This work is focused on the construction sector. It is known that this sector mainly
carries out productive activities where different companies coincide at the same working
place in a simultaneous and/or successive way. Therefore, a lack of coordination between
them increases risk prevention matters.
If in a normal situation it is difficult to coordinate different people working at the
same working place, the risk matters increase considerably in a much more complicated
place as the one it is being referred. As a consequence, a specific regulation with preventive
measures has been created.
This is why this academic work expects to determine the juridical status which has to
guide developer in health and safety regime. Developer obligations and responsibilities will
be explained. At the same time, the complexity to impose the developer benefits surcharge
payment will be remarked.

El sector sobre el que se realiza este trabajo es el de construcción, en él sabemos que
mayoritariamente se llevan a cabo actividades productivas, coincidiendo varias empresas de
forma simultánea y/o sucesiva en un mismo lugar de trabajo por lo que cualquier
descoordinación entre ellas da lugar a un aumento del riesgo laboral.
Si en una situación normal, es complicado coordinar a varias personas trabajando en
un mismo centro de trabajo, en un lugar tan complicado como al que nos referimos, los
riesgos aumentan considerablemente, lo que ha provocado la creación de una normativa
específica con medidas preventivas también específicas.
Por ello con este trabajo se pretende delimitar el régimen jurídico por el que se rige
el promotor en el ámbito de prevención de riesgos laborales y para ello explicaremos tanto
sus obligaciones como sus responsabilidades, así como, dejar clara la complejidad existente
para imponer al promotor el pago del recargo de prestaciones.
