PROTEST AGAINST THE UNLAWFUL FORCED EVICTIONS/KILLINGS OF CIVILIAN
RESIDENTS IN PORT HARCOURT BY RIVERS STATE GOVERNMENT OF NIGERIA:
We, a coalition of national and international human rights organizations working to attain a
universal right to adequate housing, hereby express our grave concern over the ongoing
unlawful forced evictions and killings of civilian residents in Port Harcourt by the Rivers
State Government and protest against the silence of the Government of Federal Republic
of Nigeria on the issue, expressing our full solidarity with the inhabitants and their
organizations
The evictions which, according to our local NGO sources, have resulted in unlawful
displacement affecting more than one third of Port Harcourt’s population and escalated to
the killing/maiming of innocent residents by the military, are carried out by the State
Governor, Mr. Chibuike Amaechi, not in the public interest, as provided by law, but to
pander to his ethnic prejudices and personal gain.
It is worth mentioning that the forced evictions, which have lasted for over one and a half
years and rendered hundreds of thousands of persons homeless and jobless in Port
Harcourt, are being undertaken by the State Governor in flagrant defiance of the due
process of law, the restraining orders of the competent courts, the moratorium sought by
the United Nations Human Settlements Programme (UN-HABITAT) and the wise counsel
of the Niger Delta Elders’ Forum, among others.
We further note that notwithstanding the protest letters by international human rights
organizations, the fact-finding mission conducted by UN-HABITAT, and the subsequent
meetings between UN-HABITAT and the Minister of Housing and Urban Development on
this issue, the Government of the Federal Republic of Nigeria has maintained a heavy
silence on the situation while the State Governor remains determined to proceed with the
unlawful forced evictions, even at the expense of the state’s resources.
We emphasize that the action of the State Governor and the federal government’s failure
to put a stop to the governor’s action as appropriate, as far as the unlawful forced evictions
in Port Harcourt are concerned, violates Nigeria’s commitment towards the Habitat
Agenda, and worse, violates international treaties and the is at odds with the jurisprudence
of the treaty bodies ratified by the Government of Nigeria, in particular the provisions of
article 11(1) of the International Covenant on Economic, Social and Cultural Rights and its
General Comments Nos. 4 and 7.
In view of the Federal Government’s deafening silence on this issue, the international
community is therefore calling on international bodies, particularly the World Bank and the
Cities Alliances Program of UN-Habitat, to freeze cooperation programs with Nigeria.
Therefore we kindly request your Embassy urgently to take up the matter with the
President of the Federal Republic of Nigeria so he can take action to:
1.
Declare an immediate moratorium on forced evictions and demolitions in Port
Harcourt and cause the Government of Rivers State to restore, without any further
delay, the rights of all those that were forcefully evicted from their homes and places
of means of livelihood as prescribed in the Report of the UN-HABITAT Mission to
Port Harcourt, a copy of which is hereto attached.
2.
Proclaim an outright embargo on the use of members of the Nigeria armed forces,
including the police, to carry out any further evictions and demolitions in any part of
Nigeria and urgently set up a Judicial Commission of Inquiry to probe the recent
killing of civilian residents in Gbundu-Ama in Port Harcourt and bring all the
perpetrators to book.
We would be grateful to receive updates on the intervention of your Embassy in regard to
this issue and, therefore, look forwards to hearing from you.

de todos a una vivienda adecuada, expresamos nuestra profunda preocupación por la
actual desalojos forzados ilegales y asesinatos de civiles residentes en Port Harcourt por
el Gobierno del Estado de Rivers, y para protestar contra la el silencio del Gobierno de la
República Federal de Nigeria sobre la cuestión. Los desalojos, que han provocado el
desplazamiento ilegal de más de la mitad de la población de Port Harcourt y escaló hasta
la muerte / la mutilación de los habitantes inocentes de los militares, según nuestras
fuentes de organizaciones no gubernamentales locales, se lleva a cabo por el Gobernador
del Estado, el Sr. Chibuike Amaechi, no para el interés público, según lo dispuesto por la
ley, pero en la satisfacción de su sentimiento étnico y el aumento de personal. Baste
mencionar que los desalojos forzosos, que han durado más de un año y medio y cientos
prestados de miles de personas sin hogar y sin trabajo en Port Harcourt, se llevan a cabo
por el Gobernador del Estado en violación flagrante del debido proceso de ley, el sistema
de retención las órdenes de los tribunales de la jurisdicción competente, la suspensión
solicitada por las Naciones Unidas para los Asentamientos Humanos (ONU-Hábitat) y los
sabios consejos del Delta del Níger Foro de Ancianos, entre otros. Baste con
mencionar que aún a pesar de las cartas de protesta por las organizaciones
internacionales de derechos humanos y las consiguientes reuniones entre las Naciones
Unidas-HABITAT y el Honorable Ministro de Vivienda y Desarrollo Urbano sobre esta
cuestión, el Gobierno de la República Federal de Nigeria ha seguido manteniendo una
fuerte el silencio sobre la situación, mientras que el Gobernador del Estado se mantuvo
empeñado en continuar con los desalojos forzosos ilegales, incluso a expensas de los
recursos del Estado. Hacemos hincapié en que la acción del Gobernador del Estado,
con la consiguiente omisión por el gobierno federal para llevar a cabo la acción del
gobernador adecuadamente, por lo que se refiere a los desalojos forzados ilegales en
Port Harcourt, viola el compromiso de Nigeria para el Programa de Hábitat, sin mencionar
que su contraviene las disposiciones de los tratados internacionales y la jurisprudencia de
los órganos de los tratados ratificados por el Gobierno de Nigeria, de especial importancia
que las disposiciones del artículo 11 (1) del Pacto Internacional de Derechos Económicos,
sociales y culturales con los Nos. General 4 y 7 de la misma. Por la magnitud del
silencio del gobierno federal sobre este tema, le agradeceríamos la demanda de su
embajada la necesidad urgente de tratar el asunto y convencer al Presidente de la
República Federal de Nigeria para manejar la situación y: 1. Declarar la moratoria
inmediata sobre los desalojos forzosos y demoliciones en Port Harcourt y hacer que el
Gobierno del Estado de Rivers para restaurar, sin más demora, los derechos de todos los
que fueron expulsados por la fuerza de sus hogares y lugares de medios de vida según lo
previsto en el Informe de la Misión de ONU-Hábitat a Port Harcourt, cuya copia adjunto.
2. Proclamar un embargo de en el uso de miembros de las fuerzas armadas de
Nigeria, incluida la policía para llevar a cabo ningún desalojo y la demolición de más en
cualquier parte de Nigeria y con urgencia de establecer una Comisión Judicial de
Investigación para investigar el reciente asesinato de civiles residentes en Gbundu - Ama
