Acknowledgment of Responsibility
Informed Consent: I acknowledge that I have been given the opportunity to participate in a Fulcrum Learning
Systems, Inc. program. There are significant elements of risk in any activity associated with outdoor adventures.
Although we have taken reasonable steps to provide you with appropriate equipment and/or skilled guides so
you can enjoy an activity for which you may not be skilled, we wish to remind you this activity is not without
risk.
Assumption of Risk and Responsibility: I am aware that this activity entails risks of injury to myself and
others for whom I may be responsible. I agree to assume responsibility for the risks identified herein and those
risks not specifically identified, even if arising from the negligence of the releasees or other, and assume full
responsibility for my participation. My/Our participation in this activity is purely voluntary. No one is forcing
me/us to participate. I am (we are) physically and mentally capable of participating in the activity and/or safely
using the equipment. I assume full responsibility for the risks of personal injury, accidents or illness, including
but not limited to sprains, torn muscles and/or ligaments; scrapes, abrasions, and/or contusions; dehydration,
insect bite or attack, and any resultant expenses from any of the foregoing risks. I also assume responsibility for
damage to or loss of my/our personal property as the result of any accident that may occur.
Covenant of Good Faith: I recognize that you, as provider of goods and/or services, will operate under a
covenant of good faith and fair dealing, but that you may find it necessary to terminate an activity or refuse or
terminate the participation of any person for the safety of myself and/or other participants. I acknowledge that
no guarantees have been made with respect to achieving objectives.
Authorization: I hereby authorize any medical treatment deemed necessary in the event of any injury while
participating in the activity. I either have appropriate insurance or, in its absence, agree to pay all costs of rescue
and/or medical services as may be incurred on my/our behalf.
Acknowledgment: “In consideration of services of Fulcrum Learning Systems, Inc., their officers, agents,
employees, and stockholders, and all other persons or entities associated with those businesses, I certify that I
am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself
for bodily injury, loss of personal property, and expenses as a result of those risks and dangers, both know and
unknown, and as a result of my/our negligence in participating in this activity.”
Photography Release: I hereby consent to the use of any program photograph, video/film, and voice quote as a
result of my participation in this program and its use for advertising, publication or exhibiting this program in
perpetuity by all media.
Location and Hosts: This Acknowledgment of Responsibility shall also run to the benefit of the host location
(Wilshire Boulevard Temple – Camp Hess Kramer/Gindling Hilltop, Mountains Recreation and Conservation
Authority – Temescal Gateway Park, City of Culver City, and any other Fulcrum host location), its staff and
any principals affiliated with the host location.
I HAVE READ THE FOREGOING ACKNOWLEDGMENT OF RISK, ASSUMPTION OF RISK,
RESPONSIBILITY AND FULLY UNDERSTAND ITS TERMS.

Acuerdo, Liberación, y Reconocimiento de Riesgo del Participante
En consideración de Fulcrum Adventurues, inc., sus agentes, propietarios, oficiales, voluntarios,
participantes, empleados y todo otro personal y cualquier otras personas o entidades actuando en
cualquier capacidad en su favor (a partir de ahora en adelante colectivamente referido como a
“FULCRUM”), Yo de este momento estoy de acuerdo a liberar y descargar a FULCRUM, a favor
de mi mismo, mis hijos/as, mis padres, mis herederos, asignados, representantes personales y lo
indicado siguiente:
1.
Yo Reconozco que mi participación en actividades a fuera en aire libre basada de aventura por
ejemplo, pero no limitado a montanismo de la roca, cuerdas o cursos estimulantes, caídas de
confianza, iniciativas de equipo, excursionismo, a campar, y natación conllevar (suponer) sabido y
riesgo anticipado cual podría resultar en lesiones físicas o emocionales, parálisis, muerte o danos a
mi mismo, a propiedad o un tercer partido pero esos tales riesgos no pueden simplemente ser
eliminados sin poner en peligro las calidades esenciales de la actividad.
2. Yo expresamente estoy de acuerdo y prometo aceptar y asumir todo razonable riesgo existiendo en
estas actividades. Mi participación en estas actividades es puramente mi voluntad, y yo elijo
participar después de saber de todos los riesgos.
3. Yo desde este momento voluntariamente doy, por siempre descargo, y estoy de acuerdo de
indemnizar y asimiento inofensivo a FULCRUM de cualesquiera o ninguna demanda, petición o
causas de acciones, que en cualquier manera están conectadas con mi participación en estas
actividades o en el uso del equipo y instalaciones de FULCRUM, incluyendo cualquier demanda
alegue que actos negligentes o omisiones de FULCRUM pero no al excluir negligencia gruesa,
intencional o actos de maldad.
4. Si FULCRUM o cualquier actuando en su favor, sea requerido para incurrir honorarios del
abogado y costos para hacer cumplir este acuerdo. Yo estoy de acuerdo a indemnice y asimiento
de ellos inofensivos de todos los honorarios y costos si una acción es comenzada Y FULCRUM es
determinado por una corte de ser el partido prevalecer.
5. Yo certifique que tengo seguro adecuado para cubrir cualquier lesión o daño que pueda sufrir
mientras participe o estoy de acuerdo de llevar (hacer mi responsabilidad) los costos de cualquier
lesión o daño a mi mismo. Y Yo además certifique que yo no se de ninguna condición medica o
física que me interfiera con mi seguridad en estas actividades o además estoy queriendo y
asimilando los costos de todos riesgos que puedan ser creados directamente o indirectamente de
cualquier o tales condiciones.
6. Los partidos están de acuerdo a someter arbitraje obligatorio en cualquier conflicto al respecto los
términos o interpretación de este acuerdo.
7. Las leyes del estado de California gobiernan la resolución de cualquier conflicto al respecto a este
acuerdo.
Yo ha tenido suficiente oportunidad para haber leído este documento entero. Yo lo he leído y lo entiendo,
y estoy de acuerdo a todos términos. Yo entiendo que fotos y videos serán tomadas durante el programa y
puedan ser usados para promociones y publicidad.
