Information regarding the Morgan Hill Case and Student Privacy
A recent lawsuit filed against the California Department of Education (CDE) is impacting all school districts across
California. The lawsuit does NOT involve the Moorpark Unified School District.
In April, 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parents
Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies
with special education laws. The suit also alleges the CDE fails to monitor, investigate and correct such non-compliance
in accordance with the law. The CDE denies these allegations and is actively defending the litigation.
The Moorpark Unified School District is not involved in the lawsuit and is not subject to the suit's allegations. In
addition, the Moorpark Unified School District will NOT release any student data or information about students
regarding this matter.
Nonetheless, as part of this lawsuit, CDE has been ordered by the court to release all data it has collected on general and
Special Education students since January 1, 2008.

Unificado de Moorpark.
En abril de 2012, dos organizaciones, la Asociación de Padres Preocupados Morgan Hill (Morgan Hill Concerned Parents
Association) y la Asociación de Padres Preocupados (Concerned Parents Association), presentaron una demanda en
contra de CDE alegando incumplimiento sistemático general de parte de las agencias locales de educación con leyes de
educación especial. La demanda también alega que CDE no cumple con monitorear, investigar y corregir dicho
incumplimiento de acuerdo con la ley. CDE niega los alegatos y está defendiendo el litigio en forma activa.
El Distrito Escolar Unificado de Moorpark no está involucrado en la demanda ni está sujeto a los alegatos de la demanda.
Además, el Distrito Escolar Unificado de Moorpark NO hará pública ninguna información sobre estudiantes con
respecto a este asunto.
Sin embargo, como parte de esta demanda, el CDE ha sido ordenado por el juez a hacer pública toda la información
colectada desde el 1 de enero de 2008 de estudiantes en educación general y especial.
