SE EXIGE LA LIBERACIÓN DE UN BLOGUERO Y SU AYUDANTE
El bloguero Nguyen Huu Vinh y su ayudante Nguyen Thi Minh Thuy están detenidos sin
juicio en Vietnam desde mayo de 2014, superando el plazo permitido por las leyes del
país. Tras una visita de sus familiares a finales de octubre, preocupa cada vez más la
salud y las condiciones de detención de Nguyen Huu Vinh.
Nguyen Huu Vinh fundó junto con otras personas el popular blog Anh Ba Sam en 2007, conocido por su postura
antichina y sus críticas al gobierno. Él y su ayudante, Nguyen Thi Minh Thuy, fueron detenidos en mayo de 2014
en aplicación del artículo 258.2 del Código Penal por "abuso de las libertades democráticas", un delito que se
castiga con hasta siete años de prisión. La acusación formal se presentó en febrero de 2015, con cargos
relacionados con otros dos blogs políticos, Dan Quyen (Derechos de los ciudadanos) y Chep Su Viet (Escribir la
historia de Vietnam), ambos críticos con las políticas y los funcionarios del gobierno, que las autoridades han
cerrado. Según la acusación, ambos blogs han recibido más de 3,7 millones de visitas.
Según las leyes nacionales, las personas acusadas en aplicación del artículo 258.2 pueden estar inicialmente en
prisión preventiva hasta seis meses, y, tras ser acusadas formalmente, pasar a detención temporal durante un
máximo de 90 días más para preparar el juicio. En este caso, sin embargo, y tras 17 meses de detención, no hay
fijada fecha para el juicio.
Los familiares de Nguyen Huu Vinh han pedido a las autoridades que tanto él como Nguyen Thi Minh Thuy sean
puestos en libertad, sin recibir respuesta. A finales de octubre, en una visita de sus familiares, Nguyen Huu Vinh
dijo a su familia y su abogado que sufría una enfermedad de la piel que le producía un sarpullido por todo el
cuerpo, para la cual no estaba recibiendo tratamiento médico adecuado.
Nguyen Huu Vinh fue policía y es hijo de un ex alto funcionario del gobierno miembro del Partido Comunista de
Vietnam, el partido gobernante, que fue embajador ante la antigua Unión Soviética. Está casado y tiene dos hijos.
Se sabe poco sobre su ayudante, Nguyen Thi Minh Thuy, que en el acta de acusación figura como divorciado y
padre de dos hijos. Nguyen Huu Vinh y Nguyen Thi Minh Thuy son presos de conciencia, detenidos
exclusivamente por el ejercicio pacífico de su derecho a la libertad de expresión.

- pidiendo a las autoridades que pongan a Nguyen Huu Vinh y a Nguyen Thi Minh Thuy en libertad inmediata e
incondicional, ya que son presos de conciencia, detenidos exclusivamente por el ejercicio pacífico de su derecho a
la libertad de expresión;
- pidiéndoles que garanticen que Nguyen Huu Vinh y Nguyen Thi Minh Thuy tienen acceso inmediato a la atención
médica adecuada y que reciben el trato que disponen las Reglas Mínimas para el Tratamiento de los Reclusos de
la ONU.

INFORMACIÓN COMPLEMENTARIA
Vietnam es Estado Parte en el Pacto Internacional de Derechos Civiles y Políticos, que garantiza el derecho a la libertad de
expresión, asociación y reunión pacífica. Sin embargo, estos derechos están muy restringidos en la ley y en la práctica en el
país. Se suelen utilizar artículos redactados muy vagamente del apartado dedicado a la seguridad nacional del Código Penal
de 1999 para criminalizar opiniones o actividades de disidencia pacífica, lo cual pone en peligro a las personas que abogan por
un cambio político pacífico, critican las políticas del gobierno o piden que se respeten los derechos humanos. El artículo 258
(abuso de las libertades democráticas que viola los intereses del Estado, los derechos e intereses legítimos de las
organizaciones y de los ciudadanos) se utiliza con frecuencia para detener, procesar y encarcelar a disidentes por su activismo
pacífico, incluidos blogueros, activistas en favor de los derechos sindicales y los derechos a la tierra, activistas políticos,
practicantes de alguna religión, defensores de los derechos humanos y activistas en favor de la justicia social, e incluso autores
de canciones.
Las condiciones en las cárceles de Vietnam son duras. La alimentación y la atención a la salud son inadecuadas y no cumplen
los requisitos mínimos establecidos en las Reglas Mínimas para el Tratamiento de los Reclusos de la ONU y otras normas
internacionales. Los presos de conciencia permanecen en régimen de aislamiento como castigo o incomunicados durante
largos periodos. También son sometidos a malos tratos, incluidas palizas por parte de otros presos sin que los guardias
penitenciarios intervengan. A algunos presos de conciencia se los traslada con frecuencia de un centro de detención a otro, a
menudo sin informar a sus familiares. Varios han iniciado huelgas de hambre en protesta por los abusos en el trato y las malas
condiciones de detención.

DEMAND RELEASE OF BLOGGER AND ASSISTANT
Blogger Nguyen Huu Vinh and his assistant Nguyen Thi Minh Thuy have been held
without trial in Viet Nam since May 2014, in excess of the time allowed under national
law. Following a visit in late October by his family and lawyer, there are increasing
concerns for Nguyen Huu Vinh’s health and conditions of detention.
Nguyen Huu Vinh co-founded the popular blog, Anh Ba Sam in 2007, which is known for its anti-China posts and
criticism of the government. He and his assistant, Nguyen Thi Minh Thuy, were arrested in May 2014 under
Article 258 (2) of the Penal Code for “abusing democratic freedoms”. This provides for up to seven years’
imprisonment. The indictment was issued in February 2015 setting out charges in connection with two other
political blogs – Dan Quyen (Citizens’ Rights) and Chep Su Viet (Writing Vietnam’s History), both of which were
critical of government policies and officials, and have been shut down by the authorities. The indictment states that
the two blogs had more than 3.7 million page views.
According to national law, suspects charged under Article 258 (2) can initially be held in pre-trial detention for up to
six months, and following indictment, held in temporary detention for a maximum of a further 90 days for trial
preparation. In this case however, after 17 months in detention, no trial date has been set.
Nguyen Huu Vinh’s family have petitioned the authorities for his release and for that of Nguyen Thi Minh Thuy,
without response. In late October, Nguyen Huu Vinh told his visiting family and lawyer that he was suffering from a
skin condition with a red rash covering his body, for which he has not received adequate medical treatment.
Nguyen Huu Vinh is a former policeman and son of a former high-ranking government official and member of the
ruling Communist Party of Viet Nam, who was Ambassador to the former Soviet Union. He is married with two
children. Little is known about his assistant Nguyen Thi Minh Thuy, who is described in the indictment as divorced
with two children. Nguyen Huu Vinh and Nguyen Thi Minh Thuy are prisoners of conscience, detained solely for
exercising their right to freedom of expression.

Viet Nam is a state party to the International Covenant on Civil and Political Rights which guarantees the rights to freedom of
expression, association and peaceful assembly. However, these rights are severely restricted in law and practice in Viet Nam.
Vaguely-worded articles in the national security section of Viet Nam’s 1999 Penal Code are frequently used to criminalize
peaceful dissenting views or activities. Those at risk include people advocating for peaceful political change, criticizing
government policies, or calling for respect for human rights. Article 258 (Abusing democratic freedoms to infringe upon the
interests of the State, the legitimate rights and interests of organizations and/or citizens), is frequently used to detain, prosecute
and imprison dissidents for their peaceful activism, including bloggers, labour rights and land rights activists, political activists,
religious followers, human rights defenders and social justice activists, and even song writers.
Prison conditions in Viet Nam are harsh, with inadequate food and health care that falls short of the minimum requirements set
out in the UN Standard Minimum Rules and other international standards. Prisoners of conscience have been held in solitary
confinement as a punishment or in isolation for lengthy periods. They have also been subjected to ill-treatment, including
beatings by other prisoners with no intervention by prison guards. Some prisoners of conscience are frequently moved from one
detention facility to another, often without their families being informed. Several prisoners of conscience have undertaken
hunger strikes in protest at abusive treatment and poor conditions of detention.
