Pollutant Release and Transfer Registers
(PRTR)
Article 7.7 of the Negotiating text prepared by the Presiding Officers (“Compilation text”) :
“Each Party shall create, administer and periodically update a pollutant release and transfer register for the
air, water, soil and subsoil, materials and waste in its jurisdiction, among others. The registered information
will be public and electronically accessible and will contain disaggregated and standardized data.”
Legal status in LAC: Relevant legislation in Belize, Chile, México, Peru and Trinidad and Tobago, amongst
others (environmental frameworks laws) ; PRTR regulations in Chile, Mexico, Honduras, Brazil
Belize: Chapter 328 Environmental Protection Act (1992), article 4 (i): [The powers, duties and functions of the Department shall be to-] maintain a register of all
wastes, discharges, emissions, deposits or other sources of emission or substances which are of danger or potential danger to the environment.
Brasil: Instrução Normativa nº 31, de 3 de Dezembro 2009: Art. 1º As pessoas físicas e jurídicas descritas no Anexo I desta Instrução Normativa são obrigadas ao
registro no Cadastro Técnico Federal de Instrumentos de Defesa Ambiental, instituído pelo art. 17, inciso I, da Lei nº 6.938, de 31 de agosto de 1981.

sostenible de los recursos naturales y el desarrollo sostenible del país. Artículo II.- Del derecho de acceso a la información Toda persona tiene el derecho a acceder
adecuada y oportunamente a la información pública sobre las políticas, normas, medidas, obras y actividades que pudieran afectar, directa o indirectamente el
ambiente, sin necesidad de invocar justificación o interés que motive tal requerimiento.
Trinidad y Tobago: Environmental Management Act nº 3 (2000), article 26: “[The Minister may…make rules…for the following] (a) procedures for the registration
of sources from which pollutants may be released into the environment and the characterisation of such sources; (b) the quantity, condition or concentration of
pollutants or substances containing pollutants that may be released into the environment generally or by specific sources or categories of sources;
