LEGAL INSTITUTIONS IN THE CONQUEST OF
YUCATAN AND THE FOUNDATION OF MERIDA

RESUMEN: En el presente trabajo el autor expone la interacción cultural e histórica que favorecieron el uso de instituciones
jurídicas especiales en los territorios de la Corona de Castilla. El objetivo específico es identificar y aquilatar el alcance de los
títulos jurídicos que ampararon el proceso de conquista y ocupación de Yucatán así como el sustento fundacional de la ciudad de
Mérida. De manera sistemática y utilizando las fuentes pertinentes, el autor analiza las instituciones jurídicas, las Capitulaciones y
el proceso general de conquista de Yucatán. Asimismo, describe la fundación de Mérida de Yucatán con sus repercusiones
jurídicas e históricas. Para el autor, esto último se trata de un acto formal y solemne que se ajustó a la normatividad aplicable en el
Nuevo Mundo.

ABSTRACT: In this paper the author presents the cultural and historical interaction that favored the use of legal institutions in
the territories of the Crown of Castile. The specific objective is to identify and refine the scope of legal titles that justified the
process of conquest and occupation of Yucatan and the foundational support of the city of Merida. The author examines
systematically and using relevant sources how legal institutions, the capitulations and the general process of conquest of Yucatan.
It also describes the founding of Mérida with its legal and historical implications. For the author, this is a formal act that adjusted
to the applicable regulations in the New World.
