1 Decision of the Council concerning the Mutual Acceptance of Data in
the Assessment of Chemicals
Esto implica que los datos y resultados de ensayos de laboratorios para el análisis de
riesgo de sustancias químicas peligrosas sea aceptado como valido en los países
integrantes. Esto es de gran incidencia ya que permite el uso de datos e información de
otros países miembro, en esta materia. En general estos análisis son bastante
cartesianos y bien definidos por metodologías estándar. A pesar del riesgo de
encarecer estos análisis por la vía de seguir métodos analíticos más avanzados o usar
equipamiento más sofisticado, parece ser un gran beneficio el usar datos de países
OCDE, que están bastante avanzados en esta materia, sin necesidad de repetirlos acá.
ACTO C(81)30/Final 1. DECIDES that data generated in the testing of chemicals in an OECD Member country in accordance with OECD Test Guidelines and OECD Principles of Good Laboratory Practice shall be accepted in other Member countries for purposes of assessment and other uses relating to the protection of man and the environment. 2. DECIDES that for the purposes of this Decision and other Council actions the terms OECD Test Guidelines and OECD Principles of Good Laboratory Practice shall mean guidelines and principles adopted by the Council. 3. INSTRUCTS the Environment Committee to review action taken by Member countries in pursuance of this Decision and to report periodically thereon to the Council. 4. INSTRUCTS the Environment Committee to pursue a programme of work designed to facilitate implementation of this Decision with a view to establishing further agreement on assessment and control of chemicals within Member countries. 2 Decision of the Council concerning the Adherence of non-Member
Countries to the Council Acts related to the Mutual Acceptance of
Data in the Assessment of Chemicals [C(81)30(Final) and

Las mismas indicaciones de la decisión a anterior pero extendidas a países no
miembros de la OCDE, que adhiriendo a este acto, deben adherir a las obligaciones
químicas de los países miembros.
C(97)114/FINAL I. DECIDES: 1. To open the OECD Council Acts related to the mutual acceptance of data in the assessment of chemicals* to adherence by non‐member countries which express their willingness and demonstrate their ability to participate therein; 2. That non‐member countries adhering to the Council Acts shall be entitled to join the part of the OECD Chemicals Programme involving the mutual acceptance of data, with the same rights and obligations as Member countries; 3. That adherence to the Council Acts and participation in the part of the OECD Chemicals Programme related to the mutual acceptance of data shall be governed by the procedure set out in the Annex to this Decision, of which it forms an integral part. II. RECOMMENDS that Member countries, with a view to facilitating the extension of the Council Acts to non‐member countries, take or pursue all available means to ensure the most effective OBSERVACIONES A LOS ACTOS QUÍMICOS DE LA OCDE Asociación Gremial de Industriales Químicos de Chile A.G. implementation of the Council Acts. Pending this effective implementation of the Council Acts by non‐members, Member countries shall be free to establish mutual acceptance of data with non‐member countries on a bilateral basis. III. INSTRUCTS the Management Committee of the Special Programme on the Control of Chemicals to assume responsibility for promoting international awareness of the Council Acts, with a view to informing, advising and otherwise encouraging non‐member countries to participate in the programmes and activities that have been established by OECD countries pursuant to these Council Acts. Further, the Management Committee should monitor closely the technical aspects of implementation of the procedure set out in the Annex, review the implementation of this Decision, and report thereon to Council within three years. 3 Decision of the Council concerning the Minimum Pre-Marketing Set
of Data in the Assessment of Chemicals
Establece que los países miembro, deben manejar un set mínimo de datos (de las
propiedades que permitan evaluar el riesgo) antes de comercializar un nuevo producto
químico. Esto puede impactar más que nada a los productos tóxicos o eco tóxicos, de
los cuales hay bastante legislación en chile o vinculante por acuerdos, como el de
Rotterdam (firmado por Chile). Por otro lado los datos indicados en esta decisión
(como Nombre, N° CAS, Formulación, pureza, Usos, Producción, Métodos de
disposición, Transporte, Medidas de Emergencia, Métodos de Análisis, Datos
Fisicoquímicos, Toxicidades, Irritabilidad, etc.) son ya requeridos en la Hoja de
Seguridad del Producto, en la NCh 2245. Cuando no hay datos, de acuerdo a las
decisiones 1 y 2 de este documento, se pueden usar datos de otros países. Para algunos
productos que no tengan esta información y se deban hacer los análisis, estos pueden
llegar a ser de un costo no menor y de largo aliento, sin embargo pareciera que esta
acotado a nuevos productos.

1. DECIDES that in Member countries sufficient information on the properties of new chemicals
should be available before they are marketed to ensure that a meaningful assessment of hazard to man
and the environment can be carried out.
2. NOTES that some chemicals, owing to their intended use, may already be subject to specific
legislation in a Member country, and insofar as this intended use is concerned are not subject to this
Decision.
3. NOTES that legislation or administrative procedures in a Member country may provide for
exemptions because of the nature of a chemical or the quantity manufactured.
4. INSTRUCTS the Environment Committee to pursue a programme of work designed to lead to the
development of an overall approach to step sequence testing of chemicals.
5. INSTRUCTS the Environment Committee to continue related work aimed at the harmonization of
hazard assessment and the study of notification procedures associated with assessment of chemicals.
PART II
To implement the Decision set forth in Part I:
RECOMMENDS that the minimum pre-marketing set of data (MPD) together with its provisions for
flexible application set forth as integral parts of this text in the Annex hereto can serve as a basis for a
meaningful first assessment of the potential hazard of a chemical to health and the environment.

Accidents Capable of Causing Transfrontier Damage
Probablemente, esta es una de las decisiones vinculantes de menos impacto, dado la
situación geográfica de Chile, donde no hay otro país miembro cerca. Esta además
acotado a 20 sustancias, de las cuales manejamos algunas, pero que no incidirían en
accidentes transfronterizos ni siquiera con países limítrofes (salvo casos
estadísticamente poco probables)
C(88)84/Final DECIDES:
1. Member Countries concerned shall exchange information and consult one another, on a reciprocal
basis if so desired, with the objective of preventing accidents capable of causing transfrontier damage
and reducing damage should such an accident occur.
2. Member countries shall take all necessary practical steps to implement, on a reciprocal basis if so
desired, the provisions set out in Appendix I to this Decision, which is an integral part of this
Decision, including, as need be, to conclude arrangements or agreements aimed at specifying
procedures for exchanging information relating to accidents capable of causing transfrontier damage.
3. Definitions of terms used in this Decision are given in Appendix II, which is integral part of this
Decision.
4. The Environment Committee will examine, within three years, actions taken by Member countries
pursuant to this Decision.
5. The Environment Committee will review Appendix III, which is an integral part of this Decision,
within three years and will propose, as need be, a revised minimum list for the identification of
hazardous installations.
