ORDER CALLING TAX RATIFICATION ELECTION
WHEREAS the Board of Trustees of the El Paso Independent School District finds and
determines that it is necessary and advisable to call and hold an election within the El Paso
Independent School District ("the DISTRICT") on the proposition hereinafter set forth; and
WHEREAS the Board of Trustees finds and declares that the meeting at which this Order is
considered is open to the public, and that public notice of the time, place and purpose of the meeting
was given as required by Chapter 551, Texas Government Code, as amended:
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Board of Trustees of the
EL PASO INDEPENDENT SCHOOL DISTRICT:
(1)
That there be and there is hereby called to be held on June 15, 2010, during the hours
prescribed by law (7:00 a.m. to 7:00 p.m.), within the EL PASO INDEPENDENT SCHOOL
DISTRICT, a Tax Ratification Election (the "Election"), pursuant to Sections 26.05 and 26.08
of the Texas Tax Code, and other applicable provisions of the Texas Education, Election, and
Tax Codes.
(2)
That at the Election, the following proposition (the "Proposition") shall be submitted to the
qualified voters of the District in accordance with law:
Approving the ad valorem tax rate of $1.3650 per $100 valuation in the El Paso
Independent School District for the current year, a rate that is $.0912 higher per
$100 valuation than the school district rollback tax rate.

That the election precincts and polling places listed in Exhibit "A" hereto shall be used in the
Election. That all of the County election precincts listed therein are identified by the
number of the precinct assigned by the County of El Paso, and that, pursuant to Chapter 42,
subchapter C, of the Texas Election Code, for purposes of this Election, the precincts and
precinct numbers to be used for this Election are the same as indicated therein, with the
exception that certain of said County election precincts (or relevant portions thereof) shall be
consolidated, and re-numbered as El Paso Independent School District ("EPISD") election
precincts, as follows:

Furthermore, the El Paso Independent School District Board of Trustees finds that such
County election precincts (with the exception of 80 and 121-3) have previously been
consolidated and served by common polling places by the County of El Paso, and that said
common polling places for the said consolidated County election precincts (now EPISD
election precincts), can adequately and conveniently serve the affected voters and will
facilitate the orderly conduct of this Election. With regard to County election Precinct 121-3,
the Board finds, based on information provided by the County Elections Administrator, that
currently no registered voters reside therein; and that should any registered voters come to
reside in that area who would be eligible to vote in the Election, they can be adequately and
conveniently served by the polling place for Precinct 80, which is adjacent to Precinct 121-3.

That early voting by personal appearance shall take place at the main early voting polling
place, Lower Level, El Paso County Courthouse, 500 East San Antonio; the permanent
branch early voting polling places, Regency of El Paso, 221 Bartlett Dr.; Fiesta Shopping
Center No. A108, 5200 North Mesa Street; Rushfair Pointe Shopping Center No. 5113, 5111
Fairbanks; Sunrise Shopping Center No. 56, 8500 Dyer; Bassett Place Shopping Center No.
110, 6101 Gateway West; and also at such temporary branch early voting polling places,
referred to as "mobile voting" sites, as listed in Exhibit "B" hereto. Early voting by personal
appearance shall take place on the dates and during the hours required by law, during the
period commencing June 1 and ending June 11, 2010, as reflected by Exhibit “B” hereto.
Additionally, early voting ballots may be voted by mail, pursuant to Chapter 86 of the Texas
Election Code. Mail applications for an early voting ballot should be addressed to the Early
Voting Clerk, Javier Chacon, at the Office of the County Elections Administrator, 500 E.
San Antonio, Room 402, El Paso, Texas 79901. The deadline for receipt by the County
Elections Administrator of an application for an early voting ballot to be voted by mail shall
be June 8, 2010, as determined by Section 84.007 of the Texas Election Code. Late ballot
voting shall be conducted pursuant to Chapters 102 and 103 of the Texas Election Code.

That the Superintendent of the El Paso Independent School District, and designees, in
consultation with the Board President and District legal counsel as needed, are hereby
appointed to hold such Election, and are authorized and directed to take any and all actions
necessary to comply with the Texas Education, Election, and Tax Codes, and the Federal
Voting Rights Act, in conducting the Election; to provide all necessary facilities for the
holding and conduct thereof; and generally to care for and arrange all details of said
Election, including the selection, replacement and/or substitution of election personnel, to
the extent not specifically appointed herein, and subject to the Contract for Election Services
with the El Paso County Elections Department. The persons authorized to provide for and
conduct said Election are hereby instructed to make all necessary instructions therefor.

That ballots conforming to the requirements of the law of the State of Texas shall be
prepared, to permit voting FOR or AGAINST the Proposition as stated above. Said ballots
shall be provided by the persons above appointed to hold said Election and shall be
distributed in due time to the judges holding said Election, together with the necessary voter
registration lists showing voters qualified to vote within the voting precincts of the EL PASO
2
INDEPENDENT SCHOOL DISTRICT. All such resident, qualified voters of the District
shall be entitled to vote in the Election. The electronic or touch-screen voting system used
by the County of El Paso is hereby adopted by the District for use in the Election.
(7)
That qualified judges and clerks will be used in the Election. No employees of the EL PASO
INDEPENDENT SCHOOL DISTRICT may serve as an election official. A Central
Counting Station shall be used for the Election. Precinct judges, and certain other election
personnel, are appointed as stated on Exhibits "A," "B," and "C" attached hereto, and as
stated in the Contract with the El Paso County Elections Department.

The election materials enumerated in Chapter 272 of the Texas Election Code shall be printed
and furnished in both English and Spanish for use on Election Day and for early voting. A
sufficient number of election clerks who are fluent in both English and Spanish shall be
utilized in order to serve the needs of Spanish-speaking voters.

That Notice of the Election shall be posted on the bulletin board used for posting notices of
meetings of the Board of Trustees, not later than May 25, 2010, and shall remain posted
continuously through Election Day, pursuant to Tex. Election Code § 4.003. Notice of the
Election, including the location of each polling place and the hours the polls will be open,
shall also be published, not earlier than May 16, 2010, and not later than June 5, 2010, in a
newspaper published within the EL PASO INDEPENDENT SCHOOL DISTRICT, pursuant
to Tex. Election Code § 4.003. Notice of the Election shall be delivered to the County Clerk
of El Paso County, pursuant to Tex. Election Code § 4.008. A copy of this Election Order
shall also be provided to the United States Department of Justice, Civil Right Division,
Voting Section.
(10)
That said Election shall be held and returns thereof made to the Board of Trustees of the EL
PASO INDEPENDENT SCHOOL DISTRICT in accordance with the general election laws,
and that said Board of Trustees shall canvass such returns, and declare the result of such
Election based on the majority of the votes cast.

ORDEN PARA ELECCIÓN DE RATIFICACION DE IMPUESTOS
DEL DISTRITO ESCOLAR INDEPENDIENTE DE EL PASO
POR LO TANTO, SEA RESUELTO Y ORDENADO POR LA MESA DIRECTIVA DE
CONSEJEROS DE EL DISTRITO ESCOLAR INDEPENDIENTE DE EL PASO lo siguiente:
(1)
Es ordenado que se lleve a cabo el día 15 de junio del 2010, durante las horas prescritas por ley
(7:00 a.m. a 7:00 p.m.), dentro del Distrito Escolar Independiente de El Paso, una elección de
Ratificación de Impuestos (Elección), de acuerdo a las Secciones 26.05 y 26.08 del Código de
Impuestos de Texas, y otras provisiones aplicables del código de Educación, Electoral y de
Impuestos de Texas.
(2)
Que en la Elección, la siguiente proposición (la “Proposición”) será sometida a los votantes
calificados del Distrito de acuerdo a la ley:
Aprobando una tasa de impuestos de acuerdo al valor de $1.3650 por cada $100 de
valuación en el Distrito Escolar Independiente de El Paso para el presente año, una
tasa la cual es $.0912 más alta por cada $100 de valuación que la tasa de reducción de
impuestos del Distrito.
(3)
Que todos los precintos electorales del Condado citados en la Exhibición “A” aquí adjunta serán
utilizados en la Elección. Que todos los precintos electorales del Condado citados aquí adjunto
están identificados por número del precinto asignado por el Condado de El Paso, y que de
acuerdo al Capítulo 42, Subcapítulo C, del Código Electoral de Texas, para objeto de ésta
Elección los precintos y números de precintos que serán usados en ésta Elección son los mismos
como se indica aquí, con la excepción que algunos de los precintos nombrados (o porciones
relevantes) deberán ser consolidados, y re-numerados como precintos electorales del Distrito
Escolar Independiente de El Paso (“EPISD”) como se indica abajo:

Además la Mesa Directiva de Consejeros del Distrito Escolar Independiente de El Paso
encuentra que tales precintos electorales del Condado (con la excepción del precinto 80 y 121-3)
han sido previamente consolidados y han servido como lugares de votación común en el
Condado de El Paso, y que dichos lugares comunes para votar en dichos precintos consolidados
para la votación en el Condado (ahora precintos para votar en el EPISD), pueden suficientemente
y convenientemente servir a los votantes afectados y facilitará la conducta ordenada de ésta
Elección. Con respecto al precinto electoral del Condado numero 121-3, la Mesa Directiva
encuentra, basada en información proporcionada por el Administrador de Elecciones del
Condado, que ningún votante registrado reside en el área; y que si algún votante registrado, que
fuera elegible para votar en la Elección, residiera en el área, el/ella pudiera adecuadamente y
convenientemente ser servido(a) por el precinto 80, el cual se encuentra adjunto al precinto 1213.

Que la votación adelantada mediante acto de presencia se llevará a cabo en el lugar principal
para votar, en el nivel bajo, de la Corte del Condado de El Paso, 500 Este San Antonio; en los
lugares permanentes de votación adelantada, Centro Regency de El Paso, 221 Bartlett Dr.;
Centro Comercial Fiesta No. A108, 5200 N. Mesa St.; Centro Comercial Rushfair Pointe No.
5113, 5111 Fairbanks; Centro Comercial Sunrise No. 56, 8500 Dyer; Centro Comercial Bassett
Place No. 110, 6101 Gateway West, y también en otros sitios de votación adelantada/temporal,
referidos como los “sitios móviles para votar”, como se indica en la Exhibición “B”. La
votación adelantada mediante acto de presencia se llevará a cabo sobre las fechas y durante las
horas requeridas por ley, durante el período comenzando el 1º de junio y concluyendo el 11 de
junio del 2010, como reflejado en la Exhibición “B”. Adicionalmente las boletas para votar por
adelantado pueden ser enviadas por correo, de acuerdo al Capítulo 86 del Código Electoral de
Texas. Las aplicaciones enviadas por correo para votación adelantada deberán ser dirigidas a el
encargado de la votación adelantada, Javier Chacón, en la Oficina del Administrador de las
Elecciones del Condado, 500 E. San Antonio, Cuarto 115, El Paso, Texas 79901. El plazo
(fecha límite) de recibo por el Administrador de Elecciones de una aplicación para una boleta
adelantada por correspondencia será el 8 de junio del 2010, como es determinado por la Sección
84.007 del Código Electoral de Texas. La votación tardía por boleta se llevará a cabo de acuerdo
a los Capítulos 102 y 103 del Código Electoral de Texas.
