In these days of economic recession it´s not uncommon to find companies which can´t
face their own duties, this is why a new method to solve this problem has come across
(either by eliminating or intervening it) called creditor process, ruled by the bankruptcy
law. As a general rule, the creditor´s activity must continue.

The judge of this process who is in charge of naming the creditor´s process
administrators, who are capable of representing the creditor during the process. One of
the tasks of the administration is to elaborate the passive mass which integrates the
creditors that can take part in the liquidation and in the distribution of the actives.
According to the effects which this producers in the contracts, the law establishes the
principle of validation for each. In these contracts with duties, if the creditor who has
fulfilled with all his obligations is the part not processed, a debit will be created for the
company which is being processed. If the person who has fulfilled his obligations is the
own creditor, these will be a credit in his favor which will be integrated in his active
mass. The creditor or the administrators must evaluate the validity of the resolution of
the contracts, depending on the interest of the process.

En estos tiempos de recesión económica es normal encontrarse con empresas que no pueden
responder a sus obligaciones, es por ello que ha surgido un procedimiento para intentar
solventar esta situación (ya sea bien liquidando la empresa o bien interviniéndola), llamado
concurso de acreedores, regulado por la Ley Concursal. Independientemente de encontrarse en
concurso, como regla general, la actividad del deudor debe continuar.
El juez del concurso es el encargado de nombrar a la administración concursal, la que está
capacitada para representar al deudor a lo largo del concurso. Una de las tareas de la
administración concursal es elaborar la masa pasiva, la cual integra los acreedores que pueden
participar en la liquidación y el reparto del activo del concursado.
Respecto a los efectos que produce en los contratos, la Ley Concursal establece el principio de
vigencia de los mismos. En los contratos con obligaciones recíprocas, si quien ha cumplido
íntegramente su prestación es la parte no concursada, se creará una deuda del concursado. Si
quien ha cumplido su prestación es el propio concursado, existirá un crédito a su favor, que se
integrará en su masa activa. El concursado o la administración concursal deben evaluar la
vigencia o la resolución de los contratos, según más satisfaga al interés del concurso.
