This work analyzes the shared custody with regard to children in the event of marriage
breakdown, which is one of the measures that must be agreed in these situations. It
studies the main issues about what happens with the exercise of parental authority and
custody in different contexts, always according to the criterion of the best interests of the
child. It also makes a concrete analysis on the figure of shared custody regulated in the
Civil Code and the most recent jurisprudence of the Supreme Court on this matter so
relevant today

En el presente trabajo se pretende analizar la guarda y custodia compartida respecto de
los hijos en caso de ruptura del matrimonio, que es una de las medidas que deben
acordarse en estas situaciones. Se plantean las principales cuestiones acerca de qué
sucede con el ejercicio de la patria potestad y la guarda y custodia en diferentes
contextos atendiendo siempre al criterio del interés superior del menor. También se
realiza un análisis concreto sobre la figura de la custodia compartida regulada en el
Código Civil y la jurisprudencia más reciente del Tribunal Supremo sobre esta cuestión
tan relevante en la actualidad.
