This process followed the procedure for endorsement of the international generic criteria as a National Interpretation in small producing countries set out in the Annex 1a of RSPO Certification Systems. This document states that: In smaller producing countries the necessary elements for participation of a multistakeholder working group may be absent and a country can elect to adopt the International RSPO Criteria in its entirety providing certain requirements are met (…) 2.1 The total output CPO production of the country must not exceed 5% of Global CPO production. 2.2 A complete listing of applicable local, national, international laws, conventions and treaties be complied. To be known as the “Laws, Conventions and Treaties” applicable to the sustainable production and use of Palm Oil of {country} (LCT for NI of {country}). 2.3 The applicable guidance for smallholders is also adopted 2.4 A draft national interpretation (comprising of the International RSPO Criteria, the appropriate smallholder guidance and the completed LCT for NIs are submitted to RSPO for formal endorsement (section 5). 2.5 All documents must be in English and the local language 2.6 There is no conflict with RSPO P&C and the national law The total production of CPO in Honduras is around 430 000 MT, which is equivalent to around 0.007% of the global CPO production1. Therefore, it is considered a ‘small producing country’, where the process of adoption of the International RSPO Criteria in its entirety as a National Interpretation could be carried out. The process was facilitated by Proforest Initiative as a part of the Central American Sustainable Palm Oil Value Chain Project. This project is funded by the Farmer Support Programme (FSP), a consortium of Honduran oil palm companies and Henkel. The project is implemented by WWF Mesoamerican Reef2, SNV, Solidaridad Network2, Proforest Initiative2 and the Honduran Ministry for Agriculture, as well as by the palm oil producer companies Agroindustrial Palma Real S.A. de C.V2, Aceites y Derivados Sociedad Anonima (Aceydesa) 2, Centralamerican Palm (PALCASA2, Coapalma Ecara2, Cooperativa De Producción Agropecuaria De Campesinos Salamá Limitada2 Grupo Jaremar2, Hondupalma2, Palmeros de Aguan S. A. (PALMASA) 2 and the producer organization FENAPALMAH. The process of the of the adoption of the international RSPO Criteria in its entirety as a National Interpretation included the convening of a multistakeholder Technical Committee to support the development of the work. The process also included a public consultation period of 82 days, which included a call for comments that was sent to stakeholders via e-mail and published in two national newspapers, as well as three public meetings in different cities of Honduras. As a part of the process the following documents were developed: 1. 2. Adoption of the international RSPO Criteria in its entirety as a National Interpretation – The Republic of Honduras, this document includes the following: • RSPO Principles and Criteria for the Production of Sustainable Palm Oil 2013 • RSPO Principles and Criteria for Sustainable, Palm Oil Production, Guidance on Scheme Smallholders (2009) • RSPO Principles and Criteria for Sustainable Palm Oil Production, Guidance for Independent Smallholders under Group Certification (2010) • List of national and international laws, conventions and treaties applicable to the sustainable production and use of palm oil in Honduras • Definitions of smallholders in Honduras, developed as a part of the national interpretation process Proposal for adapting the RSPO group certification system in Honduras, this document outlines a proposal for adapting the RSPO group certification system to the Honduran context. It was developed in response to the identification of likely challenges to the application of RSPO systems in Honduras, particularly for certain groups of smallholder producers. Process and timeline The process of the Adoption of the international RSPO Criteria in its entirety as a National Interpretation of the Republic of Honduras is outlined in the following table. The process was initiated in February 2013 at a meeting of the Central American Sustainable Palm Oil Value Chain Project consortium partners. After this, the draft documents were developed (see Section 3) and the technical committee was convened. The first meeting of the technical committee was held, followed by a period of revision of the documents by the Technical committee and Proforest. The new draft documents were revised in the second meeting of the Technical Committee. Following this meeting, the documents were revised again and the changes in the RSPO International P&C were incorporated in the NI document before initiating the public consultation period on the 1st of July, 2013. The public consultation period lasted a total of 83 days and included three meetings in different cities of Honduras. After the end of the consultation period, all of the comments were compiled and the draft documents were revised. A final revision of the documents was initiated in the 3rd meeting of the technical committee. After this, an analysis of national and international laws was carried out, to compile a list of relevant laws. No conflicts between the national laws and the RSPO Principles and Criteria were identified in this analysis. This list, together with the RSPO international P&C, RSPO Principles and Criteria for Sustainable Palm Oil Production, RSPO Principles and Criteria for Sustainable, Palm Oil Production, Guidance on Scheme Smallholders and Guidance for Independent Smallholders under Group Certification were included in a first draft of the national interpretation documents. Simultaneously, Proforest carried out research and interviews with various stakeholders on the models of smallholder production that exist in Honduras to understand how RSPO certification models could be applied in the context of the country. This research was used to develop a first proposal for the adaptation of group certification for Honduras. Therefore, Honduran stakeholders were invited to form part of the multistakeholder Technical Committee that would support the development of the National Interpretation. For this purpose, partners of the Central American Sustainable Palm Oil Value Chain Project were invited to nominate a representatives a large producer company, social sector enterprise and smallholder producer organization to form part of the committee. Representatives of social and environmental NGOs, auditing organizations and representatives of the agricultural and environmental ministries were also invited to form part of the committee. The final composition of the Technical Committee is shown in the Annex 1. The first meeting of the Technical committee was held in the city of La Ceiba. The agenda and participant lists of this meeting are included in Annex 2. At the start of the meeting some training on RSPO standards the National interpretation process were given. There were technical sessions to review and discuss the draft National Interpretation document, smallholder definitions and the proposal for group certification. The committee members volunteered to revise and send comments on the documents within the following two weeks of the meeting. After having received the comments from the technical committee meeting, Proforest, as the technical lead, revised the draft National Interpretation and the proposal for adaptation of group certification in Honduras. The revised documents were then reviewed and discussed in the second meeting of the Technical Committee. It was agreed that Proforest would make final adjustments to the documents and incorporate the new revisions of the RSPO P&C (approved in April 2013) before the start of the public consultation period. The start of the public consultation period was delayed by 1 month from the planned start date due to a delay in receiving the Spanish translation of the newly approved P&C from RSPO. Public consultation period The public consultation on the Adoption of the International RSPO Criteria in its Entirety as a National Interpretation – The Republic of Honduras and Proposal for Adapting the RSPO Group Certification System in Honduras was initiated on the 1st of July, 2013. The documents were made available in both Spanish and English, sent to RSPO prior to public notification and displayed on the RSPO website. As a part of the public consultation the draft documents and a comments form were sent to the members of the technical committee, the partners of the Central American Sustainable Palm Oil Value Chain Project and a list of 52 stakeholders. All of the documents and the comments form were also made available in Spanish on two web sites. The list of stakeholders contacted as a part of the public consultation process is listed in Annex 3. The documents were displayed on the website of WWF Mesoamerican Reef3, Proforest4 and Centro Nacional de Producción Más Limpia de Honduras5. This newspaper announcement is included in Annex 4. As a part of the public consultation process, three public meetings were held: 1. 2. 3. 23rd or July in the city of Tocoa 5th of July in the city of Tela 17th of September in the city of Tegucigalpa. The agenda and list of participants of these meetings are included in Annex 5. These meetings counted with a wide participation of different actors from the environmental, social and palm sectors as well as from central and regional governments. At each meeting a series of presentations were given to help set the context of the work and help provide basic information the participants on RSPO. These presentations covered: • • • • • an introduction to RSPO and to the International Criteria an introduction to National Interpretations and the NI for SPC in particular Overview of the NI for Honduras process including Technical committee formation, draft development, inclusion of laws and public consultation process. Overview of the content of the National Interpretation for SPC Overview of the proposal for group certification Participants were given the opportunity to ask questions and clarification. Subsequently group sessions were organized, where participants could discuss different sections of the national Interpretation (i.e. Different Principles and Criteria and the associated list of laws), or the group certification proposal. Groups were provided with copies of the NI for SPC for Honduras, the comments forms and the group proposal. Group facilitators helped to record comments made in the groups. Additionally participants were encouraged to submit individual comments, either at that time, or subsequently. Some comments were also received via e-mail. After the public consultation period, the comments were compiled. The compiled comments from the public consultation period are included in Annex 6. Finalization of the drafts for submission The comments from the public consultation were reviewed and taken into account in the final revision of the documents. The comments and revised draft documents were reviewed and discussed in the 3rd meeting of the Technical Committee on the 28th of October in the city of San Pedro Sula. The agenda and participant list of this meeting are included in the Annex 2. Final amendments were proposed to the National Interpretation document, the smallholder definitions and the proposal for group certification. These amendments were incorporated as a part of the final revision of the documents in November 2013.
