridades, preparar y presentar solicitudes, formular
descripciones, pagar impuestos, ordenar publicaciones y hacer declaraciones,
probar explotaciones, solicitar testimonios, recibir y presentar documentos y
pruebas, recibir notificaciones, formular y contestar reconsideraciones,
apelaciones, deducir oposiciones, solicitar copias certificadas, desistirse de
solicitudes, renunciar voluntariamente a derechos de Propiedad Intelectual
registrados, interponer recursos de cancelación o nulidad de derechos de
Propiedad Industrial de propiedad de terceros, inscribir licencias, transferencias,
fusiones, cambios de nombre y todo acto modificatorio de registro, en particular,
aceptar transferencias de derechos de Propiedad Industrial que terceros hagan
en favor del poderdante, celebrar convenios transaccionales; incluyendo
cláusulas de sometimiento a arbitraje; preparar e interponer acciones por
competencia desleal y por Violación y/o infracción de los derechos de Propiedad
Industrial y Derechos de Autor, incluyendo violaciones de las Normas de
Publicidad Comercial y de Protección al Consumidor ante las autoridades que
correspondan, con todas las facultades requeridas para el trámite
correspondiente, incluyendo la de solicitar inspecciones, nombrar y aceptar el
nombramiento de peritos, conducir diligencias preparatorias, contestar acciones
de infracción y competencia desleal formuladas por terceros contra el poderdante,
con plenas facultades de representación, concurrir a audiencias de conciliación,
celebrar convenios transaccionales y/o conciliación, actuar pruebas contestar
pliegos interrogatorios y defender acciones de cancelación o nulidad. Quedan
igualmente facultados para apelar, solicitar y presentar declaraciones con facultad
para celebrar transacciones y/o conciliaciones y asimismo, quedan facultados
para interponer y contestar acciones civiles y/o penales, incluyendo acciones de
impugnación de resoluciones administrativas en la vía judicial, para defender las
acciones interpuestas contra la poderdante, con todas las mencionadas
facultades que puedan requerirse incluyendo hacer convenios, someter a
arbitraje; solicitar y presentar declaraciones y confesiones, desistirse y apelar,
con las facultades especiales que se establecen en los Artículos 74 y 75 del
Código Procesal Civil, presentar acciones ante el Fuero Penal por delito contra la
Propiedad Industrial y/o contra Derechos de Autor cometidos por terceros en
contra de los derechos de la poderdante, con facultades para comparecer ante
los Tribunales, apelar y celebrar convenios transaccionales y/o de conciliación.
De igual modo quedan facultados para recibir y/o efectuar pagos ya sea en
efectivo o mediante cheque o cualquier otro título o valor negociable, cobrar
certificados de consignación judicial. Este poder ratifica, de manera expresa, la
validez de todas las solicitudes, actos o pedidos que, a nuestro nombre, hubieren
realizado los apoderados en relación con algún asunto de Propiedad Industrial y/o
Derechos de Autor que se haya realizado antes de la expedición y firma de este
documento. Los apoderados gozan, finalmente, de facultades para sustituir el
presente poder si lo consideran conveniente y revocar tal sustitución de ser
necesario.
