Ordinance No. 2016- 15 An ordinance calling a runoff election to determine City Council Member District 1 for the City of Victoria, establishing procedures for holding this election, designating the precincts and polling places, appointing certain officers to conduct said election, providing for severability, declaring an emergency, and providing an effective date. Whereas the results of the Election held on July 23, 2016 for the position of City Council Member District 1 indicate that no candidate in the race for this position received a majority of all votes cast for the position; Whereas City Council finds ( 1) this election was duly called and notice thereof duly given, ( 2) this election was held under and in strict conformity with applicable laws, ( 3) only duly qualified voters of the City voted in this election, and ( 4) due returns of this election was made by the proper officers; and was Whereas Article VII, Section 2 of the Victoria City Charter requires that a runoff election to fill this position be held between the two candidates who received the highest number of votes, with this election being held not earlier than the 20th or later than the day after the date the final canvass of the main election is completed; 45th Now therefore, be it ordained by the City Council of the City of Victoria: In accordance with the laws of the State of Texas and the Charter of the City of Victoria, Texas a runoff election in the voting precinct that applies to this position, in the City of Victoria for the 1. purpose of electing City Council Member District 1, shall be held on August 27, 2016. 2. Exhibit " A" This election shall be conducted and held at the applicable precincts as depicted in attached, and at the respective polling places as designated in Exhibit " B," and the persons listed on the attached Exhibit " B" are hereby appointed officers to conduct this election at the respective applicable election precincts and polling places listed in the attached Exhibit " B" that are located in the territorial limits of the City of Victoria, Texas. The Victoria County Elections Administrator, George Matthews, is hereby appointed administrator and early voting clerk for this election. The Victoria County Elections Administrator will 3. conduct the election, handle the administrative details, and provide the returns of the city election for canvassing by the City Council, all in accordance with the City Charter and the Constitution and laws of the State of Texas. 4. The use of a direct recording entry voting system for election day and early voting in person is hereby authorized. The use of optically scanned paper ballots for early voting by mail is further authorized. 5. Sally Rubio is appointed Presiding Judge of the Early Voting Ballot Board for canvassing the early voting ballots for this election. 6. The Mayor is hereby authorized and directed to issue an Order of Election and a Notice of Election, which shall be published and posted in accordance with state law. 7. By approving and signing this ordinance, the Mayor of the City of Victoria officially confirms as his action all matters recited in this ordinance which may, by law, come within his jurisdiction. 8. If any portion of this ordinance, or the application thereof to any person or circumstances, shall be held invalid or unconstitutional by a Court of competent jurisdiction, the remaining provisions Page 1 of 2 hereof shall nevertheless be valid, the same as if the portion or portions held invalid or unconstitutional had not been adopted. 9. Considerando que los resultados de las elecciones celebradas el 23 de julio de 2016 para elegir un Concejal del Distrito 1 indicaron que ningun candidato en la contienda para dicho cargo recibio una mayoria de los votos sufragados para el cargo. Considerando fueron debidamente se realizaron en que el convocadas estricta Concejo Municipal determina y se dio conformidad aviso con de ellas las leyes que ( 1) estas elecciones debidamente, ( 2) estas elecciones aplicables, ( 3) solo los electores debidamente calificados de la ciudad votaron en estas elecciones, y ( 4) los resultados de estas elecciones fueron determinados por los funcionarios apropiados; y Considerando que el Articulo VII, Seccion 2, del Fuero municipal de la ciudad de Victoria requiere que para Ilenar el cargo vacante se celebren unas elecciones de segunda vuelta entre los dos candidatos que recibieron el mayor numero de votos, y que dichas elecciones se celebren no antes del vigesimo ( 20) dia ni despues del cuadragesimo quinto( 45) dia posterior a la fecha en que se completa el escrutinio final de las elecciones principales; Ahora, por lo tanto, el Concejo Municipal de la ciudad de Victoria, Texas, ordena que: 1. Segun las leyes del estado de Texas y el Fuero de la ciudad de Victoria, Texas, se lleven a cabo en la ciudad de Victoria unas elecciones de segunda vuelta en los distritos electorales que corresponden a este cargo, con el fin de elegir un Concejal del Distrito 1, el 27 de agosto de 2016. 2. Estas elecciones se celebraran en los distritos electorales aplicables senalados en el Anexo " A" y en los respectivos sitios de votacion senalados en el Anexo " B", y las personas enumeradas en el Anexo " B" son nombradas funcionarios encargados de realizar estas elecciones en los distritos electorales aplicables y en los lugares de votacion senalados en el Anexo " B", que se encuentran ubicados en los limites territoriales de la ciudad de Victoria, Texas. 3. El Administrador Electoral del Condado de Victoria, George Matthews, por este medio es nombrado Administrador y Secretario de Votacion Anticipada para estas elecciones. El Administrador Electoral del Condado de Victoria realizara las elecciones, manejara los detalles administrativos y proveera los votos emitidos en las elecciones de la Ciudad para el escrutinio por parte del Concejo Municipal, todo conforme al Fuero de la Ciudad, a la Constitucion de la Ciudad y a las leyes del estado de Texas. 4. Se autoriza por medio de la presente el uso de un sistema de votacion de grabacion directa para el dia de las elecciones y para la votacion anticipada en persona. Ademas esta autorizado el uso de boletas de votacion opticamente escaneadas para la votacion anticipada por correo. 5. Sally Rubio es nombrada Juez Presidente de la Junta de Boletas de Votacion Anticipada para el escrutinio de las boletas de votos anticipados en las elecciones. 6. El Alcalde queda autorizado y obligado a emitir una Orden de elecciones y un Aviso de las elecciones, que debera ser publicado de conformidad con la ley estatal. Pagina 1 de 2 Al aprobar y firmar esta ordenanza, el Alcalde de la ciudad de Victoria confirma oficialmente como acciones propias los asuntos mencionados en esta ordenanza que por ley pueden estar 7. dentro de su jurisdiccion. Si cualquier parte de esta ordenanza, o la aplicacion de la misma a cualquier persona o 8. circunstancia, se considera inconstitucional por un tribunal de jurisdiccion competente, las restantes disposiciones de la Ordenanza, no obstante, seran validas, to mismo que si la parte o partes consideradas inconstitucionales no se han aprobado. A fin de que los resultados de estas elecciones se declaren oficiales dentro del plazo 9. ley, se declara una emergencia, y se suspende el requisito del Articulo II § 9 del Fuero de la ciudad, que dice que ninguna ordenanza se aprobara en la fecha de su primera lectura, y esta ordenanza requerido por la entrara en vigencia inmediatamente despues de ser adopatada.
