MINISTERIO DE ASUNTOS EXTERIORES Y DE COOPERACIÓN CONSULADO GENERAL DE ESPAÑA EN SAN FRANCISCO NUMERO DE IDENTIFICACIÓN FISCAL (NIF) PARA ESPAÑOLES EN EL EXTRANJERO Y ENTIDADES JURÍDICAS EXTRANJERAS (For English, see below) (Actualizado a 04/06/15) Con carácter general, el Número de Identificación Fiscal (NIF) de las personas físicas de nacionalidad española es el número de su Documento Nacional de Identidad seguido por el código de verificación (DNI) y para los que carezcan de nacionalidad española es el Número de Identidad de Extranjero (NIE). Ambos documentos (DNI y NIE), son tramitados por el Ministerio del Interior. Los obligados tributarios deberán incluir su Número de Identificación Fiscal en todas las autoliquidaciones, declaraciones, comunicaciones o escritos que presenten ante la Administración tributaria. En caso de no disponer de dicho número deberán solicitar la asignación del mismo. Hay cuatro supuestos en los que se puede solicitar directamente el NIF que tramita la AEAT, en lugar del DNINIE que tramita el Ministerio del Interior (en los dos primeros supuestos opcionalmente, en los otros dos obligatoriamente): - Españoles menores de catorce años. Españoles mayores de dicha edad que por residir habitualmente en el extranjero no tengan un DNI en vigor. Ciudadanos extranjeros que no puedan solicitar el NIE. Entidades jurídicas, españolas o extranjeras (en este caso, el NIF que se asigne será el definitivo). Para solicitar el NIF, será necesario: 1.- Solicitante persona física: a) Aportar el pasaporte en vigor o documento de identidad equivalente al DNI español. b) Aportar un documento que acredite la residencia en esta demarcación consular. Si el solicitante es de nacionalidad española deberá constar de alta en el Registro de Matrícula Consular (información en nuestra Web). c) Tarjeta del número de la seguridad social asignada por la Administración de los EE.UU. d) Si se presenta a través de representante, poder notarial de representación a favor del compareciente, con la Apostilla de la Haya si no está formalizado en España, así como NIF del representante. 2.- Solicitante persona jurídica: a) Certificación de la autoridad registral o fiscal correspondiente, con la Apostilla de la Haya si no proviene de España, que acredite la existencia de la entidad y los siguientes extremos: - Si dispone o no de personalidad jurídica - Denominación o razón social - Domicilio fiscal - Nacionalidad - Fecha de constitución y fecha de inscripción en el registro público correspondiente. - Capital social de constitución, en su caso - Representantes: o Nombre y NIF de los representantes en el extranjero o Nombre, NIF, domicilio y nacionalidad de los representantes en España, en su caso - En caso de entidades en régimen de atribución de rentas (sin personalidad jurídica), nombre, NIF, domicilio y nacionalidad de los socios, herederos o partícipes. b) Respecto de la persona física que firma la solicitud como representante de la entidad, se aportará: - Tarjeta o documento acreditativo del NIF. - Documento que acredite su representación, con la Apostilla de la Haya si no está formalizado en España. Será suficiente la certificación indicada en el punto 2.a), si consta la representación de este último. For Non-Spanish citizens, is the Foreigner Identification Number (NIE). Both documents, (DNI and NIE) are issued by the Spanish Ministry of Interior. Taxpayers must include the NIF in every document that has any implication for the Spanish taxation system (tax returns, bank accounts, contracts, deeds, etc.). If you do not have NIF, you must apply for it. There are four cases in which it is possible to apply for a NIF directly with the AEAT (Spanish Tax Agency), instead of applying for a DNI/NIE with the Ministry of Interior: - For Spanish citizens under 14 years old. - For Spanish adults with residence abroad or temporary in Spain for a period no longer than 6 months, with no valid DNI in force. - Foreigner individuals not allowed to apply for a NIE. - Foreigner or Spanish companies (the NIF assigned will not be temporary, as in the cases above) Those persons living abroad that have not a DNI/NIE in force can apply at this consulate General for a TEMPORARY NIF (cases 1st to 3rd) or a DEFINITIVE NIF (case 4th) in order to be able to perform the operations that so require. NIF application requirements: 1.- For individuals: a) Show your passport in force or other ID equivalent to the Spanish DNI. b) Show proof that you residence within this consular jurisdiction (see our Website). Spanish applicant must be registered in our Consular Registry (see our Website). c) Show your USA Social Security card. d) If the person is applying through a representative, Power of Attorney will be required, with the Apostille of the Hague if the document is not issued by an Spanish Notary. Representative NIF will be also required. 2.- For companies: a) Certificate from the registry of companies or fiscal/revenue authority, with the Apostille if the document is not issued in Spain, stating the following: - That the company is legally a corporation - Legal name of the company - Legal address of the company - Nationality of the company - Date of formation and registration - Company´s legal funds, if required by law - Company´s representatives: o - b) Name and NIF of the representatives abroad o Name, NIF, address and citizenship of the representatives in Spain, if any If the company has not legal status as a collective entity, name, NIF, address and citizenship of all members will be required. The person that signs the NIF application as the company´s representative, will be required to provide: - ID card or any document stating his/her NIF - Power of Attorney with the Apostille of the Hague if the document is not coming form an Spanish Notary. Will be enough the document specified in point 2.a above, if the document already certifies this representation. Once the documents presented and verified by this office, the NIF will be issued, and afterwards the 036 form will be electronically submitted (communication of representation and members of the company).
