Student Data Privacy Act Annual Notification
Lyons USD 405 must make annual notice to parents/guardians of the provisions of the Student Data
Privacy Act K.S.A. 2013 Supp. 72-6214. The form must be signed and kept on file at the school.
(a) Any student data submitted to and maintained by a statewide longitudinal student data system shall
only be disclosed by an educational agency in accordance with the provisions of this section. An
educational agency shall provide annual written notice to each student’s parent or legal guardian that
student data may be disclosed in accordance with this section. Such notice shall be signed by the
student’s parent or legal guardian and maintained on file with the district.
(b) Student data may be disclosed at any time to:
(1) The authorized personnel of an educational agency who require such disclosures to perform their
assigned duties;
(2) the authorized personnel of the state board of regents who require such disclosures to perform their
assigned duties; and
(3) the student and the parent or legal guardian of the student, provided the student data pertains solely
to such student.
(c) Student data may be disclosed to the authorized personnel of any state agency not specified in
subsection (b), or to a service provider of a state agency, educational agency or school who is engaged
to perform a function of instruction, assessment or longitudinal reporting, provided there is a data-sharing
agreement between the educational agency and such other state agency or service provider that provides
the following:
(1) The purpose, scope and duration of the data-sharing agreement;
(2) that the recipient of the student data use such information solely for the purposes specified in the
agreement;
(3) that the recipient shall comply with data access, use and security restrictions that are specifically
described in the agreement; and
(4) that the student data shall be destroyed when no longer necessary for the purposes of the datasharing agreement or upon expiration of the data-sharing agreement, whichever occurs first. Except that
a service provider engaged to perform a function of instruction may retain student transcripts as required
by applicable laws and rules and regulations. Destruction shall comply with the NISTSP800-88 standards
of data destruction.

El Distrito de Lyons (USD 405) necesita hacer notificación anual a los padres/guardianes de las
provisiones del Acto (K.S.A. 72-6214) de la Privacidad del Estudiante. Este formulario debe ser firmado
y guardado en un archivo en la escuela.
(a) Cualquier dato enviado a y mantenido por un sistema de dato longitudinal estatal debe
solamente ser divulgado por una agencia educacional en acuerdo con las provisiones de esta
sección. Una agencia educacional debe proveer anualmente por escrito notificación a cada
padre o guardián legal cual los datos pudiera ser divulgada en acuerdo con esta sección. Tal
notificación debe ser firmada por los padres o guardián legal y archivado en el distrito.
(b) Datos del estudiante puede ser divulgada a cualquier momento a:
(1) El personal autorizado de una agencia educacional que requiere tales revelaciones para realizar
su deberes asignados;
(2) El personal autorizado de la junta estatal que requiere tales revelaciones para realizar su
deberes asignados;
(3) El estudiante y los padres o guardián legal del estudiante, provisto que los datos pertenece
solamente a tal estudiante;
(c) Los datos del estudiante puede ser divulgada al personal autorizado de cualquiera agencia
estatal cual no sea especificado en la sección (b), o a un proveedor de servicios de una agencia
estatal o escuela cual es encargado para ejecutar una función de instruir, valoración o reportar
longitudinal, previsto que haiga un acuerdo del intercambio de datos entre la agencia
educacional y la otra agencia estatal o el proveedor de servicios que proporciona la siguiente:
(1) El propósito, el alcance y la duración del acuerdo del intercambio de datos;
(2) El beneficiario del uso los datos del estudiante use tal información solamente para el propósito
especificado en el acuerdo;
(3) El beneficiario deberán cumplir con los acceso a datos; use y restricciones de seguridad cual son
especificados el en acuerdo; y
(4) Los datos del estudiante deban ser destruidos cuando no sean más necesitados con el acuerdo
del propósito del intercambio de datos o cuando se expira el acuerdo de intercambio de datos, lo
que ocurra primero. Excepto el proveedor de servicios realizar una función de instrucción pueda
retener las transcripciones del estudiante como requerido por las leyes aplicables y reglamentos
y regulaciones. Destrucción deberán cumplir con las normas NISTSP800-88 de la destrucción
de datos.
